AFFILIATE AGREEMENT

This Affiliate Agreement ("Agreement") is made.

1. Epic Tattoo Gallery, a content platform specializing in tattoo-related content and recommendations ("Affiliate"), and

2. Fiverr Affiliate Services, a subsidiary of Fiverr International Ltd. ("Fiverr").

This Agreement sets forth the terms and conditions governing the Affiliate’s participation in Fiverr’s Affiliate Program.

1. DEFINITIONS

• "Affiliate" – Epic Tattoo Gallery, participating in Fiverr’s affiliate marketing program.

• "Fiverr" – Fiverr International Ltd., the entity managing the Fiverr Affiliate Program.

• "Commission" – Earnings paid to the Affiliate for successful referrals.

• "Affiliate Link" – A unique tracking link provided by Fiverr for referral tracking.

• "Qualifying Purchase" – A purchase made by a user via an Affiliate Link that meets Fiverr’s eligibility criteria.

2. AFFILIATE PARTICIPATION

1. Enrollment: Affiliate agrees to promote Fiverr’s services through approved marketing channels, including but not limited to its website, social media, and email marketing.

2. Tracking: Fiverr provides Affiliate with a unique tracking link to monitor referred customers.

3. Commission Structure: Fiverr shall pay Affiliate commissions in accordance with its published commission schedule.

3. AFFILIATE RESPONSIBILITIES

1. Content Compliance: Affiliate must provide accurate and non-misleading information about Fiverr services.

2. Brand Guidelines: Affiliate agrees to follow Fiverr’s branding and promotional guidelines.

3. Prohibited Activities: Affiliate shall not engage in spam, misleading promotions, false advertising, or any deceptive marketing practices.

4. Legal Compliance: Affiliate must comply with all FTC disclosure requirements and clearly indicate affiliate relationships in content (e.g., "This post contains affiliate links.").

4. COMMISSION PAYMENTS

1. Payment Terms: Fiverr shall pay commissions according to its payout schedule (e.g., monthly or upon reaching the minimum payout threshold).

2. Refunds & Chargebacks: Commissions are subject to adjustment in case of order cancellations, charge backs, or fraudulent transactions.

3. Payment Methods: Fiverr shall process commission payments via PayPal, bank transfer, or other available payout methods.

5. INTELLECTUAL PROPERTY

1. Limited License: Fiverr grants Affiliate a limited, revocable license to use Fiverr’s logos and promotional materials solely for approved marketing purposes.

2. Restrictions: Affiliate may not modify Fiverr’s trademarks, claim ownership, or use Fiverr branding in misleading ways.

6. TERMINATION

1. Termination by Either Party: Either party may terminate this Agreement with written notice of at least 14 days.

2. Immediate Termination: Fiverr reserves the right to terminate the Affiliate’s participation immediately in cases of fraud, policy violations, or deceptive marketing.

3. Effect of Termination: Upon termination, Affiliate must cease all promotions and remove Fiverr branding and affiliate links.

7. LIABILITY & DISCLAIMERS

1. No Guarantees: Fiverr does not guarantee specific earnings or conversions.

2. Limitation of Liability: Neither party shall be liable for indirect, incidental, or consequential damages arising from this Agreement.

3. Indemnification: Affiliate agrees to indemnify Fiverr from any claims resulting from non-compliance with laws or misuse of Fiverr’s brand.

8. GENERAL TERMS

1. Independent Contractors: Nothing in this Agreement creates an employment, agency, or joint venture relationship between the parties.

2. Governing Law: This Agreement shall be governed by the laws of [jurisdiction], without regard to conflict-of-law principles.

3. Amendments: Fiverr reserves the right to update this Agreement, with Affiliates notified of changes in advance.
