Terms & Conditions 

Parties 

This Service Contract Agreement (hereinafter referred to as the 'Agreement') is entered into  on ________________ (the 'Effective Date'), by and between the 'Photographer' and 'Client'. In this agreement, the 'Photographer' shall mean 'Abigail Tipler' trading as 'Florence Photography'(hereinafter referred to as the 'Photographer'). The Client(s)'  with an address of ____________________(hereinafter referred to as the 'Client(s)''), shall be those persons who fill out this form.  (collectively  referred to as the 'Parties').

The Client(s) will agree to this digital contract and image release prior to the photo session/ booking. 

This Agreement must be signed and submitted before any session can begin.

Consideration 

The Parties agree that the Photographer will provide the photography services attached hereunder, whereas the Client(s) will in return provide compensation for such services and expertise. 

Services 

The Photographer’s services are summarized as follows:

Applicable Law 

The laws of England and Wales shall govern this agreement. These Terms and Conditions shall not be varied except by agreement in writing.

In the event of any conflict between these terms and conditions (including those relating to the time of payment) and those issued or submitted by the Client(s) and in the absence of any contrary agreement in writing, these Terms and Conditions shall prevail.

Dispute Resolution 

Any dispute of difference whatsoever arising out of or in connection with this Agreement shall be submitted to Small Claims Court in accordance with, and subject to the laws of England and Wales. 

Pricing, Booking Fee and Payment 

The non-refundable booking fee (35% of the total payment) is due in full by the Client(s) at the time of booking in order to secure the session date requested. The Photographer will not hold any dates open without the  booking fee payment and the total payment is to be paid two weeks in advance of the session (subject to change depending on what service(s) the Client(s)' require).The Photographer will not attend the session if the total payment is not received at it's due date. 

All prices are subject to change without notice by the Photographer. No consideration will be given to any previous Client(s) regarding product pricing, availability, or session fees. (Prices/collections valid at the time of paying deposit booking will be honoured).

The Parties agree that the total fee of the services provided will be ________________.  

The Parties agree that a non-refundable deposit amounting to ______________ will be made upon the execution of this Agreement. 

The Parties agree that the means of payment will be via  PayPal.

Cancelling The Agreement 

In the event of an illness or misadventure, the client(s) must call as soon as possible to reschedule. 

The Parties agree that in case the Client(s) cancels this Agreement prior to the event, he/ she / they will be entitled to a refund of the monies paid except for the non-refundable deposit made. This request must be made no later than 24 hours prior to the start of the photography session (this is subject to change depending on what service(s) the Client(s)' require), otherwise a refund of monies paid - excluding the non-refundable deposit - will be void. 

The Photographer maintains the right to reschedule at any time should it become necessary (due to illness or otherwise) but will do her upmost to negotiate a mutual acceptable rebooking/ alternative date or arrangement should the need arise. Where not possible, the Photographer's liability shall be limited to a full refund of the session fee (including the non-refundable deposit). 

If the Client(s)' feel they are sick/ poorly the Photographer reserves the right to and will most likely request that you reschedule if it is noticeable. Having a photoshoot when poorly isn't nearly as comfortable or enjoyable as when the Client(s) are is good health. In this scenario the session can be transferred to a new date at the convenience of both Parties without charge.

Session 

The Parties agree that every session is unique to each Client(s), therefore it's not possible to offer every pose/ set up in each session. If a particular pose, prop or photo is wanted, the Client(s) will discuss any requests before the day of the session (at least two days in advance, subject to change depending on what service(s) the Client(s)require). The Photographer will make every effort to comply with requests for specific photos, however, this will be dependant on the willingness/co-operation of subjects, it may not be possible for all or any of the images requested or expected to be captured.

Both Parties agree that some requested props or poses may not be suitable for the shoot and the Photographer will use alternative props or poses. Please note, not all poses and shots are guaranteed.

The Photographer will end the session at her discretion when it is determined that adequate images in terms of quality and quantity have been captured. There will be no refund or credit for unused time.

The Photographer will do everything she can to produce good quality images. However, if in the instant of a child portrait photography shoot/ newborn shoot the child/ baby won’t settle or co-operate (resulting in little or no images taken) then the Photographer cannot be held responsible. In this instance the Photographer will offer the chance to re-shoot at a time suitable for both Parties at no charge. For newborn sessions this cannot be guaranteed that it will be in the 2 weeks time frame.

Health and Safety 

1.) Photography equipment - If photography equipment (i.e. lighting or background stands) is used the photographer will not be held liable for any tripping/ injury that could potentially be caused by the equipment. 

2.) Children - The Client(s) is responsible for the children's safety during the photography session. The Client(s) must therefore ensure that a responsible adult, other than the Photographer, is present at all times to supervise the child/children. 

Copyright/ Print Release 

The Parties agree that the Photographer will maintain the original copyright for all the photographs taken by her. 

The images may be printed but not altered or edited in any way other than by the Photographer and any alterations is a violation of the copyright. 

The Photographer hereby grants the Client(s) the permission to make an unlimited number of copies/ prints of the images for personal use, friends and family, however not for the sake of commercial use unless the Photographer gives her consent. This also applies to social media. The Client(s) are encouraged to post on social media, however they must use the specified watermarked copies that the Photographer will supply them with, along with tagging the Photographer in with the appropriate social media tags. 

Permits

The Client(s) are responsible for acquiring all permits and necessary permission for all locations on which the Photographer will be performing services.

Capture and Delivery

The Photographer is not liable to deliver every image taken at the event. The determination of images delivered to the Client(s) is left to the discretion of the Photographer. 

Post Production and Editing

The final post production and editing styles, effects and overall look of the images are left to the discretion of the Photographer, although this can be discussed with the Client(s) and adapted as the Photographer deems necessary. 

Data Protection 

The Photographer will store the Client(s) name, contact details and session information privately and will not share these with any other business or organisation.

Amendments 

The Parties agree that any amendments made to this Agreement must be in writing where they must be signed by both Parties to this Agreement. 

As such, any amendments made by the Parties will be applied to this Agreement. 

Electronic Devices 

Personal cameras, camera phones, camcorders or any other recording equipment is NOT permitted during any session, either in the studio or on location, without the express permission of the Photographer (Abigail Tipler).

Additional Terms and Conditions

The Parties agree that the Client(s) will provide a brief overview of the expectations to allow the Photographer to prepare in advance.
