They blew up thousands of Nazi supply trains, destroyed power plants and other military and strategic targets, and carried out complicated smuggling and rescue missions.

On their return to MCAS El Toro, Calif., in 1959 the squadron received the Vought F8U-1 Crusader. Assigned to Carrier Air Group 14 aboard the USS Lexington in 1961, VMF-323 was the first Marine F-8 squadron to go on cruise with the Crusader. When VMF-323 returned from the Western Pacific they were outfitted with the improved F8U-2 version of the Crusader. In July 1963 the unit was re-designated VMF(AW)-323 to reflect the enhanced "all-weather" capabilities of the new fighters. While deployed to NAS Atsugi, Japan in 1963, the "Snakes" twice supported operations in the Philippines, Okinawa, and Taiwan from the decks of Navy carriers.

Life itself arose from the oceans. The ocean is vast and covers 140 million square miles, some 72 per cent of the Earth's surface. The ocean has always been an important source of food for the life it helped generate, and from earliest recorded history it has also served trade and commerce, adventure and discovery. It has separated and brought people together.

The oceans had long been subject to the freedom of-the-seas doctrine - a principle put forth in the 17th century, essentially limiting national rights and jurisdiction over the oceans to a narrow sea belt surrounding a nation's coastline. The rest of the seas were declared free for all and belonged to none. While this situation lasted into the twentieth century, by mid-century there was an impetus to extend national claims over offshore resources.

There was a growing concern over the toll taken on coastal fish stocks by long-distance fishing fleets and over the threat of pollution and wastes from transport vessels and oil tankers carrying noxious cargoes that plied sea routes across the globe. The threat of pollution was always present for coastal resorts and all forms of ocean life. The navies of the maritime powers were competing for a worldwide presence in surface waters and even under the sea.

The UN Environment Programme (UNEP), particularly through its Regional Seas Programme, acts to protect oceans and seas and promote the sustainable use of marine resources. The Regional Seas Conventions and Action Plans is the world's only legal framework for protecting the oceans and seas at the regional level. UNEP also created The Global Programme of Action for the Protection of the Marine Environment from Land-based Activities. It is the only global intergovernmental mechanism directly addressing the link between terrestrial, freshwater, coastal and marine ecosystems.

The United Nations Educational, Scientific and Cultural Organization (UNESCO), through its Intergovernmental Oceanographic Commission, coordinates programmes in marine research, observation systems, hazard mitigation and better managing ocean and coastal areas.

A series of controversies over oceanographic surveying and military-surveillance activities in the South China Sea have brought to the fore the long-standing struggle between coastal states and naval powers as it shaped the United Nations Convention on the Law of the Sea (UNCLOS).

This development raises the questions of whether and if so how FONOPs do indeed safeguard navigational rights and freedoms and strengthen adherence to international law. To answer these, we first describe the legal and political contexts. Second, we outline the debate about the effectiveness of FONOPs. Third, we advance, from a European perspective, policy proposals for strengthening the rule of law over the rule of force.

In essence, China and the US hold opposing views on the very nature of the EEZ as an extension of sovereign rights from the land into the sea, or as an extension of high seas freedoms toward the coast, respectively (Bateman 2020). Accordingly, the US argument that oceanographic surveillance and military surveying are permissible in EEZs as long as the obtained data serves military purposes only strikes the wrong chord in Beijing. Yet, the US is in an awkward position in relying on UNCLOS regardless. It has not yet ratified the Convention, and instead claims that most of its provisions reflect customary international law.

Under President Obama, the US labelled one naval operation in 2013, two in 2015, and three in 2016 as South China Sea FONOPs. Under President Donald Trump, meanwhile, the US Navy conducted six FONOPs there in 2017, five in 2018, seven in 2019, and five in 2020 as of the time of writing in August of that year. In addition, surveillance aircraft and long-range bombers have been asserting the freedom of overflight.
