Terms and Conditions for using the findly Mobile Application. By accessing and using Findly, you agree to abide by the following terms and conditions. Please read these terms carefully before using Findly. Your use of the Findly App indicates your acceptance of these terms and constitutes a legally binding agreement between you (“User”) and Findly ("Findly"). Any entity, individual or business besides the Findly team will be referred to as the (“User”) for the purpose of these terms and conditions and any other reference.
1. Strict Security
1.1 User accounts: Users must create an account to access certain features of the App. Users are responsible for maintaining the security and confidentiality of their account credentials. Findly will not be liable for any unauthorized access or use of User accounts.
1.2 Data protection: Findly employs strict security measures to protect User data, but cannot guarantee the absolute security of information transmitted through the App. Users are responsible for safeguarding their personal information and Findly shall not be responsible for any unauthorized access or data breaches.
2. Reservation of Rights
2.1 Intellectual property: Findly and all its contents are owned or licensed by Findly Pty Ltd. Users are granted a limited, non-exclusive, non-transferable right to access and use the Findly App solely for personal or commercial purposes. Users shall not modify, distribute, reproduce, or exploit any part of the App without prior written consent from the Company.
2.2 Termination: Findly reserves the right to suspend or terminate User accounts and access to the App at its sole discretion, without prior notice if any User violates these terms and conditions.
3. Conduct
3.1 Prohibited activities: Users agree not to use Findly for any unlawful or unauthorized purposes, including but not limited to: uploading, posting, or transmitting any content that is defamatory, fraudulent, abusive, obscene, or infringing upon any intellectual property rights.
3.2 User responsibilities: Users are solely responsible for their actions and interactions on Findly, including any content they upload, share, or transmit. Users agree not to use Findly to harass, stalk, or harm other Users, or to engage in any behaviour that may disrupt the functionality of the Findly App.
4. Spam
4.1 Unsolicited content: Users agree not to use Findly to send unsolicited promotional or marketing content, including spam, to other Users.
4.2 Anti-spam measures: Findly employs anti-spam measures to detect and prevent the transmission of spam. Users must not circumvent or interfere with these measures. Findly reserves the right to suspend or terminate User accounts involved in spamming activities.
5. Payment
5.1 Transaction processing: Users may engage in financial transactions outside of Findly for property rentals or other services. Findly may also facilitate the transfer of funds between Users, but we are not responsible for any financial disputes that may arise between Users.
5.2 Third-party payment processors: Findly may integrate with third-party payment processors, and Users agree to abide by the terms and conditions of those processors.
5.3 Fees and charges: Users may be responsible for paying fees, charges, or commissions to findly for the use of certain features or services provided through the Findly App. Findly reserves the right to modify or introduce new fees, charges, or commissions with or without prior notice to Users.
6. Our Limited Responsibility
6.1 Content accuracy: Findly does not guarantee the accuracy, completeness, or reliability of any content on the App, including property listings or user-generated content. Users should exercise discretion and verify the accuracy of any information before relying on it.
6.2 Property condition: Findly is not responsible for the condition, safety, or legality of any property listed on the Findly App. Users agree to engage in due diligence and take necessary precautions before renting or visiting any property.
7 Student Marketplace
7.1 Eligibility to Use the Student Marketplace:
The Student Marketplace is exclusively available to verified student users of the Findly app. Only students who have completed the registration process and have been granted student status by the platform may sell or purchase items within this section.
7.2 Permitted Items for Sale:
Students are permitted to list and sell items that meet the following criteria:
Items must be academic in nature (e.g., textbooks, stationery, academic equipment).
Items must be non-edible.
Items must comply with all applicable local, national, and international laws.
7.3 Prohibited Items:
The sale or listing of the following is strictly prohibited:
Illegal items or substances.
Edible goods or perishable products.
Non-academic or inappropriate items.
Counterfeit or stolen goods.
7.4 Accuracy of Listings:
Sellers are required to provide accurate and truthful descriptions of items listed for sale, including their condition, price, and any other relevant details. Misrepresentation of items is prohibited.
7.5 Buyer-Seller Interactions:
All transactions and communications between buyers and sellers must take place within the Findly app. The platform reserves the right to monitor and moderate conversations to ensure compliance with these terms.
7.6 Responsibility for Transactions:
Findly acts solely as a facilitator and does not take responsibility for the quality, legality, or condition of items listed. Buyers and sellers are responsible for ensuring fair and legal transactions.
7.7 Reporting Violations:
Users are encouraged to report any violations of these terms and conditions or suspicious activity to Findly's support team for review at Findlystudents@gmail.com
7.8 Account Suspension or Termination:
Failure to adhere to these terms may result in warnings, suspension, or termination of user accounts at Findly’s discretion.
7.9 Changes to Terms and Conditions:
Findly reserves the right to update or modify these terms and conditions at any time. Continued use of the Student Marketplace constitutes acceptance of the updated terms.
7.10 Dispute Resolution:
Findly does not mediate disputes between buyers and sellers. Users are encouraged to resolve issues amicably.
8. No Uploading of Inappropriate Content
8.1 Prohibited content: Users shall not upload, post, or share any content that is inappropriate, offensive, or violates any applicable local and international laws, regulations, or third-party rights.
8.2 Monitoring and removal: Findly reserves the right to monitor and remove any inappropriate content from the Findly App without prior notice.
9. Privacy
9.1 At Findly we respect user privacy and we comply with applicable data protection laws.
9.2 Users can review our privacy policy for details on how personal information is collected and processed. Please note that these terms and conditions may be subject to change without prior notice. Users are advised to review these terms periodically. If Users continue to use the findly App, it will indicate their acceptance of any updated terms.
