General
1. By confirming an order, you agree to the terms of service presented in this document.
2. As an artist, I reserve the right to:
• Change the terms as I see fit. The changes will not affect customers who have already agreed to it previously.
• Refuse an order if it is not within the limits given in part 3 of the Terms (Work and review methods).
• Canceling an order, and payment will be refunded in full or in part depending on the reason.
• Refuse orders on behalf of third parties, however art gift orders will be accepted.
3. All communication will be carried out via e-mail, and other methods of contact will not be accepted, unless requested by the artist.
Work method and review
1. The work will not be accepted if it contains something related to the following themes:
• Themes with visibly explicit violence.
• Themes considered offensive aimed at any type of marginalization or prejudice.
• Non-consensual situations.
2. Specific desires or fetishes that don’t fit into the themes mentioned above must be discussed privately to gain approval.
3. I commit myself to complete the orders in the order that they are requested, which can be changed if necessary (for reasons of priority, such as commemorative dates, or reasons of commitment, such as finishing levels)
4. I will send the sketch for approval before proceeding with painting and finishing, except in cases of draft order or cases where there is a previous request by the customer.
5. During the drafting process, it will only be made 3 revisions for change. During each review, the customer is advised to make a list of all elements to be changed. If more changes are needed, an additional charge will be made according to the complexity and time to place the order.
6. Except for draft orders, the customer can request small changes to the final product without an additional charge (if the change is considered complex, it will be communicated and requested authorization from the customer before being made). These changes will have the same procedure mentioned above, with a limit of 3 revisions.
Image Rights
1. By default, I reserve all image rights to my art. Rights covering the use, publication, repost, alteration and sale of prints. The character itself is a patrimony and creation of the client.
2. The customer has the right to repost a lower resolution version of the related order, provided that my signature is visible or the credits are properly presented. The customer may also use the published image for personal uses, such as:
• Icons
• Banners
• Stickers
• Publications on social networks for personal use
3. The customer has the right to print a high resolution copy of the order for his private use such as:
• Portrait pictures
• Posters
• Banners
• Cups and mugs
• Stickers
• Decor Prints
4. Full rights to my artwork may be purchased for an additional fee. Permission for publication or resale may also be granted under a royalty concession agreement. Details must be discussed in private.
Deadlines and Updates
1. By default, I will strive to complete my orders within 3 months.
2. The customer can assign a delivery date to their order, for a non-negotiable additional fee, depending on the time required and complexity of the order. Details should be discussed in private.
3. I reserve the right to prioritize my orders based on their delivery dates.
4. I reserve the right to refuse the order for a delivery date if I deem it necessary based on my personal schedule.
5. I will endeavor to keep the customer updated on the status of their order as they progress through the manufacturing process. If there is no update reported within 7 days after the previous one, the customer has the right to contact me to inquire about the order, however, there may not be any changes to report.
Payments
1. Payments will be made through Paypal for customers residing abroad. The amount will be charged exclusively in US Dollars (USD).
2. Payments will be made by credit card, bank transfer, bank slip or pix for customers residing in Brazil. The amount will be charged exclusively in Brazilian real (BRL).
3. Payments will be made in advance (Whether the Full Value or 50% down payment, and the other 50%, upon delivery of the product. Note: The final version of the artwork will only be delivered upon completing the full payment.)
4. I will not start the order until at least part of the payment is realized.
5. Customers can request a full refund under the following situations:
1. The customer cancels the order before it starts;
2. The artist cancels the order for personal reasons. If the order is in an advanced stage, the customer will have the right to ask for the incomplete artwork if desired, receiving only 50% of the amount paid as a refund.
6. Clients can request a partial refund of 50% of the amount paid if they request a cancellation during the sketching process.
7. If the client requests a cancellation after the sketching process, a refund will not be applied.
Artist's Notes
1. I don’t work full-time with illustration, so I work on orders according to my available time, which is shared with my current registered job and other responsibilities. Please keep this in mind when placing an order.
2. Working with illustration requires commitment, discipline and sacrifices, which affect my personal life on a daily basis (expenses, health, emotional exhaustion, etc...). This is reflected in the prices shown. I sincerely ask for your understanding and in the face of any misunderstandings that may occur, I will be open to dialogue.
