1. Acceptance of Terms

Welcome to EmpowerHER! By accessing or using the EmpowerHER mobile application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use this App.

2. Description of Service

EmpowerHER provides a platform for users to create, share, and read affirmations, as well as create personal journal entries (“Service”). These Services may be used for your personal and non-commercial use.

3. Registration and Account Security

To access certain features of the App, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4. User Conduct

You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the App. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the App.

5. Intellectual Property Rights

The content on EmpowerHER, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, and interactive features (“Content”) are the intellectual property of EmpowerHER or its licensors.

6. User-Generated Content

You retain all your ownership rights to your submitted affirmations and journal entries. By submitting content to EmpowerHER, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with EmpowerHER.

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and disclose information about you.

8. Modifications to Service

EmpowerHER reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

9. Termination

EmpowerHER may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. EmpowerHER expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

You expressly understand and agree that EmpowerHER shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if EmpowerHER has been advised of the possibility of such damages), resulting from the use or the inability to use the service.

12. General Information

These Terms constitute the entire agreement between you and EmpowerHER and govern your use of the Service, superseding any prior agreements between you and EmpowerHER. The laws of the United States will govern these Terms of Use.
