• Internet Access: Required to generate and fetch images. We do not collect any personal information through this permission. 

Children Privacy

Our app is not intended for use by children under the age of 13. We do not collect any personnel information from children under the age of 13.

Content Restrictions

We do not allow the creation or distribution of the following content:

• Depictions, animations, or illustrations of sex acts.

• Sexual nudity or sexually suggestive poses where the subject is nude, blurred, minimally clothed, or wearing clothing that would not be acceptable in a public context.

Use of the App

You agree to use the App solely for lawful purposes and in accordance with these Terms. You shall not:

• Use the App to generate content that is illegal, offensive, or violates any third-party rights.

• Use the App to create or distribute malware or engage in any form of cyber attack.

Image Generation and Ownership

• User Input: You retain ownership of all input provided to the App, including text prompts.
  
  

• Generated Content: Upon generation, you are granted full ownership of the resulting images, including the right to use them for commercial purposes.
  
  

• No Liability: We do not assume any liability for the content you generate. You are solely responsible for ensuring that your generated images do not infringe upon any third-party rights.

No Affiliation with Third-Party Platforms

Our application is an independent application and is not affiliated, associated, authorized, endorsed by, or in any way officially connected with Midjourney, DALL·E (OpenAI)

Any references to these platforms in our app description, store listings, or marketing materials are purely for illustrative purposes — to help users understand the quality or type of AI-generated art they can expect from our app. These references do not imply any partnership, endorsement, or shared technology.

All trademarks and brand names mentioned are the property of their respective owners.

Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Any interruption or cessation of transmission to or from the App.

Indemnification

You agree to indemnify, defend, and hold harmless Proya and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with:

• Your violation of any rights of another party.

Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason.
