1. Acceptance of Terms

Welcome to Epiphany! By downloading, installing, accessing, or using the Epiphany mobile application ("App", "Service", or "Epiphany"), you agree to be legally bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not use the App.

These Terms constitute a binding legal agreement between you ("User", "you", or "your") and Epiphany ("we", "us", or "our").

2. Description of Service

Epiphany is a mobile application designed to provide users with daily inspirational thoughts, shower thoughts, philosophical quotes, and thought-provoking content across multiple categories.

2.1 Core Features

The App includes the following features:

• Daily Thoughts: Access to curated collection of 1,000+ thoughts across 20 categories

• Browse & Discover: Swipe through thoughts and discover new perspectives

• Share & Copy: Share thoughts with friends or copy text

• Home Screen Widget: Display random thoughts on your home screen

• Notifications: Receive daily reminders with new thoughts

• Customization: Choose from multiple color themes

2.2 Premium Features

Premium subscription unlocks additional features:

• Favorites: Save and access your favorite thoughts

• Category Filtering: Filter thoughts by specific categories

• Premium Themes: Access to 7 additional exclusive color themes

• Unlimited Notifications: Set unlimited daily reminders

3. User Eligibility

The App is rated 4+ and is available to users of all ages.

• Age 13 and Under: Parental supervision is recommended

• Age 13-17: Parental consent may be required depending on your location

• Age 18+: Full access with no restrictions

By using the App, you represent that you meet the age requirements or have obtained necessary parental consent.

4. Account and Registration

No Account Required: Epiphany does not require account creation, registration, or login. You can use the App immediately after download.

All your preferences and data are stored locally on your device.

5.3 Pricing and Payment

• Price: $1.99 USD per month (or equivalent in your local currency)

• Free Trial: 7-day free trial for first-time subscribers

• Payment Method: Charged to your Apple ID account

• Payment Timing: Charged at confirmation of purchase (after free trial ends)

• Currency: Prices shown in your local App Store currency

5.4 Auto-Renewal

⚠️ Important: Subscriptions Automatically Renew

• Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• Renewal charge will be the same price as the original subscription

5.5 Managing Your Subscription

To manage or cancel your subscription:

1. Open iOS Settings app

2. Tap your Apple ID at the top

3. Tap Subscriptions

4. Select Epiphany

5. Choose Cancel Subscription

You can also manage subscriptions from:

• App Store app → Profile → Subscriptions

• Epiphany app → Settings → Manage Subscription

5.6 Cancellation Policy

• You can cancel anytime through your Apple ID account settings

• Cancellation takes effect at the end of the current billing period

• You will retain Premium access until the end of the paid period

• No partial refunds for unused time in the current billing period

5.7 Refund Policy

All purchases are processed through the Apple App Store and are subject to Apple's refund policies.

To request a refund:

1. Go to reportaproblem.apple.com

2. Sign in with your Apple ID

3. Find Epiphany subscription

4. Click "Report a Problem"

5. Select reason and submit

Or contact Apple Support directly through the App Store.

We do not process refunds directly. All refund decisions are made by Apple.

6. Content Ownership and License

6.1 Our Content

All thoughts, quotes, text, graphics, user interfaces, visual interfaces, photos, trademarks, logos, sounds, music, and artwork in the App are either:

• Original content created by Epiphany

• Licensed content we have permission to use

• Public domain content

The App and its content are protected by copyright, trademark, and other intellectual property laws.

6.2 Your License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• ✅ Download and install the App on your personal device

• ✅ Use the App for personal, non-commercial purposes

• ✅ Share individual thoughts via the share feature

• ✅ Copy text for personal use

6.3 Restrictions

You may NOT:

• ❌ Sell, rent, lease, or sublicense the App

• ❌ Copy the App's code, design, or database

• ❌ Scrape or extract bulk content for commercial use

• ❌ Create derivative works based on the App

• ❌ Republish all thoughts in another app or website

• ❌ Remove copyright or trademark notices

7. Acceptable Use Policy

7.1 Prohibited Activities

When using Epiphany, you agree NOT to:

• Reverse Engineer: Decompile, disassemble, or reverse engineer the App

• Hack or Exploit: Attempt to gain unauthorized access to the App's systems

• Interfere: Interfere with or disrupt the App's functionality or servers

• Violate Laws: Use the App for any illegal or unauthorized purpose

• Spam: Use the App to send spam or unsolicited communications

• Impersonate: Impersonate any person or entity

• Collect Data: Scrape or systematically collect data from the App

• Circumvent: Bypass Premium features without paying

7.2 Consequences of Violation

Violation of these terms may result in:

• Immediate termination of your access to the App

• Legal action if necessary

• Reporting to Apple for App Store violations

8. Intellectual Property

8.1 Our Trademarks

"Epiphany" and the Epiphany logo are our trademarks. You may not use them without our written permission.

8.2 Copyright Claims

We respect intellectual property rights. If you believe any content in the App infringes your copyright, please contact us with:

• Description of the copyrighted work

• Location of the infringing content in the App

• Your contact information

• Statement of good faith belief

• Statement under penalty of perjury

• Your physical or electronic signature

9. Disclaimers

We do not guarantee that:

• The App will be error-free or uninterrupted

• Defects will be corrected

• The App will meet your requirements

• Thought-provoking discussion

They should NOT be taken as:

10. Limitation of Liability

To the maximum extent permitted by law:

We are NOT liable for any:

• Indirect, incidental, special, consequential, or punitive damages

• Loss of profits, revenue, data, or use

• Business interruption

• Personal injury or property damage

• Emotional distress

Even if we have been advised of the possibility of such damages.

Our total liability shall not exceed the amount you paid for the Premium subscription in the 12 months prior to the claim (maximum $23.88).

11. Indemnification

You agree to indemnify, defend, and hold harmless Epiphany and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App

• Your violation of these Terms

• Your violation of any rights of another person or entity

12. Privacy

Your privacy is important to us. Our Privacy Policy explains:

• We don't collect personal information

• All data is stored locally on your device

• No tracking or analytics

• Subscription status only from Apple

13. Changes to Terms

We reserve the right to modify these Terms at any time.

13.1 How We'll Notify You

• Updating the "Last Updated" date at the top

• Posting new Terms at this URL

• In-app notification for material changes

13.2 Your Acceptance

Continued use of the App after changes constitutes acceptance of the new Terms. If you don't agree with the changes, you must stop using the App.

14. Termination

14.1 By You

You can stop using the App at any time by:

• Uninstalling the App from your device

• Canceling your Premium subscription

14.2 By Us

We may terminate or suspend your access immediately, without notice, if you:

• Breach these Terms

• Engage in prohibited activities

• Attempt to hack or exploit the App

14.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately

• You must delete the App from your device

• Subscription charges continue until you cancel through Apple

• Provisions of these Terms that should survive will remain in effect

15. Governing Law and Disputes

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of TX/united States, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising from these Terms or the App shall be resolved through:

1. Informal Negotiation: First, contact us to resolve informally

2. Mediation: If negotiation fails, non-binding mediation

3. Arbitration or Court: As a last resort

15.3 Jurisdiction

You agree to submit to the jurisdiction of the courts located in austin for any legal proceedings.

16. Apple-Specific Terms

Because Epiphany is distributed through the Apple App Store, the following terms apply:

16.1 Acknowledgment

You acknowledge that:

• These Terms are between you and Epiphany, not Apple

• Apple is not responsible for the App or its content

• Apple has no obligation to provide support for the App

16.2 Scope of License

Your license to use the App is limited to a non-transferable license to use on Apple-branded products you own or control, as permitted by the App Store Terms of Service.

16.3 Maintenance and Support

Epiphany, not Apple, is responsible for:

• App maintenance

• Support services

• Addressing claims

16.4 Warranty

In the event of App failure to conform to any warranty:

• You may notify Apple for a refund of the purchase price

• Apple has no other warranty obligation

• Any other claims are our responsibility, not Apple's

16.5 Product Claims

Apple is not responsible for:

• Product liability claims

• Claims that the App fails to conform to legal requirements

• Consumer protection or similar legislation claims

16.6 Intellectual Property

If a third party claims the App infringes their intellectual property rights:

• Epiphany, not Apple, is responsible for investigation and defense

• Apple has no obligation in such claims

16.7 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you.

17. Miscellaneous

17.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Epiphany regarding the App.

17.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force.

17.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

17.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and Epiphany through these Terms or use of the App.

17.6 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
