Terms of Service

1. Introduction: These terms of service govern your use of our virtual reality game Funky Fungus. By accessing or using Human Touch 2, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use Funky Fungus.

2. Eligibility: To play Funky Fungus, you must be at least 10 years of age. If you are under the age of 10, you may not use Funky Fungus.

3. License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Funky Fungus for your personal, non-commercial use.

4. Prohibited Conduct: You may not use Funky Fungus for any illegal or unauthorized purpose. You must not, in the use of our Game, violate any laws in your jurisdiction (including but not limited to copyright laws).

5. User Content: We allow you to submit, upload, publish or otherwise make available content, including but not limited to gameplay footage and screenshots (“User Content”). By making any User Content available through our Game, you grant to us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with Funky Fungus and our business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

6. Termination: We reserve the right to terminate or suspend your access to our Game at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

7. Disclaimer of Warranty: Funky Fungus is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representation or warranty of any kind, express or implied, as to the operation of Funky Fungus or the information, content, materials, or products included on Funky Fungus.

8. Limitation of Liability: To the fullest extent permitted by law, in no event shall we be liable for any damages whatsoever, including but not limited to any direct, indirect, special, incidental, consequential or punitive damages, arising out of or in any way connected with the use of or inability to use Funky Fungus or for any content obtained from or through Funky Fungus.

9. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the country in which you reside, without giving effect to any principles of conflicts of law.

10. Changes to these Terms: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 day's notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
