Welcome to the Enhanced app, developed and provided by Dani Aziz ("we," "us," or "our"). By using the Enhanced app, you agree to be bound by the following Terms and Conditions. Please read them carefully.

1. Services

The Enhanced app enables you to interact with AI-driven chatbots, providing an interface to the ChatGPT API for various purposes, including entertainment and education. Please note that while we strive to provide reliable and informative interactions, the responses generated by the AI may not always be accurate, and the information should not be considered definitive.

2. Disclaimer

You acknowledge and agree that the use of the Enhanced app is done at your own risk. We cannot and do not make any representations or warranties regarding the accuracy or reliability of the AI-generated content in our app. The app and its content are provided on an "as is" basis without any warranties, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, completeness, or usefulness of any information provided in the app. Any reliance you place on such information is strictly at your own risk.

3. Licensing and Other Terms

a. Scope of License: The Enhanced app is licensed to you, not sold. Your license to use the app is subject to your acceptance of these Terms and Conditions. The license granted to you is nontransferable, and you may only use the app on devices that you own or control, in accordance with the app's usage guidelines. You may not distribute or make the app available over a network where it could be used by multiple devices simultaneously. You may not copy, reverse-engineer, modify, or create derivative works of the app, except as permitted by law or the licensing terms governing open-sourced components included with the app.

b. Consent to Use of Data: By using the Enhanced app, you agree that we may collect and use technical data and related information about your device, system, and application software to improve our products and provide services or technologies to you, as long as it does not personally identify you.

c. Termination: These Terms and Conditions are effective until terminated by you or us. Your rights under these Terms and Conditions will automatically terminate if you fail to comply with any of its provisions.

d. Cancellation of Subscription: Dani Aziz reserves the right to cancel your subscription to the Enhanced app at any time, for any reason or no reason, with or without advance notice.

e. External Services: The Enhanced app may enable access to external services and websites. You agree to use these external services at your own risk. We are not responsible for examining or evaluating the content or accuracy of any third-party external services. Any data displayed by the app from external services is for general informational purposes only and is not guaranteed by us. You agree not to use external services in a manner that violates these Terms and Conditions or infringes intellectual property rights.

f. No Warranty: You acknowledge and agree that the Enhanced app and any services provided are provided "as is" and "as available," without warranty of any kind. We disclaim all warranties and conditions, whether express, implied, or statutory, including but not limited to warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. We do not warrant that the app will be error-free or operate without interruption. You assume all risks associated with the use of the app.

g. Limitation of Liability: To the extent not prohibited by law, we shall not be liable for any personal injury or any incidental, special, indirect, or consequential damages arising out of or related to your use of the Enhanced app, regardless of the theory of liability. In no event shall our total liability exceed the amount paid by you for the app. Some jurisdictions do not allow the limitation of liability for certain damages, so this limitation may not apply to you.

h. Export Control: You may not use or export the Enhanced app except as authorized by the laws of the United States and the jurisdiction in which you obtained the app. You agree not to use the app for any purposes prohibited by United States law.

i. Governing Law and Jurisdiction: These Terms and Conditions and the relationship between you and Dani Aziz shall be governed by the laws of the State of California, excluding its conflicts of law provisions. You and Dani Aziz agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California, to resolve any disputes or claims arising from these Terms and Conditions. If you are a citizen of any European Union country or Switzerland, Norway, or Iceland, the governing law and jurisdiction shall be the laws and courts of your usual place of residence. The United Nations Convention on the International Sale of Goods is specifically excluded from the application of these Terms and Conditions.

j. Entire Agreement: These Terms and Conditions constitute the entire agreement between you and Dani Aziz regarding the Enhanced app and supersede any prior or contemporaneous agreements.
