Terms of Service

Privacy

Your personal information, such as email address and paypal billing account, will be kept between us.  Your name or Social Media Account, pronouns, and the Character Name and pronouns, may be listed in social media posts on my portfolios or website as the commissioner and in the image description. If you would like to stay anonymous, there will be an opt-out, where I will not list your name or pronouns or tag you on social media or other portfolio postings. 

Payment

Full cost of the commission is required up front via Paypal invoice. After the commission has been confirmed, I will send one to your email address. Payment is required before work begins; if payment is not received within 5 days of accepting the commission, I reserve the right to open the slot to someone else.

Discounts

If I have already modeled your OC before, and you're not making significant changes to their look or outfit, you will get a discount using them for 3D YCH slots or 3D full commissions!

If this is your first time getting a character modeled with me, you will get the discount on future 3D commissions and YCH slots, as long as your model has remained viable with the current program version.

The discount for characters I've previously modeled does not always apply to 2D commissions, which are generally discounted already and don't necessarily rely on a prior 3D model.

Refunds

If you cancel the commission before I begin work, I will arrange a full refund with you. Do not initiate a chargeback! I'll handle it from my end, just let me know.

If I have already begun the work, and you need to cancel the commission, I may be able to offer a partial refund, based on how far I got. Just contact me over email. Do not initiate a chargeback!

Customers who force Chargebacks for work, completed/delivered or not, will be banned from future auctions/sales/commission slots, and reported to the relevant Beware boards/accounts.

If, for some reason, I cannot complete the commission (health, program limitations, the world exploding, your character exploding the program), I will let you know and begin a refund.

No refunds after delivery. You will be receiving a DIGITAL file, I do not do physical prints or merchandise.

Turnaround Time

The expected completion window will depend on current commission queue, and number of slots open. I'll have a time range posted on the social media listing. If I run into delays, that will be communicated on social media and by email to the affected customers. In general, the minimum time to complete a digital painting or 3D render is going to be at least 2 weeks from when we finalize payment and details. (It's sooner if you're at the front of the queue and it's the weekend. I do most art on weekends or evenings, my render machine is NOT portable and doesn't follow me to my day job.)

If you're messaging me regarding something, and I haven't responded in 2 days (48 hours), send a follow-up email or ping me on social media letting me know there's an email waiting. The email apps are sometimes iffy with alerts. (I am not glued to my email 24/7, so follow-ups every 5 minutes are a bad idea. I need time to get the alert, check into your questions if it's a technical thing, and get back to you.)

Status Updates

I will keep in touch with you over email or social media to send you progress images of any commissions. This will start with simple screenshots as I model and paint your characters, so you will have a chance to approve the design work, or request changes, before the character is added to the final scene.

Changes you want after the final image render will incur an extra fee, due to the time involved for further modifications and running the render again. (The machine cannot be used for anything else while it renders, which can take hours.)

Where Can I (EnberLight) Post? - Artist Rights

I retain the copyright on all commissions I work on, and all rights of reproduction unless otherwise specified and arranged for an additional fee. The artwork may appear on any of my social media accounts or websites, such as Tumblr, BlueSky, Ko-fi, or my personal domain.

Where Can You (Customer) Post? - Customer Rights

Leave my signature or watermark on the image, and you can upload it to any social media you'd like! Just mention me as the artist. A tag or link back to me is greatly appreciated, but not required. Use as PFP/Banner/Lockscreen etc is okay. If there's a spot to mention the artist, just mention me there.

Do not claim the artwork as your own.

(Exception: If you downloaded one of my pay-to-use or free bases, you are the COLORIST or character designer, but still need to mention me as the base artist, please.)

You retain all rights to your OC - name, design, etc. I won't use it for other images, except other commissions by you, or in case you have authorized a friend to gift you an image with your character.

Reproduction & Resale Rights

I will not sell your artwork as prints or downloads, unless that's something I specifically arranged with you.

You may not use the art I created for prints and merchandise, outside of having print made for personal use. (No charms, acrylics, etc, but you can print it to hang on the wall, or use as a badge.)

You may not resell the image. You can transfer it as part of a character package if you sell the character itself in the future, though. It would be great if you let me know, please, in case I see it floating around with Not You claiming it or posting it.

Do not feed the image to any AI programs, or use it for NFTs, or upload it to any sort of stock site or other downloadable media place. (I won't either.)

Will Do / Won't Do Limitations

I specialize in fantasy art of humanoids. This covers humans, fairies, elves, orcs, and most sorts of anthro (furries) and a few types of centaur or mythical creatures like mermaids and dragons. Mecha or high-tech elements are case-by-case, they aren't my focus. I can include prosthetics and assistive devices! Styles for those that I can achieve may be limited, but I'll do my best for your character.

Outfit, hair styles, and physical features will be limited by the capabilities of my 3D assets, machine, and program. If I can't match your OC exactly, I will suggest alternatives. Some complex styles or features may need an additional asset/complexity fee. If we can't come to a compromise, you will not be invoiced, and there will be no artwork.

I will NOT do artwork that promotes hate of or violence against any group, gender, sexuality, religion, ethnicity, or anything else bigots can possibly come up with to make me add here.

I will not do artwork with explicit features or actions, violence, or gore. (Light battle damage for an adventuring warrior, sure. But graphic unhealed injuries? Not my thing. Healed amputations and scars are okay! I have the capability for old wounds, surgical scars, and limb adjustments.)

Modifications of Agreement

These terms may be updated as needed for clarity, typographical issues, or changes in circumstances. So if you've read them once a while back, give them another glance for new commissions in case something changed. TOS on different types of commissions may vary, this one applies to the type of commission you are submitting the form for.
