Terms of Use and Commitment – Escudex Antivirus

PLEASE READ THIS DOCUMENT CAREFULLY. BY INSTALLING, ACCESSING, CREATING AN ACCOUNT, OR USING THE ESCUDEX ANTIVIRUS APPLICATION, YOU DECLARE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THE TERMS AND CONDITIONS SET FORTH HEREIN. IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT USE THE APPLICATION.

This document ("Terms") governs the contractual relationship between you ("User") and Jefferson Prado Barros ("Developer"), the creator and responsible party for the Escudex Antivirus security application ("Application").

1. Acceptance of Terms

By downloading, installing, creating an account, and using the Escudex Antivirus application, the User signifies their free, express, and informed agreement with the entire content of these Terms, legally binding themselves to its provisions.

2. Description of Services

Escudex Antivirus is a security application for mobile devices that offers antivirus and anti-theft functionalities. Its purpose is to act as an additional layer of protection and as a tool to aid in device location.

2.1. Anti-Theft Functionality and Tracking Limitation: The anti-theft tracker function is designed to assist the User in locating a lost or stolen device. The User's control panel registers a location history for a maximum of the four (4) most recently connected devices. It is of fundamental importance and the User's sole responsibility to actively check the panel to verify if their device has been properly connected and if location information is being reported. The Developer is not responsible for failures in tracking devices that were not correctly synchronized by the User.

3. License to Use

The Developer grants the User a limited, personal, non-transferable, non-exclusive, and revocable license to use the Escudex Antivirus application for personal and non-commercial purposes, in strict compliance with these Terms.

4. User Obligations and Responsibilities

The proper functioning of the Escudex Antivirus application is directly dependent on the active and diligent conduct of the User. It is established that it is the User's exclusive responsibility to:

• Correct Usage: Operate the Application in accordance with its purposes and instructions. Misuse of the Application for illicit purposes or that violate the rights of third parties will result in the immediate termination of the license to use.

• Updates: Keep the Application and its virus database always updated to the latest version available in the official application store. Protection against new threats is directly dependent on these updates.

• Configuration: Perform the proper configuration of all functionalities, including passwords, security commands, and emergency contacts.

• Granting of Permissions: For the antivirus, real-time protection, and, especially, anti-theft functionalities (such as GPS location, remote lock, and data wipe) to operate correctly, the User must grant all permissions requested by the Application in their device's operating system (e.g., location access, device administrator, display over other apps, etc.). The refusal or deactivation of any essential permission will imply the malfunction or total inoperability of the respective functionalities, without this incurring any liability for the Developer.

5. Function as an Auxiliary Tool and Disclaimer of Insurance

It is expressly clear that Escudex Antivirus is an AUXILIARY TOOL and not a property recovery service or an insurance policy.

• Absence of Restitution: The Developer DOES NOT OFFER INSURANCE, FINANCIAL GUARANTEES, OR ANY FORM OF RESTITUTION for lost, stolen, robbed, or damaged devices, regardless of the operation or failure of the Application's functionalities.

• Responsibility for Recovery: The recovery of any lost device is the full and exclusive responsibility of the User. The User must contact the competent police authorities and take the measures they deem necessary. Escudex Antivirus serves only as a technological means to potentially assist in this process, without guaranteeing success in the recovery.

6. Limitation of Liability and Disclaimer of Warranties

The Application is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by applicable law, the Developer:

• Does not guarantee that the Application will detect 100% of all viruses, malware, or security threats.

• Is not responsible for connection failures, unavailability of GPS signal, or internet access that prevent the operation of location functions and remote commands.

• Will not be liable for any direct, indirect, incidental, special, or consequential damages (including, but not limited to, loss of data, loss of profits, or business interruption) arising from the use or inability to use the Application, even if the Developer has been advised of the possibility of such damages.

• Disclaims any liability arising from the User's failure to follow the obligations described in Clause 4.

7. Intellectual Property

All copyrights, trademarks, patents, and other intellectual property rights related to the Escudex Antivirus application, including its source code, design, logos, and graphic material, are the exclusive property of the Developer, Jefferson Prado Barros, and his licensors.

8. Modifications to the Terms

The Developer reserves the right to modify these Terms at any time, at its sole discretion. We will notify you of material changes (e.g., via an in-app notification or by updating the "Last Updated Date"). The continued use of the Application after the publication of changes constitutes acceptance of the new Terms.

9. Term and Termination

These Terms remain in effect as long as the User keeps the Application installed and in use. The Developer may terminate this license to use at any time if the User violates any of its clauses. The User may terminate this agreement at any time by uninstalling the Application from their device.

10. Governing Law and Jurisdiction

These Terms shall be governed and interpreted in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law principles.

If you are a User residing in the European Union or another jurisdiction with mandatory consumer protection laws, this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the law of your habitual residence.

For any dispute or controversy arising from this instrument, the parties will attempt to seek an amicable resolution. If this is not possible, the Jurisdiction of the District of Goiânia, GO / Brazil, is hereby elected. This does not, however, prevent consumers in the European Union from bringing proceedings in their own country of residence.
