The following is an excerpt from the NHADA Legal Guide. Dealers need to be aware of the fact that there is a significant difference between a documentary fee and an administrative fee.

Documentary fees are defined by RSA 361-A:1, IV as "the fees for filing, recording or investigating, perfecting and releasing or satisfying a retained title or a lien created by a retail installment contract, and shall not exceed the actual cost assessed by the Department of Safety, Division of Motor Vehicles (DMV), or other state or local agency for filing, recording or investigating, perfecting and releasing or satisfying such title or lien."

Documentary fees are the combination of the $25 title fee that is submitted to the DMV and the $2 agent fee. Documentary fees ($27) can be listed on the retail installment contract.

On the other hand, the term administrative fee is not defined anywhere in the state's statutes. Therefore, according to the Banking Department, administrative fees cannot be listed on the retail installment contract. Administrative fees can, however, be listed on the Purchase and Sale Agreement. The bottom line on the Purchase and Sale Agreement becomes the "cash sale price," which includes the administrative fee and is then carried over to the Retail Installment Contract.

Also, dealers need to be able to justify the amount of the administrative fee. A dealer should be able to identify and justify those expenses included in the administrative fee. NHADA provides a brochure explaining the purpose of an administrative fee. Dealers should use the NHADA brochure or another to provide an explanation to customers. Similarly, all dealer personnel should be trained to explain the "why" behind the fee. Complying with the documentary/administrative fee rule as well as the other requirements of RSA 361-A will keep the Banking Department examiners off your doorstep.

The Banking Department has the authority to do an audit of a dealer's records, including, but not limited to, deal sales jackets, to determine if the dealer is complying with NH law. A violation can result in a fine or the suspension of the dealer's retail seller's license. Moreover if, as the result of an audit, a dealer is found to be in violation of RSA 361-A, in addition to the imposition of a penalty, the dealer must reimburse the state for the cost of the audit.

"Consignment Agreement" is an agreement between the owner of avehicle, known as the consignor, and a licensed vehicle dealer, known as theconsignee, wherein the owner delivers physical possession of the vehicle to thedealer for the specific purpose of having the dealer sell the vehicle for theowner and also with the intent that if the vehicle is not sold by the dealer,it is to be returned to the owner.

Hi there. Same problem. Just bought a house with a big solar/battery setup which I need to get on top of. The previous owner is dead (yes unfortunately). Don't know where he bought his Victron Colour so it's a bit difficult. Is there really no way I can reset the administrator?

Hi, I have a second hand system bought from an "unofficial" Victron dealer/breaker. I have no idea who the original owner or dealer was, but need access to the VRM Portal and removal of the previous admins/users (who seem to be accessing my installation!!). I've sent via the VRM Portal the request to the previous admin (email?) and raised a support request.

I have the problem of purchasing a second hand system installed in a travel trailer, purchased from an individual. I am unable to add the Cerbo GX as an installation on the VRM. I was able to find the installer, but he cannot give me access. He said only the previous owner can. I contacted the previous owner and he added me as a user with full access. However, I still cannot add the installation. I just get the following message "All administrators of the installation have been notified by email. It will be accessible for you after one of them approves the request." Is there another path to getting this done?

If the previous owner added you as a full admin, the install appears automatically in your VRM account, which should already be registered. You do not have to do anything to add it (as if it was a new install - since it is not new)

* The broker-dealer reasonably believes that, upon consummation of the transaction, any person acquiring securities or assets of the eligible privately held company, acting alone or in concert, will control and, directly or indirectly, will be active in the management of the eligible privately held company or the business conducted with the assets of the eligible privately held company; and

After a recent visit to the used car market, I was quoted a standard sum of $800.00 for the admin fee usually while a few others quoted $500.00. Some dealers even told me depending on how they play with the price. They can also waive the admin fees but it was already mark up in the car price. So I assumed this "admin fees" was implemented by Used cars traders since there isn't a real standard. All dealers I have spoke to so far all said that this is a fee buyer "must pay".

its definitely something used car dealers (nowadays) will ask for and also include in the sales agreement. And of course they will say its industry practice and all that bla bla bla. But buyers should be aware and negotiate accordingly. Like the previous bro, I did the same. They asked 500 but I negotiate with them saying Im getting insurance, loan, all from you so I wont pay. So yea, buyers must negotiate la.

Just look at the final price to decide buy or not... it doesn't matter how they coin the breakdown.. even if they tell u no admin fee.. does not mean its not included in the car price already.. 2nd hand dealers ARE selling old stuff with a definite mark-up anyways...

By and large, before you commit or sign and anything, pls ASK them any hidden cost(s) apart from the obvious items. Nowadays, admin fee not necessary only apply to buying used car, some PI also impose admin fee, if you are taking up a high loan. However, all these are negotiable. They will come up all sort of lame excuses to "earn" from you. Just ask around first but just like some bros mentioned that just treats it as part of the car price.

My daughter purchased a car and the dealer charged her $599 for dealer services. I heard this is not legal, but the dealer says it is. She paid it because the car was such a good deal. Do we have any recourse?
