Terms of Service

There are certain subjects and themes I can’t/won’t draw, and will decline the commission without a detailed explanation as to why. If your commission inquiry includes any of them, you will be notified. From there on, we can discuss alternative options/ideas, or cancel the commission.

Process & Disclaimers

Getting Started

Email Me: Commission inquiries must be made and confirmed via email (ghilenan@gmail.com).
Other People & their Intellectual Property: If your commission involves another real person or their intellectual property (characters, concepts, etc), the commission has to be confirmed by them as well. Some exceptions can be made on a case by case basis and within reason.
Payment Upfront: I will start working on the commission once the invoice is paid for. See more details in the next section.
Time Frame: Your commission will be finished from 3 days to 3 months after the payment is cleared. Should your commission be delayed beyond this time frame, you will be notified.
Deadlines: All specific deadlines must be stated and discussed in advance to ensure that they are met either by me, or another artist. Extra fees may apply if your deadline is close.
Private Commissions: By default, I will share the finished piece(s) online along with your social media username. If you'd like to be referred to as 'private client' instead, or would like me to not share the piece(s) online, please let me know in advance.

In Progress

WIPs: Unless requested otherwise, I will provide you with Work In Progress shots of the commission after every applicable stage (thumbnail, sketch, colors). This gives you the opportunity to give me corrections and additional info applicable to the specific stage.
Correspondence: Please refrain from sending excessive inquiries for updates, I will keep you posted regarding any news on the status of your commission.
In Progress Edits: Upon receiving the WIP, you are advised to state any and all edits you'd like me to make before I move on to the next stage. You are entitled to having each stage of your commission edited* twice. Unless caused by my mistake, any further and/or major changes will be made for an additional fee only. I will cancel your commission if I sense that you are trying to scam me into doing more work than you've paid for, and you will be blacklisted.
*I will remake the thumbnail twice before moving on to the sketch phase. All stages beyond that will only be modified.

Completed

Output: Once your commission is completed, the full resolution image will be uploaded to my Google Drive, and shared with you via email as a reply to the commission inquiry thread.
Post-completion Edits: After the final version is approved by you, up to 2 minor changes will be made free of charge (color alterations, small tattoos/scars/markings, etc) within 5 business days following the approval. Any further edits will be discussed on a case by case basis, and will come with an additional fee.
Personal Use: By default, all my commissions are made for personal use (posting on social media for non-commercial purposes, making personal prints, using as icons/headers, attaching to character sheets, etc).
Commercial Use: Purchasing the commercial rights to the artwork will be discussed on a case by case basis. With said purchase, it will be within your legal rights to alter the material, use it for merchandise, as book illustrations, etc, with only the credit provided to me as the artist.
Cryptocurrency & AI: Under no circumstances will I approve the use of my artwork as NFTs or other forms of cryptocurrency, or feeding said artwork to AI and its related technologies for any purpose. Doing this will result in you being blacklisted and may be followed up with legal action.

Payment

Currency: Payment is accepted only in USD.
Payment Methods: I accept payment via PayPal and Ko-fi. Please do not transfer the funds without an invoice / confirmation from me.
Transfer Fees: As of now, the transfer fee is 6% and it will be included in the invoice/confirmation email.
Advance Payment: Payment must be made in advance for all commissions under $500. Anything totaling $500 and above can be split 50/50. In the event that you choose this option, I will send you a small preview of the finished illustration, and the full resolution image once the second half of the payment is made.

Refunds

Payment is refundable only until I've presented you with the sketch of your commission, or in the event that I am unable to complete it before the deadline / within the promised time frame (3 days - 3 months). If you would prefer to receive the finished commission rather than a refund, we can discuss a new deadline.
Refunds will be made within 24-48 hours after the initial request.

Please note that while I will not ask you to state a reason for requesting the cancellation of your commission, any suspicious activity in this regard will affect whether I'll accept any future commissions from you or not.

Filing a dispute for the transfer without having contacted me, or doing so after you've been provided with the sketch for your commission, is a violation of my Terms of Service, and will permanently ban you from my services and revoke your rights to any works commissioned from me to date. In addition, you will be put on a public blacklist for other artists to see and be wary of.

Please, either attach the character reference(s), or provide links to them. Written descriptions will be accepted only alongside visual references.

Instructions

If you'd like to use PayPal to pay for your commission(s), please include the email address that you use for your PayPal account, so I can send you an invoice when all details are discussed and agreed upon.
If Ko-fi is your preferred method of payment, please indicate so in your commission form so that I can provide you with the appropriate information.
Please be clear on the subject of the commission. This will ensure that it's completed in a timely manner, to your satisfaction, and without any unnecessary hiccups. Rough concept sketches and doodles are more than welcome.

By submitting a Commission Form, you agree that you have read and accepted these Terms of Service, and have every intention to commit to this exchange.
