LINGULL Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Lingull application, a language learning service provided by Lingull ("we," "our," "us"). By accessing or using any aspect of our Service—including the Lingull Free Service and the subscription-based service known as Lingull Pro ("Pro")—you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease using the Service.

1. Definitions

For the purposes of these Terms, the following definitions apply:

• Lingull Free Service: The version of our language learning application that offers access to real news articles (licensed under third-party terms such as Creative Commons), translation with contextual explanations, vocabulary management, and user-generated article uploads. The Free Service may display advertisements at intermittent intervals.
  
  

• Lingull Pro (Pro): A subscription service that provides an enhanced, ad-free user experience along with unlimited translations. Although subscriptions are managed via RevenueCat, all payments, renewals, and cancellations are ultimately processed through the Apple App Store or Google Play Store and are subject to their respective terms.
  
  

• User-Generated Content: Any text, images, videos, or other materials uploaded by users to the Service.

2. Service Description

Lingull is designed to support language learning through access to authentic, real-time news articles and interactive translation features. The Service is offered in two distinct modes:

Lingull Free Service:
This mode grants users access to real news articles, enabling the translation of words and expressions with immediate, contextual explanations. Additional features include the ability to create and manage personalized vocabulary lists and to upload articles, provided such articles are either copyright-free or that you hold the necessary rights to use and distribute the content.

Lingull Pro Subscription:
For users opting for Lingull Pro, the subscription provides a premium experience that removes all advertisements and lifts the limitation requiring ad-viewing after every fifteen translations. Although subscription management is administered via RevenueCat, all transactions are processed and enforced by the Apple App Store or Google Play Store. Users acknowledge and agree that any modifications, renewals, or cancellations to their subscription must be handled through their respective device settings in accordance with the policies of these digital storefronts.

3. User Registration and Account Responsibilities

Access to Lingull requires the creation of an account through Apple, Google, or email registration. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Unauthorized use or access to your account may result in immediate suspension or termination. Pro subscribers, in addition, agree to the billing terms set forth in Section 6.

4. Permitted and Prohibited Uses

You are authorized to use the Service exclusively for personal language learning, translation, and vocabulary improvement. You may upload content only if it is either your original work or is otherwise copyright-free or appropriately licensed for upload. You agree not to misuse or disrupt the Service in any manner, including the use of automated tools (such as bots or scripts) to access, scrape, or interfere with the operation of Lingull. Moreover, the use of artificial intelligence features is strictly limited to language learning purposes. Any use that involves the dissemination of illegal, harmful, defamatory, or otherwise offensive material is expressly prohibited.

5. Intellectual Property

All content provided by Lingull, excluding user-generated content, including but not limited to the design, interface, underlying software, and documentation, is the exclusive property of Lingull and is protected by international copyright and intellectual property laws. You retain ownership of any content you upload; however, by doing so, you grant Lingull a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purposes of operating and promoting the Service. You are solely responsible for ensuring that your content complies with applicable third-party licensing agreements.

6. Payments, Subscription Terms, and Refund Policy

Lingull Pro is offered on a subscription basis. The pricing, billing cycles, and automatic renewal terms for the Pro subscription will be clearly displayed at the time of purchase. Notwithstanding that subscriptions are managed via RevenueCat, all transactions are processed through the Apple App Store or Google Play Store. Accordingly, cancellations, modifications, or renewals of your subscription must be carried out through your device’s subscription settings as defined by the respective digital storefronts. Subscription fees will automatically renew at the end of each billing cycle unless you cancel at 24 hours prior to renewal. Fees charged for the current billing period are non-refundable, except as expressly provided by applicable law or in the case of a verified billing error. 7. Data Privacy and Security

Your use of Lingull is subject to our Privacy Policy, which explains in detail how we collect, process, and protect your personal data. By using the Service, you consent to such collection and processing. 8. Content Removal and Copyright Infringement

TO THE FULLEST EXTENT PERMITTED BY LAW, LINGULL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, DATA, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE. This limitation applies even if Lingull has been advised of the possibility of such damages. Additionally, Lingull does not warrant that the Service will meet your requirements, operate uninterrupted, or be error-free.

10. Account Termination and Suspension

Lingull reserves the right to suspend or terminate your account, in whole or in part, without notice if you violate these Terms or engage in any activity that is deemed harmful to the Service or to other users. Termination of your account does not absolve you of any outstanding obligations or liabilities incurred prior to termination. In the event of account termination, Lingull may retain certain data as required by law or for legitimate business purposes.

11. Dispute Resolution, Governing Law, and Jurisdiction

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service shall be resolved through final and binding arbitration conducted in accordance with the laws of Austria. These Terms shall be governed by and construed in accordance with the laws of Austria without regard to its conflict of laws principles. All legal proceedings arising in connection with these Terms shall be exclusively brought in the courts located in Villach, Austria, and you hereby consent to the jurisdiction of such courts.

12. Changes to the Terms

Lingull reserves the right to modify these Terms at any time. Any amendments will be effective immediately upon posting to the Service and, if appropriate, by email notification to your registered address. Your continued use of the Service following such modifications constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

13. Indemnification

You agree to defend, indemnify, and hold harmless Lingull, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Lingull regarding your use of the Service and supersede all prior understandings, agreements, or representations.
