Terms of Use

1. General

These Terms of Use, also known as the "Terms of Service," "Terms," "User Agreement," or "Agreement," constitute a legally binding agreement between you, whether acting as an individual, business, or organization, and FikrU. FikrU may also be referred to in these Terms as the "Website," "Application," "Platform," or "Services."

In these Terms, "we," "us," and "our" refer to FikrU. "You," "your," "user," and "visitor" refer to any person who accesses or uses FikrU. The words "Content" and "Materials" refer broadly to any information, materials, communications, or other content made available through the Website, Application, or Services.

By accessing or using FikrU and its available content or services, you confirm that you are at least 18 years old, or have reached the minimum legal age required in your state, country, or region if that age is higher.

If you do not meet the applicable age requirement, you must not access or use FikrU.

2. Content and User Conduct

When using FikrU, you agree not to engage in any activity that violates these Terms or applicable laws. Prohibited activities include, but are not limited to:

(i) Defaming, libeling, harassing, or otherwise violating the privacy, publicity, intellectual property, or other rights or interests of another person.

(ii) Using the Products or Services in any way that may damage, disable, overload, interfere with, or otherwise impair the normal operation of the Application, Platform, or Services.

(iii) Uploading, displaying, transmitting, distributing, or sharing any text, sound, audio, image, photograph, video, or other material that we reasonably determine to be hateful, threatening, obscene, abusive, discriminatory, racially or ethnically offensive, defamatory, or otherwise inappropriate.

(iv) If you submit or share Content that is protected by intellectual property rights, you represent and warrant that you are the lawful creator or owner of such Content, or that you have obtained all rights, permissions, and authorizations necessary to use and provide the Content to us. You further agree to be responsible for all royalties, fees, compensation, or other amounts that may be owed to any third party in connection with your Content.

(v) Attempting to gain unauthorized access to, hack, disrupt, damage, or destabilize the Website, Application, Services, or their source code, or falsely representing that any third-party website, application, product, or service is affiliated with or officially associated with FikrU.

(vi) Accessing or using the Products or Services through any interface, method, software, or system that has not been provided, authorized, or required by us.

(vii) Using the Products or Services to distribute worms, viruses, malware, or any other code, files, or programs designed to be harmful, destructive, or disruptive.

(viii) By submitting, transmitting, displaying, or otherwise making Content available through the Application or Services, you grant FikrU a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, transmit, publish, display, distribute, modify, or otherwise utilize such Content for the operation, promotion, and marketing of our products and services.

(ix) Submitting, transmitting, displaying, or distributing any Content or other material that depicts physical violence, promotes violence, encourages criminal conduct, or could otherwise result in criminal or civil liability.

(x) When you voluntarily share information with other users through the Application, including photographs, text, screenshots, videos, or other communications, you acknowledge that you may no longer have complete control over how such information is used or distributed. Depending on your actions and the actions of the users with whom you share the information, such Content may become accessible to others or publicly available.

You are responsible for all Content that you submit, transmit, display, or otherwise make available through FikrU and for ensuring that your use of the Products and Services complies with these Terms and applicable laws.

3. Third-Party Technology

The Application may incorporate or rely upon software, technology, components, or other materials that are owned, operated, or controlled by third parties. Such third-party technologies may be integrated into or used in connection with the Application and Services.

Unless otherwise stated, third-party software or technology incorporated into the Application is subject to these Terms to the extent applicable.

Third-Party Websites, Products and Services

The Services may provide links, references, integrations, or other access points to websites, applications, products, or services operated by third parties for the convenience of our users ("Reference Sites").

The inclusion of any Reference Site does not constitute our endorsement, approval, sponsorship, or recommendation of that third party or its products or services.

Your access to and use of any Reference Site, including any information, content, materials, products, or services made available through it, is solely at your own risk. FikrU is not responsible for the availability, accuracy, security, content, or practices of any third-party website or service.

4. Payment Policy

Certain features, products, or services available through FikrU may require you to pay fees. By making a payment, you agree to comply with all applicable payment terms, conditions, and requirements provided by FikrU.

You are solely responsible for any fees, charges, duties, or taxes associated with your purchases or other payments made through FikrU, unless otherwise required by applicable law.

Prices, product availability, service availability, and other commercial terms may be modified at any time without prior notice, subject to applicable laws and regulations.

Except where a refund is required by applicable mandatory laws or regulations, or where FikrU has expressly provided a specific refund policy for a particular product or service, all purchases made through FikrU are final and non-refundable.

Any item, virtual item, product, or service purchased through FikrU is non-refundable regardless of whether it has been used, consumed, or remains unused, except where a refund is required by applicable law or expressly permitted under a specific FikrU policy.

5. Account Termination

You may stop using the Application and/or Services at any time by deleting your FikrU account.

We reserve the right to restrict, suspend, or terminate your access to the Application, Services, account, or these Terms, immediately and without prior notice, if we reasonably believe that you have violated, or may violate, any provision of these Terms or otherwise engaged in conduct that may adversely affect FikrU, its users, or the Services.

Upon termination or suspension of your account, you will not be entitled to receive a refund for any paid content, products, items, or services associated with the period before the termination of your account, except where otherwise required by applicable law.

6. Your Data and Feedback

Your personal information and other data will be collected, processed, stored, and handled in accordance with our Privacy Policy.

We may retain or otherwise store Content and other materials that you provide in connection with your use of the Products and Services, to the extent permitted by applicable law.

If you provide suggestions, comments, ideas, recommendations, or other feedback regarding FikrU, the Application, Products, or Services ("Feedback"), you agree that FikrU may use such Feedback without restriction.

You grant FikrU an exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, distribute, display, or otherwise utilize your Feedback for any purpose, whether commercial or non-commercial, without any obligation to provide you or any other person with compensation, credit, or attribution.

We are not obligated to keep your Feedback confidential or to use any Feedback that you provide.

You acknowledge and agree that providing Feedback does not grant you any ownership, intellectual property rights, or other rights in the Products, Services, or any resulting changes, modifications, improvements, or corrections.

You are solely responsible for all materials and Content that you submit or provide through FikrU, including their legality, accuracy, reliability, appropriateness, originality, and compliance with applicable copyright and other intellectual property laws.

By submitting Content or Feedback, you represent that you have the necessary rights and authority to provide such materials and to grant the rights described in these Terms.

7. Limitation of Liability

Certain features and functions of the Application depend on an internet connection. Such connection may be provided through Wi-Fi or your mobile network operator. FikrU is not responsible for any interruption, limitation, or reduced functionality of the Application caused by the absence of a suitable internet connection, including situations where you have reached or exceeded the data limit provided by your mobile network operator.

When accessing or using the Application through a mobile network rather than Wi-Fi, your agreement with your mobile network provider will continue to apply. As a result, you may be charged for mobile data usage or other services provided by your network operator or other third parties. By using the Application, you acknowledge and accept full responsibility for any such charges, including roaming fees that may arise when you use the Application outside your usual country or region without disabling mobile data roaming.

You are also responsible for ensuring that your device is capable of accessing and using the Application. This includes maintaining sufficient battery power and ensuring that your device remains operational. FikrU will not be responsible for any inability to access or use the Services caused by your device being switched off, running out of battery, or otherwise becoming unavailable.

FikrU makes reasonable efforts to keep the information and functionality provided through the Application accurate and up to date. However, certain information and services may be supplied or supported by third parties. Because such information may depend on third-party sources, FikrU does not guarantee its completeness, accuracy, reliability, or continuous availability. To the maximum extent permitted by applicable law, FikrU will not be liable for any direct, indirect, incidental, or consequential loss arising from your reliance on such information or functionality.

FikrU may modify, improve, update, or otherwise change the Application from time to time. The technical requirements for operating systems and other platforms on which the Application is available may also change. You may therefore need to install updates in order to continue using the Application.

Although FikrU may provide updates when appropriate, FikrU does not guarantee that the Application will always be updated, maintained, or compatible with every version of an operating system or every device. You agree to install and accept Application updates when they are made available to you.

FikrU also reserves the right to discontinue, suspend, or terminate the Application or any part of the Services at any time, without being required to provide advance notice, unless such notice is required by applicable law or otherwise stated by FikrU.

Unless FikrU expressly provides otherwise, following termination of the Application or your access to the Services:

(a) all rights and licenses granted to you under these Terms will immediately cease; and

(b) you must stop accessing and using the Application and, where applicable, remove or uninstall it from your device.

Indemnification

You agree to defend, indemnify, and hold harmless FikrU, its employees, representatives, and related parties from and against any third-party claims, liabilities, losses, damages, costs, and expenses arising out of or relating to:

(a) your acts or omissions while using the Website, Application, or Services; or

(b) any Content or other materials submitted, uploaded, transmitted, displayed, or otherwise provided by you.

8. Changes to These Terms

FikrU may revise, amend, or update these Terms of Use from time to time in response to changes in our Services, business practices, applicable laws, or other relevant circumstances.

When changes are made, the updated version of the Terms will be published on this page. We encourage you to review these Terms periodically so that you remain aware of the latest applicable provisions.

Your continued access to or use of the Application or Services after the revised Terms become effective will constitute your acceptance of the updated Terms.

If you do not agree with any revised provision, you should stop using the Application and Services.

9. Arbitration

FikrU specifically draws your attention to the provisions of these Terms that may limit or exclude FikrU's liability or otherwise affect your rights and interests. You are encouraged to carefully review these provisions and independently assess the potential risks associated with using the Application and Services.

If any dispute, controversy, or claim arises between you and FikrU in connection with these Terms or your use of the Application or Services, the parties should first attempt to resolve the matter through good-faith negotiation.

If the dispute cannot be settled through negotiation or mediation, the dispute shall be referred to the Hong Kong International Arbitration Centre ("HKIAC") for arbitration in accordance with the arbitration rules applicable at the time the arbitration is commenced.

The seat and place of arbitration shall be Hong Kong.

The arbitral award shall be final and binding upon both parties, subject to any rights or remedies that cannot legally be excluded under applicable law.
