These Terms of Service ("Terms") govern your use of the mobile game Gem Sort: Color Match Puzzle (the "Game"), provided by yalin zhang ("we", "us", "our"). By downloading, installing, or playing the Game, you agree to these Terms. If you do not agree, please do not use the Game.
We grant you a personal, non-exclusive, non-transferable, revocable license to install and play the Game on a device you own or control, for your personal, non-commercial entertainment. You may not copy, modify, reverse-engineer, decompile, redistribute, sell, or create derivative works from the Game, except to the extent such restriction is prohibited by applicable law.
The Game is intended for a general audience and is not directed to children under the age of 13 (or the minimum age required in your country). If you are a minor, you may use the Game only with the involvement and consent of a parent or legal guardian.
The Game may include virtual currency and items such as coins, gems, and boosters ("Virtual Items").
Virtual Items are part of the Game and are licensed to you, not sold. They have no monetary value and cannot be exchanged for real money or transferred outside the Game.
Virtual Items are currently earned through gameplay and are not sold for real money. If paid purchases are introduced in the future, additional purchase terms will apply.
Virtual Items are non-refundable except where required by law. We may modify, manage, or remove Virtual Items, and your balance may be lost if you uninstall the Game, clear app data, or lose access to a device, unless cloud save is enabled and successfully syncs.
The Game is free to play and is supported by third-party advertising, including rewarded video, interstitial, and banner ads (provided through networks such as AppLovin MAX, Unity, and Google). By using the Game you acknowledge that ads will be shown. Where required by law, we will request your consent before showing personalized ads. You can manage ad personalization via your device settings (for example, resetting or limiting your Advertising ID).
You agree not to: (a) cheat, exploit bugs, or use unauthorized third-party software, bots, or modifications; (b) interfere with or disrupt the Game or its servers; (c) attempt to gain unauthorized access to the Game, other users' data, or our systems; or (d) use the Game for any unlawful purpose.
All content in the Game — including code, graphics, audio, characters, and design — is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or content except the limited license in Section 1.
Your use of the Game is also governed by our Privacy Policy, available at: https://sites.google.com/view/gem-sort/gemsortprivacypolicy/privacypolicy
The Game is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or Virtual Items, arising from your use of (or inability to use) the Game. Where liability cannot be excluded, it is limited to the amount you paid us for the Game in the 12 months before the claim (which, for a free game, may be zero).
We may update, change, suspend, or discontinue the Game (or any feature) at any time without notice. We may also update the Game automatically through the app store.
We may suspend or terminate your access to the Game if you violate these Terms. You may stop using the Game at any time by uninstalling it. Sections that by their nature should survive termination (e.g., Sections 6, 8, 9) will survive.
We may revise these Terms from time to time. Material changes will be reflected by updating the "Effective Date" above and, where appropriate, by an in-app notice. Your continued use of the Game after changes take effect constitutes acceptance.
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law principles, except where mandatory local consumer-protection laws of your country of residence apply.
