Acceptance of Terms

• By commissioning services from me, you confirm that you have read, understood, and agree to be bound by these Terms of Service.

Service Description

• PACE (Personal Avatar Customization and Editing) provides services including model adjustments, retexturing, animation, and upgrades. I also offer Remote Assistance, where I provide real-time advice and support during your avatar editing process. The specifics of each service will be discussed and agreed upon before work begins.

Use of Third-Party Assets

• You are responsible for ensuring that you have the appropriate licenses and permissions to use any third-party assets involved in the PACE process.

• I am responsible for ensuring that I have the appropriate licenses and permissions for any third-party assets I use in your commission.

• I do not assume responsibility for any unauthorized use of third-party assets on your end.

• I reserve the right to decline any commission that involves unlicensed or infringing assets.

• I reserve the right to request proof of ownership or licensing for any third-party asset you provide.

Payment Terms

• I provide an initial pricing estimate based on the projected scope of work and any necessary assets. This estimate is subject to change based on project adjustments.

• Payment options:

  • • Upfront payment

    • Payment at the end of the commission

    • Payment at the end of each session

    • Periodic payment plans (must be agreed upon in advance)

• If you opt for a periodic payment plan, any delays in payment must be communicated promptly with a valid reason.

• The final payment must be completed before the final product is delivered.

• Accepted payment methods: PayPal, Cash App, Wise, and Ko-fi.

• All prices are in USD unless otherwise stated.

• Due to the digital and custom nature of the work, completed commissions are non-refundable once delivered.

Client Responsibilities

• You must provide all necessary files, information, and permissions required to complete the service.

• If additional assets are required that I do not possess, you are responsible for obtaining them or covering their cost.

• Failure to provide necessary files, permissions, or timely communication may result in project delays or cancellation without refund. 

Intellectual Property

• You retain ownership of all original intellectual property that you provide.

• I reserve the right to use completed projects for promotional purposes unless otherwise agreed.

• If you prefer your project not to be used for promotional purposes, this must be discussed and agreed upon in writing before work begins.

• Custom materials, edits, or textures that I create may not be resold, redistributed, or repackaged without my written permission. 

Advertisement & Change Log Inclusion

• By default, I will add a small card inside the avatar that advertises my services, along with a list of changes made to that version of the avatar.

• If you do not want this advertisement and change log inside your avatar, you must pay a $20 fee for its removal.

Concept Development Fee

• If you do not have a concrete idea of what you want your avatar to look like, you are required to compile a document containing:

  • • Links to potential assets

    • Pictures for at least half of the linked assets

• If the list contains more than 10 links and/or lacks pictures for at least half of the assets, you will be required to pay an additional fee of at least $10, depending on the complexity and length of the list.

Cancellation and Refund Policy

• I reserve the right to cancel a commission at any time for reasons including:

  • • Inappropriate behavior

    • Severe indecisiveness

    • Communication barriers preventing a successful outcome

• If I do not receive communication from you within three (3) days, your commission will be put on hold while I work on other pending commissions. If no communication is received within one (1) week, your commission may be canceled, and any progress may be deleted or used for promotional purposes.

• If a commission is put on hold, work will not resume until further communication is received. If I take on another commission in the meantime, yours may be delayed until that one is completed.

• Refunds:

  • • If you cancel after payment and work has begun, you may be eligible for a partial refund based on progress made.

    • A full refund is only available if no work has commenced.

    • No refunds will be issued after a commission is completed.

Transfer and Upload

• Upon completion, avatars can be delivered via email or uploaded directly to your VRChat account, based on your preference.

  • • File transfers may take place through third-party platforms such as Discord or Google Drive. While I take reasonable care to protect shared files, I cannot guarantee data security beyond the measures provided by those platforms.

• If you request an upload, you must provide:

  • • Your VRChat account login details

    • The authentication code sent to your email

• I will not retain your account information, and we will both delete any messages containing these details once the upload is complete.

• It is recommended that you change your password after the commission is completed.

• Responsibility for upload issues:

  • • If I upload the avatar, and it is not functioning properly, I will address the issue.

    • If you upload it yourself and experience problems, I can assist, but additional fees may apply.

    • I am not responsible for issues caused by VRChat updates or platform changes after the avatar has been successfully uploaded and confirmed as functional. Future fixes require a new commission.

• All project files and working assets will be deleted 30 days after delivery unless otherwise agreed in writing. 

Age Verification and Commissions Involving Adult Content

To ensure compliance and maintain the integrity of my services, I require age verification for all commissions involving sexual content. This is mandatory to adhere to legal guidelines and protect both parties. If your commission involves sexual content, you must verify your age.

Accepted methods of age verification:

• Proof of ownership of a verified account on an adult platform with strict age verification (e.g., Fansly, Pornhub).

• A clear photo or video of yourself holding a government-issued ID next to your face. The ID must display your photo and date of birth.

• A link to your VRChat profile with the Verified 18+ badge.

I do not retain age verification records after verification is completed. Any provided documents or images are deleted immediately after verification.

Limitation of Liability

• I am not responsible for any loss, damage, or liability arising from:

  1. • Unauthorized use of third-party assets

     • Your failure to comply with licensing agreements

     • Platform or software changes affecting your avatar after completion

• My liability is strictly limited to the cost of the service provided.

• I am not responsible for any actions, consequences, or account issues that result from how you use your avatar after it has been delivered.

• I cannot guarantee compatibility with future game versions, Unity updates, or platform changes. If your avatar becomes incompatible due to such updates, you may request a paid review or fix, which may incur additional fees.

• These Terms of Service are governed by the laws of Nevada, United States. Any disputes arising under or in connection with these Terms will be handled in Las Vegas, Nevada. 

Amendments to Terms

• I reserve the right to update or modify these Terms of Service at any time.

• Significant changes will be communicated before they take effect.

• By continuing to use my services, you agree to any updated terms.
