# Fintrakit Terms of Use (EULA)

## Agreement to Terms
By downloading, installing, or using Fintrakit ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
## Description of Service
Fintrakit is a financial management application that helps users track debts, expenses, income, and create financial plans. The App provides:
- Debt tracking and payoff strategies
- Expense and income management
- Budget planning and analysis
- Financial calculators (payment, amortization, home affordability, investment)
- Calendar view for financial planning
- Data export and import capabilities
## Subscription Services
### Free Plan
- Limited number of debts, expenses, and income entries
- Basic financial tracking features
- 7-day free trial of premium features
### Premium Subscription Plans
**Monthly Plan:**
- Price: $2.99 USD per month
- Auto-renewable subscription
- Access to all premium features
- Unlimited debts, expenses, and income entries
- Advanced calculators and analytics
- Priority support
**Yearly Plan:**
- Price: $24.99 USD per year
- Auto-renewable subscription
- Access to all premium features
- Unlimited debts, expenses, and income entries
- Advanced calculators and analytics
- Priority support
- Savings compared to monthly plan
### Subscription Terms
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and turn off auto-renewal in your Account Settings at any time after purchase
- No refunds will be provided for the unused portion of the term when a subscription is cancelled
## User Responsibilities
### Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Reverse engineer, decompile, or disassemble the App
- Remove or modify any copyright, trademark, or other proprietary notices
### Data Accuracy
You are responsible for:
- Providing accurate and complete financial information
- Maintaining the security of your device and data
- Backing up your data regularly
- Verifying the accuracy of calculations and projections
## Privacy and Data
### Data Storage
- All your financial data is stored locally on your device
- We do not collect, store, or transmit your financial information to our servers
- You are responsible for backing up your data
- We are not responsible for data loss due to device failure or app deletion
### Privacy Policy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App and is incorporated into these Terms by reference.
## Disclaimers and Limitations
### Financial Advice Disclaimer
Fintrakit is a financial management tool and does not provide financial, investment, or legal advice. The App's calculations, projections, and recommendations are for informational purposes only and should not be considered as professional financial advice.
### No Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
### Limitation of Liability
IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
### Maximum Liability
THE DEVELOPER'S MAXIMUM LIABILITY TO YOU FOR ANY DAMAGES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP OR SUBSCRIPTION SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
## Intellectual Property
### App Ownership
The App and its original content, features, and functionality are owned by the developer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
### User Content
You retain ownership of any data you input into the App. By using the App, you grant us a limited license to process your data solely for the purpose of providing the App's functionality.
## Termination
### Termination by You
You may stop using the App at any time. You may also cancel your subscription through your device's account settings.
### Termination by Us
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.
### Effect of Termination
Upon termination, your right to use the App will cease immediately. If you have a subscription, it will continue until the end of the current billing period unless cancelled earlier.
## Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by:
- Posting the new Terms in the App
- Updating the "Last Updated" date
- Sending a notification through the App (if significant changes)
Your continued use of the App after any changes constitutes acceptance of the new Terms.
## Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
## Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
## Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
