By using the Service on any computer, mobile phone, tablet, or other device (collectively, the “Device”), you, as a user of the Service, confirm that you have read, understand, and agree to be bound by these Terms of Use and any other applicable law.
XSoft (“We,” “Us,” or “Our”) may change these Terms of Use at any time without notice, effective upon their posting in the App. Your continued use of the Service after such changes are posted constitutes your acceptance of the revised Terms of Use. If you do not agree to these Terms of Use, please do not use the Service.
Subject to these Terms of Use, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to use the Service solely for your personal, non-commercial purposes.
This license does not allow you to use the Service on any Device that you do not own or rightfully control, and you may not distribute or make the Service available over a network where it could be used by multiple devices at the same time.
You may not rent, lease, lend, sell, redistribute, or sublicense the Service. You may not copy (except as expressly permitted by this license or the terms of the relevant certified application store from which you have downloaded the App), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Website or the App, any updates, or any part thereof, except to the extent such restriction is prohibited by applicable law.
Any attempt to do so is a violation of our rights as a licensor. If you breach this restriction, you may be subject to prosecution and damages.
All intellectual property on the Service, including materials protected by copyright, trademark, or patent laws, is proprietary either to us or to third parties.
All trademarks, service marks, and trade names are owned, registered, and/or licensed by us. All content offered by the Service, including but not limited to text, software, scripts, code, designs, graphics, interfaces, illustrations, interactive features, and other content (the “Content”), is our intellectual property or is used under appropriate rights or licenses. All rights are reserved.
Any and all issues regarding the collection, use, storage, and processing of your personal information are governed by our Privacy Policy.
Gapday may request access to information available on your Device, such as photo metadata, including dates, times, and location information, to provide features that help you review and organize your travel history and identify days for which location data may be unavailable.
You should read our Privacy Policy carefully to understand how your information is handled.
By using features that require access to information on your Device, you acknowledge that such access is subject to the permissions you grant to the App.
Gapday: State, Country Tracker is free to download, with optional paid features available through in-app purchases.
Some features may require a one-time purchase, subscription, or other in-app purchase to access. Pricing and available purchase options are clearly displayed within the App before purchase.
Payment will be charged to your Apple ID account at confirmation of purchase.
If subscriptions are offered, they will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. You can manage or cancel subscriptions through your Apple account settings.
All purchases are subject to the applicable terms and policies of the App Store.
You agree to use the Service only for lawful purposes and in accordance with these Terms of Use.
You may not:
Use the Service in any way that is unlawful, fraudulent, defamatory, threatening, abusive, obscene, or otherwise objectionable;
Use the Service to infringe or violate the intellectual property, privacy, publicity, or other rights of any third party;
Attempt to gain unauthorized access to the Service, its systems, or related services;
Interfere with or disrupt the operation or security of the Service;
Introduce viruses, malware, or other code designed to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment;
Copy, modify, distribute, sell, lease, sublicense, or otherwise exploit the Service except as expressly permitted by these Terms of Use or applicable law;
Use the Service for any purpose that violates applicable laws or regulations; or
Transfer or assign any rights or obligations under your agreement with Us to any third party.
You are responsible for ensuring that you have the necessary rights and permissions to access and use any information or content available on your Device in connection with the Service.
Gapday may allow you to use information stored on your Device, including photo metadata such as dates, timestamps, and location information, to reconstruct or organize your travel history.
You retain ownership of your personal data and information.
We do not claim ownership of your personal photos or other personal content merely because you use the Service.
The Service may process information you provide or authorize the App to access solely to provide the requested functionality, subject to our Privacy Policy.
When the Service allows you to export information, the resulting file or report is generated from the data available to and processed by the App. You are responsible for reviewing exported information for accuracy and completeness before using or sharing it.
Gapday is designed to help you organize and review location-related information and identify days for which available data may be incomplete or unavailable.
The Service is provided for informational and organizational purposes only. Gapday does not provide legal, tax, immigration, residency, accounting, financial, or other professional advice.
Information displayed by the App may depend on the availability, accuracy, and completeness of data on your Device, including photo metadata and location information. The App may not have access to all relevant records or information and may therefore be unable to determine your actual location or activities for every day.
You should not rely solely on information provided by the App for legal, tax, immigration, residency, compliance, or other decisions that require complete or independently verified records. If you need professional advice or official documentation, you should consult an appropriately qualified professional or relevant authority.
To the maximum extent permitted by applicable law, the Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the Service or the accuracy, completeness, reliability, timeliness, or usefulness of any information provided through the Service.
We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, non-infringement of third-party rights, and fitness for a particular purpose.
We do not warrant that:
The Service will always be available or uninterrupted;
The Service will be error-free or that errors will be corrected;
Information displayed by the Service will always be accurate, complete, reliable, current, or available;
The Service will identify every location, trip, or missing day; or
Any exported information will be sufficient for any particular legal, tax, immigration, residency, compliance, or other purpose.
You acknowledge that your use of the Service is at your own risk.
Some jurisdictions do not allow the exclusion of certain warranties. Accordingly, some of the above exclusions may not apply to you.
The Service may not be available in all languages or in all countries, and we make no representation that its functionality is appropriate, accurate, or available for use in any particular location. Service availability and pricing are subject to change.
This disclaimer constitutes an essential part of these Terms of Use.
These Terms of Use are effective until terminated by either you or us.
You may terminate these Terms of Use at any time by discontinuing your use of the Service and uninstalling the App.
If you violate these Terms of Use, your permission to use the Service may automatically terminate.
We may, in our sole discretion, suspend or terminate these Terms of Use or your access to all or part of the Service at any time and for any reason, to the extent permitted by applicable law.
Upon termination of these Terms of Use, you must discontinue use of the Service and uninstall the App from your Devices.
The following provisions survive the expiration or termination of these Terms of Use: Intellectual Property, Privacy, User Data and Device Information, Disclaimer, Indemnity, Severability, and any other provisions that by their nature should survive termination.
These Terms of Use and the Application Privacy Policy constitute the entire agreement (the “Agreement”) between you and us regarding the subject matter of the Service.
Anything contained in or delivered through the Application that is inconsistent with or conflicts with the terms of this Agreement is superseded by the terms of this Agreement.
These Terms of Use may not be modified, in whole or in part, except as described elsewhere in these Terms of Use or as otherwise permitted by applicable law.
You agree to defend, indemnify, and hold harmless Us, including our officers, directors, employees, agents, subcontractors, licensors, suppliers, affiliated companies, organizations, successors, assigns, and licensees, from and against any claims, actions, demands, damages, losses, liabilities, judgments, settlements, costs, or expenses (including reasonable attorneys’ fees and costs) arising directly or indirectly from or relating to:
Your breach of these Terms of Use;
Your misuse of the Service;
Your violation of any law or regulation;
Your violation of the rights of any third party; or
Any other matter for which you are responsible under these Terms of Use or applicable law.
You agree that your use of the Service shall comply with all applicable laws, regulations, and guidelines.
We reserve the right to assume the exclusive defense and control of any demand, claim, or action arising in connection with the Service. You agree to fully cooperate with us in the defense of any such demand, claim, settlement, or compromise negotiation.
If any provision of these Terms of Use is held to be unenforceable by a court or other tribunal of competent jurisdiction, that provision shall be amended, limited, or eliminated to the minimum extent necessary so that the remaining provisions of these Terms of Use remain in full force and effect.
