# Terms of Use

Welcome to Foxy Pal: AI Calorie Tracker! These Terms of Use ("Terms") govern your access to and use of the Foxy Pal mobile application (the "App") developed and operated by Dzmitry Pirozhnik, an individual developer based in the United States ("we," "us," or "our").
By using the App, you agree to these Terms. If you do not agree, please do not use the App.
## 1. Eligibility
To use the App, you must be at least 4 years old. If you are under 18, you must have permission from a parent or legal guardian. The App is rated 4+ globally and classified as AL in Brazil.
## 2. Account Registration
You must sign in via Google or Apple Sign-In to create an account. Your account stores personal preferences and links to your subscription, if any. You are responsible for maintaining the confidentiality of your credentials.
## 3. Subscriptions and Premium Features
Some features of the App are available only via a paid subscription ("Premium"). These include, but are not limited to:
- AI Food Description
- AI Camera Food Analysis
Subscriptions are processed through your Apple ID account. After purchasing, you must log in through Google or Apple to activate and link Premium access to your account. Failing to log in may prevent access to Premium features.
All subscription billing, renewals, and cancellations are handled by the App Store. Please refer to Apple’s terms for details on managing your subscription. You will be charged on a recurring basis unless you cancel your subscription before the end of the current billing period.
You can restore your subscription by logging in with the same Apple ID and using the “Restore Purchases” feature within the App.
## 4. Usage Limits
To prevent abuse, we may impose daily limits on the number of AI tool uses (e.g., food recognition or description). These limits are subject to change.
## 5. Data and Privacy
Your use of the App is also governed by our Privacy Policy, which outlines how we collect and use your data. You can view it within the App or at [Privacy Policy Link Placeholder].
Most personal data is stored on secure remote servers. Locally, only temporary cache data is stored. The App requires an active internet connection to function properly.
## 6. Content and Acceptable Use
You agree not to use the App for:
- Any unlawful, offensive, or abusive purpose
- Uploading content that is harmful, misleading, or violates any rights
- Attempting to reverse engineer, copy, or disrupt the App or its backend systems
We reserve the right to suspend or terminate access for users who violate these terms.
## 7. Account Deletion
You may delete your account at any time within the App. Upon deletion, all associated personal data will be permanently removed unless retention is required by law.
## 8. Modifications and Termination
We may update these Terms from time to time. Continued use of the App after changes are posted means you accept the updated Terms.
We reserve the right to discontinue or modify any part of the App at our sole discretion.
## 9. Disclaimer and Limitation of Liability
The App is provided "as is" without warranties of any kind. We do not guarantee accuracy of nutrition information. Use at your own discretion.
We are not responsible for access limitations or service interruptions resulting from third-party providers being blocked or unavailable in certain countries. The App relies on third-party infrastructure and an active internet connection.
We do not guarantee the quality, accuracy, availability, or reliability of the data processed or delivered through third-party APIs or databases. This includes any results generated by AI tools or external food recognition and nutrition services. You understand and agree that all use of such data is at your own risk.
The App is not intended to provide medical or dietary advice. All content is provided for general informational purposes only and should not be relied upon as a substitute for professional healthcare consultation. You are solely responsible for any actions taken based on the information provided.
To the extent permitted by law, we disclaim all liability for any indirect, incidental, or consequential damages arising from your use of the App.
