Flymoto Pty Ltd (ACN 692 022 432 (“Flymoto” or “we” or “us”) is strongly committed to protecting your privacy. This policy explains how we collect, use, protect and disclose your personal information within our organisation. Your use of the Flymoto website, the Flymoto app, the Flymoto eBike rental services, the Flymoto motocycle rental services, the Flymoto scooter rental services (together, the “Services”) and all other products and services provided by Flymoto is governed by this Privacy Policy and the Terms of Use which can be obtained from the Flymoto website. Your use of the Services is also governed by the user Terms of Use which is on Flymoto website.
We may make changes to this policy from time to time, to take into account changes to our standard practices and procedures or where necessary to comply with new laws and regulations. The latest version of this policy will always be available on our website and we will notify you of any changes via the email you provide us when you register with Flymoto.
The kinds of personal information that we collect and hold about you may include:
•Account information, such as your name, date of birth, e-mail address, postal address, mobile number and payment information such as your card details;
•your usernames and passwords of your registered Flymoto account;
•any third-party account information you grant us if you login to the Flymoto platform through a third-party account (such as Facebook, Google or Twitter);
•details of any products or services that we provide to you including your journey data on Flymoto eBikes, scooters and motorcycles;
• information you send us including photos of parked Flymoto eBikes, scooters and motocycles and returned helmets;
•traffic data;
•information about how you use the products and services we provide;
•information about the referring source which may have sent you to our website;
•records of our communications with you, including any messages you send us;
•device information, server log information, IP address, and location information; and
•other information associated with the interaction of your browser and website.
Without this information we may not be able to provide you with our products or services (or with all of the features and functionality offered by our products or services) or to respond to queries or requests that you submit to us.
•We collect personal information about you in the following ways:
•where you register for an account with us;
•when you obtain services from us;
•when you submit a query or request to us;
•when you respond to a survey that we run or fill in forms on one of our websites;
•by tracking your use of our websites and mobile applications;
•from public sources; and
•from third parties who are entitled to disclose that information to us.
Where we collect personal information from you, we will generally do so directly ourselves. However, in some cases we may collect personal information from a third party, such as through your representatives, contractors who provide services to us, or third parties who refer you to us because they think you may be interested in our products or services.

•to keep you informed about our activities, including by sending out newsletters; and
•to customise your use of the Flymoto app, the Flymoto website and the Services.
We may from time to time use your personal information in order to send you marketing materials about products or services that we think you may be interested in (including in some cases products and services that are provided by a third party). You can opt-out of receiving marketing communications from us by following the “unsubscribe” link in the communication.
We may also use and disclose your information for other purposes as authorised by you, or in accordance with your requests or instructions.
We may share personal information about you with:
•our staff who need the information to discharge their duties, such as performing customer service or providing marketing and advertising services;
•related entities within our corporate group;
•our trusted business partners, agents and service providers;
•payment system operators and financial institutions;
•prospective purchasers of all or part of our business or shares in our company or a related entity;
•professional advisers who we engage to provide advice on our business; and
•government, regulatory and law enforcement agencies who ask us to disclose that information, or to other people as required by law.
We also share certain categories of information we collect from you and about you from our affiliates in the ways described in this privacy policy. We share personal information and traffic data with our affiliates, vendors, and business partners who assist us by performing
core services (described above), for data matching and customer profiling purposes and/or by making certain services available to our users. Those affiliates and business partners are bound to uphold the same standards of security and confidentiality that we have promised to you in this privacy policy, and they will only use your contact data and other personal information to carry out their specific business obligations to and to provide you with site related services. We may transfer information about you to another company in connection with a merger, sale or acquisition by or of Flymoto. In this event, we will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy. Flymoto does not share, sell, rent or trade your personal information with any third parties for their promotional purposes. We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our sites.
In some cases, the people to whom we disclose your personal information may be located overseas and may be subject to different privacy regimes. The countries in which these people are likely to be located include Singapore and China.
We use cookies to monitor and observe your use of our websites, compile aggregate data about that use, and provide you with a more effective service (which may include customising parts of our websites based on your preferences and past activities on those websites). "Cookies" are small text files created and stored on your hard drive by your internet browser software, in order to hold relevant information about the web page you are currently viewing. Most internet browsers have a facility that will allow you to disable cookies altogether – please refer to your browser’s help menu to find out how to do this. While you will still be able to browse our websites with cookies disabled on your internet browser, some website functionality may not be available or may not function correctly.
We or our third party tracking utility company also use “web beacons” to collect anonymous information about your use of our sites and the websites of selected sponsors and advertisers, and your use of emails, special promotions or newsletters we send to you. Web beacons are tiny graphic image files embedded in a web page or email that provide a presence on the web page or email and send back to its home server information from the user’s browser. The information collected by web beacons allows us to statistically monitor how many people open our emails, are using our sites and services, and selected affiliates’, sponsors’, and advertisers’ sites and communications, and for what purposes. Our web beacons are not used to track your activity outside of our sites or apps, or those of our affiliates or sponsors’. We do not link non-personal information from web beacons to personal information without your permission, except in connection with our marketing, promotion, or similar initiatives alone or jointly with our business partners and affiliates.
From time to time the Flymoto market research department, or our contractors and affiliates acting on our behalf, may conduct online research in order to gather feedback about our site and services, our affiliates and sponsors through email invitations, pop-up surveys, online focus groups, and social networks. When participating in such feedback, we may ask you to submit personal information. This personal information is used for market research purposes only and is not used for sales solicitations. When a survey is sponsored by an affiliate or other third party, aggregate information of the survey results is reported to the sponsor. Personal information collected through market research will be used only by Flymoto, our affiliates, our service providers and contractors, and successors and assigns, and will not otherwise be given or sold to another third party without your consent or as otherwise permitted by this privacy policy. We will not knowingly accept survey responses from or conduct interviews with any person under the age of 18. In addition to collecting survey responses from our members, cookies may be used to authenticate respondents or to help you pick up where you left off in a survey. If you have cookies disabled you may not be able to participate in some studies. cookies may be used to connect survey data with Flymoto site usage characteristics. You will be notified when we would like to use cookies in this way and your consent will be requested for these cookies.
We take reasonable steps to ensure that any of your personal information which we hold is accurate, complete up to date and not misleading. These steps include promptly updating personal information when we are advised that the information has changed, checking our contact lists for accuracy, and providing individuals with a simple means to update their personal information. However, we also rely on your advice of any changes to your personal data.
We store personal information for as long as it is needed for the purpose for which it was collected or as required by law. We use industry-standard encryption technologies with respect to the receipt and transfer of personal information you submit to us on the site and only authorized personnel have access to your information. Sometimes we also keep hard copy records of this personal information in physical storage facilities. We use a range of physical and technical security processes and procedures to protect the confidentiality and security of the information that we hold, and we update these from time to time to address new and emerging security threats.
If you want to access any of the personal information that we hold about you or to correct some aspect of it (e.g. because you think it is incomplete or incorrect), you can log into your account via the Flymoto website or app and by clicking on the “My Account” tab and following the applicable directions. You may also contact us using the contact details set out below. To protect the integrity and security of the information we hold, we may ask that you follow a defined access procedure, which may include steps to verify your identity. There may be cases where we are unable to provide the information you request, such as where it would interfere with the privacy of others or result in a breach of confidentiality. In these cases we will let you know why we cannot comply with your request.
The Flymoto sites contain links to other affiliates and third-party sites. Flymoto does not endorse and is not responsible for the privacy practices of any third-party websites. You should review the privacy policy posted on any other website to understand how that third party contractor website collects and uses your personally identifiable information.
If you access third-party services, such as Facebook, Google, or Twitter, to login to the Flymoto website or Flymoto app or to share information about your usage on the Platform with others, these third-party services may be able to collect information about you, including information about your activity on the Flymoto website or Flymoto app, and they may notify your connections on the third-party services about your use of the Platform, in accordance with their privacy policies. If you choose to allow a third-party service to access your account, we will share certain information about you with the third party. Depending on the permissions you grant, the third party may be able to obtain your account information and other information you choose to provide.
If you choose to engage in public activities on the Flymoto website or Flymoto app, you should be aware that any information you share may be read, collected, or used by other users. You should use caution in disclosing personal information while using the Flymoto website or Flymoto app. We are not responsible for the information you choose to submit.
We try to meet the highest standards in order to protect your privacy. However, if you are concerned about the way in which we are managing your personal information and think we may have breached the Australian Privacy Principles, or any other relevant obligations, please contact us using the contact details set out below. Complaints must be lodged in writing. We will deal with the matter within a reasonable time and will keep you informed of the progress of our investigation.
