Garthmath Terms of Use

Thanks for using Garthmath! These Garthmath Terms of Use (as amended from time to time, the “Terms”) are applicable to Garthmath, an online learning tool, and related contents, features and functionality (together, the “Services”) provided to users (“you” or “your”) by Wang Dong, the developer (“we”, “our” or “us”).

1. Your Acceptance of These Terms These Terms form a contract between you and us, which does not require any physical, electronic or digital signature. Your consent to these Terms constitutes the prerequisite for you and/or your child to use Garthmath and/or our Services, so please read these Terms carefully before using.

Use of Garthmath (including but not limited to download, installation, browse, activation, registration, login, use, paying for use) by you and/or your child signifies your agreement to these Terms. If you do not accept these Terms, you and/or your child shall not use Garthmath in any manner.

Any user who has not created an account with Garthmath will become a non-registered user from the moment Garthmath is used by them, and shall abide by all the terms herein other than those applicable to registered users.

These Terms contain important provisions related to children. Any user under 13 years old or the minimum age legally permitted in your jurisdiction to use services shall not use Garthmath without their parent’s or legal guardian’s permission. If you are a child user, you should review these Terms with your parent or legal guardian to make sure that you and your parent or legal guardian fully understand and agree to them. If you are a parent or legal guardian accepting these Terms on behalf of your child, you are responsible for the compliance with these Terms by you and your child. Any use of Garthmath by a child shall be deemed to have been permitted by and under the supervision of their parent or legal guardian.

These Terms contain important provisions on purchase and payment. All purchases and payments within Garthmath are processed exclusively through the Apple App Store and must be operated by an adult. To the maximum extent permitted by applicable laws and Apple's policies, no refund request will be accepted for our Services on the ground of a child user’s purchase or payment by mistake or accident.

If you and/or your child continue to use Garthmath and/or our Services after these Terms have been updated, you shall be deemed to have agreed to be bound by the updated version hereof. If you do not agree, you and/or your child shall cease using Garthmath.

2. User Privacy We attach great importance to the protection of user personal information. We will collect, use, preserve and share your and/or your child’s personal information in accordance with these Terms, our Privacy Policy, and applicable laws. We may synchronize your and/or your child’s personal information among your different mobile devices, in order to provide you and/or your child with better services.

You shall read and agree to our Privacy Policy before using Garthmath. Using Garthmath suffices the consent to our Privacy Policy. If you do not agree to the terms thereof, you and/or your child shall immediately stop accessing or using Garthmath.

3. Child User Protection

• 3.1 We attach great importance to child user protection. In accordance with applicable laws, you acknowledge and undertake that you are an adult or the parent and/or legal guardian of a child user. We provide Garthmath to a child user only after his/her parent and/or legal guardian has fully read and agreed to these Terms.

• 3.2 Parents and/or legal guardians shall guide their children to pay attention to the safety of accessing the Internet. Payment is not allowed to be made by child users to Garthmath, and only a parent and/or legal guardian may process payment via their Apple ID.

• 3.3 The protection of child users’ personal information will be implemented strictly following our Privacy Policy and applicable laws.

4. Our Services, Subscription and Payment

• 4.1 For purpose of these Terms, Garthmath and/or our Services include:

  • Answer-Searching: Our AI algorithm for providing an answer to your question by uploading a picture of the question, taking a photo of the question, or directly inputting text on Garthmath;

  • Subscribed Services: If you subscribe to our value-added paid services, you will become a subscribed member and receive access to premium features and in-depth responses; and

  • Our other services provided to users.

• 4.2 The official Garthmath mobile application is available exclusively on the Apple App Store. Apple App Store is the only authorized channel to download the Garthmath app and purchase subscriptions. We do not recognize the validity of any products and/or services obtained through any other channels. All risks and liabilities arising therefrom shall be assumed by you.

• 4.3 Subject to these Terms, we grant you and/or your child a limited, revocable, non-exclusive, non-transferable, non-sublicensable right and license to access and use Garthmath and/or the search feedback derived therefrom (the “Derivative Contents”); however, you have no title or intellectual property rights in any of the Derivative Contents.

• 4.4 We reserve the right to stop or amend any of our Services in our sole discretion without prior notice to you.

• 4.5 Use of Garthmath requires one or more compatible iOS devices and Internet access. You acknowledge and agree that such system requirements are your responsibility.

5. User's Account

• 5.1 Account Registration: To fully access and use Garthmath, you need to log in through your Apple or Google account. As a requirement for accessing and/or using Garthmath, we may collect and process your personal data in accordance with the Garthmath Privacy Policy. You agree that all information you provide to register with Garthmath is governed by our Privacy Policy. You shall be responsible for all actions taken under your account. You agree to notify us immediately of any unauthorized access to or use of your Garthmath account.

• 5.2 Account Management: You are not allowed to register any Garthmath account by using false information, impersonating someone else or using someone else’s account. We reserve the right to terminate our Services to you and to take proper actions if you violate these representations.

• 5.3 Protection of Account: Ownership of your Garthmath account is vested in us and you and/or your child only has limited access to it. You shall keep the account secure, and shall not give, transfer, lend, lease, sell, share or use the account with others.

• 5.4 Cancellation of Account: You may cancel your Garthmath account at any time via the in-app settings. Please note that cancellation of an account is irreversible. We cannot help you retrieve any content or information related to your account once deleted. Please note that deleting your Garthmath account does not automatically cancel your App Store subscription. You must manage your subscriptions directly through your Apple ID settings.

6. User Code of Conduct

• 6.1 User Rights: You and/or your child may only use Garthmath for lawful purposes. You shall not upload any contents that are in violation of applicable laws and regulations; infringe on our or any third party’s intellectual property rights; defame others, involve sexual harassment, racial discrimination or are harmful to minors; or contain any virus that may damage computer systems.

• 6.2 User Obligations: You understand and agree that you and/or your child shall not engage in any of the following activities:

  • Reverse engineer, disassemble, decompile, or otherwise attempt to discover the source code of Garthmath;

  • Interfere with or disrupt Garthmath or the servers and/or networks connected to Garthmath;

  • Use any manual process or automated device (robot, spider) to monitor or copy Garthmath;

  • Attempt to gain unauthorized access to any parts of our Services;

  • Falsify or otherwise manipulate the learning materials in such a way that it is mistaken for being transmitted by us.

7. Price, Subscription and Payment (App Store Only)

• 7.1 We charge fees for our value-added subscribed Services exclusively through Apple App Store In-App Purchases.

• 7.2 Subscribed Services are available in various billing cycles (e.g., weekly, monthly, or annual subscriptions) as displayed on the purchase screen. All payments are processed and managed entirely by Apple in accordance with the Apple Media Services Terms and Conditions. Apple acts as the Merchant of Record, meaning Apple handles all payment processing, tax collection (including VAT/GST), and billing inquiries.

• 7.3 Auto-Renewal: A subscription for the value-added Services will automatically renew unless auto-renew is turned off in your Apple ID Account Settings at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

• 7.4 Cancellation and Refunds: You may manage and cancel your subscriptions by going to your Apple ID Account Settings after purchase. Because all transactions are processed by Apple, we cannot directly issue refunds. Any refund requests must be submitted directly to Apple Support and are subject to Apple’s standard refund policies.

• 7.5 We establish different rate standards depending on the subscription period and may adjust the rates from time to time at our sole discretion, subject to App Store notification policies.

8. Intellectual Property and AI Technologies

• 8.1 All the intellectual property rights (including without limitation patent rights, trademark rights, copyrights, trade secrets) of the software, interface, and branding of Garthmath belong to us.

• 8.2 Without our prior written authorization, you shall not use, modify, adapt, translate, or create derivative works relating to Garthmath.

• 8.3 AI Contents (Powered by Google Gemini)

  • 8.3.1 To deliver our core learning features, Garthmath integrates with third-party Artificial Intelligence services, specifically the Google Gemini model provided by Google LLC. Answers, step-by-step solutions, and educational feedback generated during your use of the App (“AI Contents”) are the products of this AI system.

  • 8.3.2 You understand and acknowledge that we cannot fully predict, edit, or strictly control the creation and substance of AI Contents. Garthmath is not responsible for the absolute accuracy, completeness, or reliability of the AI Contents. You should verify critical educational information independently.

  • 8.3.3 You acknowledge that AI language models may generate false, inaccurate, or incomplete information, or output that might be deemed inappropriate. All ideas, thoughts, and responses expressed in the AI Contents are not attributable to us, and any liability for such contents is explicitly excluded to the fullest extent permitted by law.

  • 8.3.4 As stated in our Privacy Policy, your inputs and uploaded images are processed by Google LLC solely to generate immediate responses and are not used to train Google's foundational AI models.

• 8.4 You represent that all texts, images, and data uploaded by you to Garthmath are owned by or legally authorized to you. You grant us a permanent, irrevocable, non-exclusive license to use such contents strictly to provide and improve the Services.

9. Modification and Termination

• 9.1 We may change, suspend or terminate Garthmath and/or our Services at any time, in which event we shall not be liable for breach of contract to you or any third party.

• 9.2 We have the right to suspend or terminate your account or right to access Garthmath if you breach these Terms.

• 9.3 We may amend these Terms at any time by posting the amended terms within the App. Your continuously using of Garthmath following the posting of the revised Terms signifies that you accept and agree to the changes.

10. Disclaimer

• 10.1 YOU UNDERSTAND AND ACKNOWLEDGE THAT GARTHMATH IS PROVIDED IN A FORM CONSISTENT WITH EXISTING TECHNOLOGY, THAT WE DO NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES FOR GARTHMATH, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR CERTAIN PURPOSES, CORRECTNESS, OR TIMELINESS.

• 10.2 GARTHMATH IS NOT A SUBSTITUTE FOR FORMAL EDUCATION, PROFESSIONAL TUTORING, OR CERTIFIED ACADEMIC ADVICE.

• 10.3 WE DO NOT UNDERTAKE ANY DIRECT, INDIRECT, INCIDENTAL, DERIVATIVE OR PUNITIVE DAMAGES FOR LOSS OF PROFITS, DATA, OR TANGIBLE/INTANGIBLE LOSSES ARISING FROM THE USE OR INABILITY TO USE GARTHMATH.

• 10.4 UNLESS OTHERWISE PROVIDED HEREIN, THE TOTAL LIABILITIES THAT WE SHALL BE RESPONSIBLE FOR HEREUNDER SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES CHARGED BY US FOR OUR SERVICES TO YOU.

11. Indemnification To the extent permitted by applicable laws, you agree to indemnify and hold harmless us, our officers, directors, employees, and our AI service providers (Google LLC) from and against any and all claims, demands, liabilities, costs, or expenses, including reasonable legal fees, resulting from your breach of these Terms, your misuse of the App, or your infringement of any third-party intellectual property rights.

12. Governing Law and Dispute Resolution These Terms shall be governed and construed by the laws of the State of California, USA (other than its conflict of laws rules).

To the fullest extent permissible by law, any dispute of any kind between you and us in connection with or arising out of your use of our Services shall be resolved through friendly negotiations. In case of failure of such negotiations, any dispute, controversy, difference or claim arising out of or relating to this Terms shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted.

UNLESS YOU OPT OUT AND EXCEPT OTHERWISE PROVIDED IN THESE TERMS, YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
