These Terms of Use create a legally binding agreement between you and **NMS Company** (“Company”, “we”, “our”, or “us”) regarding your use of **Free AI Clean Up** and any related features, services, content, subscriptions, and in-app purchases provided through the application.
By downloading, installing, accessing, or using the app, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with these Terms, please do not use the app.
## 1. The App
**Free AI Clean Up** is a mobile application designed to help users manage and clean up storage on their iPhone. Depending on the features available in the app, the app may help you review, organize, detect, compress, or remove items such as duplicate photos, similar photos, screenshots, large videos, blurred photos, duplicate contacts, or other media and files accessible through permissions granted by you.
The app only works with the permissions you choose to grant. You are responsible for reviewing any suggested items before deleting, modifying, merging, or compressing them.
## 2. Eligibility
You must be at least 13 years old to use the app. If you are under the age of majority in your country or region, you may use the app only with the permission and supervision of a parent or legal guardian.
By using the app, you represent that you have the legal capacity to enter into these Terms or that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
## 3. License to Use the App
Subject to your compliance with these Terms, NMS Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the app on Apple-branded devices that you own or control, solely for your personal, lawful, and non-commercial use.
This license does not give you ownership of the app or any intellectual property rights in the app.
## 4. Restrictions
You agree that you will not:
* Copy, modify, translate, adapt, or create derivative works of the app;
* Reverse engineer, decompile, disassemble, or attempt to extract the source code of the app;
* Rent, lease, sell, sublicense, distribute, or transfer the app to any third party;
* Use the app for any illegal, harmful, fraudulent, abusive, or unauthorized purpose;
* Interfere with, damage, disable, overburden, or impair the app or our systems;
* Use bots, scripts, automated tools, or other unauthorized methods to access or manipulate the app;
* Remove, obscure, or alter any copyright, trademark, or proprietary notices in the app;
* Use the app in a way that violates any applicable laws, regulations, third-party rights, or Apple App Store rules.
## 5. User Responsibility for Content
The app may allow you to access, scan, organize, compress, merge, or delete content stored on your device, such as photos, videos, contacts, or other files.
You remain solely responsible for all content on your device and for all actions you take using the app. Before deleting, modifying, compressing, or merging any content, you should carefully review your selections and make sure you have backed up any important data.
NMS Company is not responsible for any loss of photos, videos, contacts, files, data, memories, or other content resulting from your use of the app, including accidental deletion, user error, device issues, system errors, or failure to back up your data.
## 6. Device Permissions
To provide certain features, the app may request access to device permissions such as Photos, Videos, Contacts, Camera, Notifications, or other permissions depending on the features available in the app.
You can grant, deny, or revoke permissions at any time through your device settings. Some app features may not work properly if required permissions are denied or revoked.
The app does not have access to content or device areas that you do not permit or that are not allowed by iOS.
## 7. Subscriptions and In-App Purchases
Some features of the app may be free, while others may require a paid subscription or in-app purchase.
If you choose to purchase a subscription, the payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period.
Your account may be charged for renewal within 24 hours before the end of the current period, according to the subscription plan you selected.
You can manage or cancel your subscription in your Apple ID account settings after purchase. Deleting the app does not automatically cancel your subscription.
Any unused portion of a free trial period, if offered, may be forfeited when you purchase a subscription, where applicable.
Prices, subscription periods, free trials, and available features may vary by country, region, promotion, or version of the app. We may change subscription pricing or features from time to time in accordance with Apple’s rules and applicable law.
## 8. Refunds
All purchases, billing, and refunds for subscriptions or in-app purchases made through the Apple App Store are handled by Apple, not NMS Company.
If you wish to request a refund, you must contact Apple or use Apple’s refund request process. We do not have access to your Apple ID billing information and cannot directly issue refunds for App Store purchases.
## 9. Free Trials and Promotional Offers
We may offer free trials, discounts, promotional subscriptions, or limited-time offers. The specific terms of each offer will be displayed in the app or on the purchase screen.
Unless canceled before the end of the trial period, a free trial may automatically convert into a paid subscription.
Promotional offers may be changed, suspended, or discontinued at any time, subject to applicable law and Apple’s rules.
## 10. Third-Party Services
The app may use third-party services, software development kits, analytics tools, crash reporting tools, payment systems, cloud services, or advertising networks to operate, improve, analyze, or support the app.
These third-party services may have their own terms and privacy policies. Your use of the app may also be subject to those third-party terms.
NMS Company is not responsible for the content, policies, availability, accuracy, security, or practices of third-party services.
Third-party services may include, depending on the app implementation:
* Apple App Store / StoreKit;
* Firebase;
* Firebase Crashlytics;
* Google Analytics for Firebase;
* RevenueCat;
* AppsFlyer;
* Adjust;
* Facebook SDK;
* AdMob;
* Other analytics, attribution, crash reporting, or subscription management tools.
Please remove any third-party service from this list if it is not used in your app.
## 11. Privacy
Your use of the app is also governed by our Privacy Policy, which explains how we collect, use, store, and share information.
Please review our Privacy Policy carefully before using the app.
## 12. Internet Connection and Device Requirements
Some features of the app may require an active internet connection. You are responsible for any data charges, roaming fees, or other fees charged by your mobile carrier or internet provider.
The app may not function properly if your device has no internet connection, insufficient storage, low battery, outdated software, revoked permissions, or other technical limitations.
We do not guarantee that the app will be compatible with all devices, operating system versions, regions, or languages.
## 13. Updates and Changes to the App
We may update, modify, suspend, or discontinue the app or any part of it at any time, with or without notice.
Updates may add, change, or remove features. You may need to install the latest version of the app to continue using certain features.
We do not guarantee that we will continue to support older versions of the app or that the app will always be available.
## 14. Termination
These Terms remain in effect while you use the app.
We may suspend or terminate your access to the app at any time if we believe that you have violated these Terms, used the app unlawfully, caused harm to us or others, or created legal or security risks.
You may stop using the app at any time by deleting it from your device. Termination does not automatically cancel any active subscription. You must cancel subscriptions through your Apple ID account settings.
Upon termination, the license granted to you under these Terms will end, and you must stop using the app.
## 15. Intellectual Property
The app, including its design, software, code, features, graphics, logos, trademarks, text, visual elements, and other content, is owned by or licensed to NMS Company and is protected by copyright, trademark, and other intellectual property laws.
You may not use our name, trademarks, logos, branding, or content without our prior written permission.
All rights not expressly granted to you in these Terms are reserved by NMS Company.
## 16. User Feedback
If you send us feedback, ideas, suggestions, bug reports, feature requests, or other comments, you agree that we may use them without restriction or compensation to you.
You represent that your feedback does not violate any third-party rights.
## 17. App Store Terms
If you download the app from the Apple App Store, your use of the app is also subject to Apple’s applicable terms, including the Apple Media Services Terms and Conditions and the Apple Standard End User License Agreement, unless a separate custom EULA applies.
Apple is not responsible for providing maintenance or support services for the app. Any claims, support requests, or questions related to the app should be directed to NMS Company.
## 18. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the app is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory.
We do not warrant that:
* The app will meet your expectations or requirements;
* The app will be uninterrupted, secure, error-free, or always available;
* The app will detect all duplicate, similar, large, blurred, or unnecessary items accurately;
* The results, suggestions, scans, compression, organization, or cleanup features will be complete, accurate, or suitable for your needs;
* Any errors or defects will be corrected.
You use the app at your own risk.
## 19. Limitation of Liability
To the maximum extent permitted by applicable law, NMS Company shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of data, loss of photos, loss of videos, loss of contacts, loss of profits, loss of goodwill, device issues, service interruptions, or other damages arising from or related to your use of or inability to use the app.
To the maximum extent permitted by law, our total liability for any claim related to the app or these Terms shall not exceed the amount you paid to use the app during the twelve months before the claim arose, or USD $50, whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
## 20. Indemnification
You agree to defend, indemnify, and hold harmless NMS Company, its owners, employees, contractors, partners, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses arising from:
* Your use or misuse of the app;
* Your violation of these Terms;
* Your violation of any law or regulation;
* Your violation of any third-party rights;
* Your content or data;
* Any action you take using the app, including deleting, modifying, compressing, merging, or organizing content.
## 21. Force Majeure
We will not be responsible for any delay or failure to perform any obligation caused by events outside our reasonable control, including but not limited to natural disasters, internet failures, power outages, cyberattacks, labor disputes, government actions, war, civil unrest, technical failures, App Store interruptions, or third-party service failures.
## 22. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the “Last updated” date above.
If we make material changes, we may notify you through the app, by email, or by other reasonable means where required by law.
Your continued use of the app after the updated Terms become effective means that you accept the revised Terms. If you do not agree to the updated Terms, you must stop using the app.
## 23. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction where NMS Company is established, unless otherwise required by applicable consumer protection laws.
If you are a consumer, you may have mandatory rights under the laws of your country or region that cannot be limited or waived by these Terms.
## 24. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.
The invalid or unenforceable provision will be interpreted to the maximum extent permitted by law to achieve the original intent of the provision.
## 25. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms presented in the app, constitute the entire agreement between you and NMS Company regarding your use of the app.
