2. PAYMENT
Currency accepted is USD and can be paid through PayPal. No other options are available at this time.
Commissions must be paid in full within 48 hours of having your request accepted. The slot will be forfeit after that time if unpaid.
If needed, the buyer may request a 50% non-refundable deposit that can hold a slot for up to a week but the remaining half will be required before work begins. If remaining half is not paid after a week, the slot will be forfeit.
Do not send any payment before I have agreed to give you a slot and requested the payment. Sending payment before it is requested and approved may result in your request being permanently rejected.
3. PROCESS AND DELIVERY
I will notify you when I have started on your commission. After that point, there are no rights to a refund on the work (see point 7 below for more info on refunds).
I will check in at the sketch stage and require your approval to move forward. The amount of further reviews depends on the complexity of the work and will be discussed beforehand.
The time it takes to finish a commission varies depending on factors such as health, the complexity of the commissioned piece, and overall workload. Generally, pieces are finished within one month of starting work on them.
If anything comes up that will slow the progress of the initially estimated delivery time I will let you know ASAP.
Once the piece is finished, you will receive the full-resolution image via email.
4. REVISIONS
For digital pieces, you get an initial sketch that requires your approval where you can request minor changes free of charge. After this stage, revisions and changes may be subject to additional charges:
A fee will be added if you want to make significant changes to the character or piece after approval of your submission form (small changes are fine).
If you wish for me to change something significant in the drawing once it is past the sketch stage, that either you had previously approved, not mentioned, or was otherwise not confirmed with/made known to me, you will be charged for the change. The amount depends on the change you want me to make and the time and effort involved to make it.
If your reference images or provided details were unclear or insufficient for your request, later changes will come at an extra charge for the work being done to figure out your piece. Please be as detailed as possible at the request stage, especially if you do not have sufficient visual references for your commissioned work.
5. COPYRIGHT / USAGE POLICY
I, Shannon Fleck (the artist), claim the rights to the produced drawing, not the buyer. I reserve the full rights to the image and its use/distribution. I am allowed to use the copyrighted artwork to:
Promote myself
Publish books (artbooks, etc.)
Display and/or post it anywhere (website, social media, etc.) unless otherwise explicitly agreed
The buyer is allowed to:
Use the commissioned piece for personal use (can be uploaded to social media profiles, forums, etc. with artist credit)
Display the artwork publicly with artist credit
The following is considered copyright infringement:
Reproducing/using/reselling my artwork commercially and making money off of my work in any way
Tracing or drawing over my artwork
Claiming my artwork as your own
Removing my signature from my artwork
Altering my artwork without my consent
Training AI with my artwork
Anything else that I deem unacceptable use of my artwork
6. CUSTOMER SATISFACTION
I want to do everything I can to make my clients happy with their piece. For this reason I highly suggest that you tell me everything you need as early as possible in the commission process. I am happy to accommodate reasonable requests and help find solutions.
If you have a problem with anything in regards to a final piece, please understand that I am strict on my refund policies in order to protect myself and my work. Dissatisfaction with a finished piece or with my style is not considered grounds for a refund. Demands, threats, or any other aggressive or retaliatory behavior in regard to my policies will result in immediate blacklisting.
It is on the commissioner to express all of their needs and requests upfront, preferably before filling out a request form. I am happy to check in with you during the art process if you want a certain level of oversight on the artwork but you must make this known to me before I am spending time and effort on your piece. And, understand the nature of art: my art is made by me, in my style, and through my personal envisioning and process. After all, hopefully that is why you are here!
I am willing to change some of my terms for you if you ask before I start on your commission. For example, if you do not want me to post your art anywhere, we can discuss this. Payment policies are fairly immovable, but in extenuating circumstances there may be different arrangements that we can make - please reach out if you have a need and we can talk about it!
7. REFUND / CANCELLATION POLICY
Refunds of any kind are strictly not allowed once work on the commission has begun.
If for any personal reason I am unable to continue work on your commission, you will receive a full refund.
If you need to cancel your order due to an unforeseen emergency, a partial refund may be possible. This will depend on the circumstance and be at the artist's discretion.
If you have had a refund approved, do not request a chargeback. I will transfer the money back to you myself.
If you request a chargeback at any point when a refund was not approved by the artist, you will lose all aforementioned rights to the commissioned piece. Furthermore, you will be blacklisted from commissioning me again.
If the buyer breaks any of the points stated above they will lose all the aforementioned rights to the artwork commissioned from me, Shannon Fleck aka Flexk (the artist) and I will have the right to profit further from the commissioned artwork in any way I see fit. If you are unsure about any of these statements, they may be discussed with me prior to paying for a commissioned piece.
