Elite Washing Solutions Terms of Service (Pressure washing)
Please thoroughly review the terms and conditions agreement before we commence work to understand our service expectations.
Acceptance to terms
By accepting the quotation/estimate with Elite Washing Solutions, the client agrees to all terms and conditions in this agreement and authorise to do the service at an agreed-upon price.
Description of Binding Agreement
This document serves as a binding agreement between the homeowner, now identified as "client", and Elite Washing Solutions and its owners, employees and subcontractors, now identified as "Company," for the execution of services in exchange for payment for residential or commercial outdoor cleaning including pressure washing and non-pressure washing. The services that Elite Washing Solutions provide to you are subject to the following terms, and we reserve the right to update the terms and conditions anytime without notice. You can review the terms and conditions by clicking the terms and conditions links via our website, email communications or any other communications such as quotes and invoices.
Authorisation
The client agrees to allow Elite Washing Solutions on the property for cleaning services. The client understands that the completion of service has no set timeframe and may require several visits to the property. In addition, the cleaning service may need to move to the next available time if unforeseen circumstances like bad weather. The client understands that the Company will do their best to accommodate immediate reschedule but must work around other scheduled clients and weather. The Company also has permission to visit the property with little or no notice to assess service needs before the service date and to check completion after services have been rendered.
Water usage
The client agrees to allow Elite Washing Solutions to utilise their residential water source via an outdoor tap, which will be turned on and easily accessible on the service date. If on well water, or if in an area with low water pressure or volume, the client agrees to cease all water consumption inside the home, including faucets, dishwashers, washing machines, outdoor sprinkler systems etc.
Electric usage
The client agrees to provide Elite Washing Solutions Pro with the right to use an on-site source of electricity as needed to complete the stated project without compensation.
Acknowledgment of Risks and Releases of Liability
Elite Washing Solutions technicians are trained to use the equipment and cleaning products and take extreme precautions not to cause harm and damage to property. Safe techniques in cleaning will operate with the use of low-pressure cleaning to delicate surfaces such as sidings and roofs. However, damage can still occur due to poor maintenance, neglect of the property, or low-grade building materials. To avoid potential defects, the client should have routine maintenance following the manufacturer's recommendation. Before washing the home, the client must address any areas of concern to ensure a watertight seal to prevent damage. The client assumes all the risk and takes responsibility for any damage due to the above explanations.
The client released our Company of property damage unless negligence or willful misconduct caused it.
Inspection
On the service date, Elite Washing Solutions will note any pre-existing damage on the field, give the checklist/report to the client, and have them sign/accept. If the client is unable to sign/accept at the time of the noted damage, the Company will note the absence on the checklist/report and take photos of the noted damage. The client will have to sign/accept the checklist/report to note they have been informed of any damage once the work is complete. Elite Washing Solutions will notify the client of the damage and the supporting documentation before work if the client is unavailable during and at the time of completion. If damage is found during the cleaning process, the Company will cease all cleaning efforts until the client can see the damage and acknowledge its existence.
Plant/Landscaping
The client understands that Elite Washing Solutions has a set of procedures to ensure the plant life around the area to be clean is protected. In addition, the client understands that washing service may be scheduled during midday, and there could be potential for leaf burn as water could spray or get around the plant during the cleaning process.
Oxidation
House that has not been maintained or has contact with sun exposure may be susceptible to oxidation. Signs of oxidation are a chalky white powder on sidings. The client understands that oxidation and other blemishes will be noticeable after cleaning, especially in houses covered with debris.
Window Cleaning and Window Screens and House Softwash
The client understands that during the House Softwash service, you will only receive basic window cleaning. A basic window cleaning will eliminate debris, but spots may occur because hard water is used. If you are looking for a streak-free window, you will want to get the added Window Cleaning service.
The client must understand that some window screens are susceptible to damage, delicate and brittle during window cleaning. The Company will use extreme precautions when removing screens, but any damages because of wear and tear will be the client's responsibility.
If you are not getting the added Window Cleaning Service, just House Softwash Service only, the team of Elite Washing Solutions will not remove window screens nor will they be held liable for these damages.
On The Day of Service:
Please have a water spigot or outdoor tap activated and accessible.
During House soft wash and window cleaning, please have all windows & doors shut tightly.
Please have all pets inside before and during cleaning.
Please clear the work areas of all items and remove all flags, doormats, vehicles, or sensitive materials from the areas to be cleaned for work efficiency, to avoid damage and safety.
The Company suggests the client utilise their property's safety switch or circuit breaker to shut off power to any exterior outlets, light fixtures, or electrically powered features. Especially important for outlets that are not covered with exterior covers.
The client must understand that the Company strives to be efficient at work as possible, so respect is expected of the client. Please understand that Elite Washing Solutions refuses to service any client unrespectful to any of our team member.
Exclusions:
There is a $50.00 cancellation fee if notice is not received within 24 hours of service or if the team of Elite Washing Solutions arrives and cannot wash due to steps 1-4 not being completed.
Elite Washing Solutions is not responsible for water intrusion. While every effort is made to prevent this, bad seals around windows and doors and cracks in concrete foundations can make this unavoidable.
Elite Washing Solutions will do the job to the best possible result. This agreement to provide services is in no way a guarantee that it will remove stains completely.
Notify us if surfaces on or near the area cannot have any form of cleaning solution on them. If we did not receive notification before the service Elite Washing Solutions is not responsible for any ill effects on any surface.
Media Release
The client agrees to allow Elite Washing Solutions to use any photos, descriptions, reviews, quotes, or videos of the property or the
client in the context of marketing or advertising. The client must inform before the service if they do not want content utilised. The Company will use photos, descriptions, reviews, quotes, or videos without compensation to the client. Elite Washing Solutions will use the media for marketing and training purposes only. The client agrees not to seek punitive action in a civil court of law regarding the development, display, reproduction, or printing of the above examples of media. Including the use of photos, reviews and videos posted or displayed on online venues such as social media and the Company's website.
Quotes
Quotes are valid for 30 days. Elite Washing Solutions will only do the job described in the quote. Any additional services requested before or on the day of service will incur additional charges.
Payment
Payment is due upon receipt. There is a processing fee when paying through a credit card (which are 1.95% of the total charge + $0.30).
If any damage occurs
Elite Washing Solutions is obligated under our terms and conditions for any damage resulting from negligence, willful misconduct and operator error.
Discovered damage must be reported within three days of service completion. The Company will be allowed 60 calendar days from the date of written receipt to inspect the premise and have the sole option of repairing or contracting repair to any damages resulting from negligence.
Terms and Conditions for Crime Scene Cleanup Services
These Terms and Conditions ("Agreement") govern the use of crime scene cleanup services ("Services") provided by Elite Washing Solutions ("Company," "we," "our," or "us") to you ("Client," "you," or "your"). By engaging with our Services, you agree to comply with and be bound by the following terms.
1. Scope of Services
Elite Washing Solutions specializes in crime scene cleanup, including biohazard, blood, bodily fluids, decomposition, and trauma cleanup. Our Services are designed to remove hazardous substances from affected areas and restore the property to a safe and livable condition. The specific scope of the Services will be outlined in the Service Agreement provided to the Client prior to the commencement of work.
2. Client Responsibilities
Access to Property: The Client is responsible for providing the Company with full access to the property, vehicle, or any other areas that need to be cleaned. This includes providing access to all rooms, areas, and surfaces affected by hazardous substances. The Client must ensure that we can fully perform the necessary cleaning without obstruction.
Notification of Hazards: The Client is responsible for informing the Company of any known risks or potential hazards present in the property, such as dangerous chemicals, structural damage, or other hazards that may affect the cleanup process.
Payment: The Client agrees to pay the Company the agreed-upon fees for the Services rendered. Payment terms are outlined in the Service Agreement, and payment is due upon completion of the Services unless otherwise agreed.
3. Payment Terms
Estimate and Hourly Rate:Upon arrival at the scene, the Company will assess the situation and provide an estimate for the Services. Please note that we are unable to give an accurate quote until we arrive at the scene and evaluate the conditions.
Baseline Hourly Rate:Our baseline hourly rate is $300 per hour with a minimum of 4 hoursrequired.
Rate Adjustments: The hourly rate may increase based on various factors, including the amount of biohazard present, the effort required to remove the biohazard, the tools and skills utilized to clean the area, and any other circumstances that affect the complexity of the job.
Hazmat Disposal Fee:A hazmat disposal feewill be added to the final cost to cover the safe and proper disposal of hazardous materials, including but not limited to blood, bodily fluids, and other biohazardous substances. This fee will be included in the estimate and final pricing.
Hazmat Transport Fee:A hazmat transport feewill be added to cover the safe transport and disposal of hazardous materials to an approved disposal site. This fee will be determined based on the quantity of hazardous materials and the distance to the disposal facility.
Cancellation Fee: If the Client cancels the scheduled Services, a cancellation fee of $200 will apply. This fee helps to cover the costs incurred for scheduling and preparation. Cancellations must be made with at least 24 hours' notice to avoid this fee. Cancellations made with less than 24 hours' notice will incur the full $200 charge.
Non-Payment: In the event of non-payment, the Company reserves the right to seek collection through a collections agency to recover the outstanding balance.
Payment Plans: In-house payment plans will require a deposit before initial services can begin. Payment plans will be structured and agreed upon before services start.
Insurance: The Client shall provide all information regarding their insurance policy. If the insurance policy does not cover the full cost and fees, the Client will be responsible for the remaining balance.
4. Cancellation and Rescheduling
The Client may cancel or reschedule the Services with at least 24 hours' notice. Cancellations or rescheduling with less than 24 hours' notice will incur a $200 cancellation fee.
5. Liability and Insurance
Limitation of Liability: The Company shall not be liable for any indirect, special, or consequential damages, including any loss of business, reputation, or property damage caused by the cleanup process.
Insurance: The Company maintains adequate insurance coverage for its services, including general liability insurance. The Client is responsible for ensuring the property is insured for any damage that may occur during the cleanup process. The Client is also responsible for any loss or damage that is not covered by the Company’s insurance.
6. Confidentiality and Privacy
The Company respects the privacy of its Clients. All information related to the Services, including the nature of the cleanup, the affected property, and any personal information about the Client, will be kept confidential. The Company will not disclose any information without the Client's consent unless required by law or regulation.
7. Compliance with Laws
The Company agrees to comply with all local, state, and federal laws and regulations regarding the disposal of biohazardous materials and the cleanup of crime scenes. The Client agrees to comply with all applicable laws and ordinances concerning the use of the property and the cleanup process.
8. Hazardous Materials and Disposal
During the course of the Services, the Company may encounter hazardous materials, including but not limited to blood, bodily fluids, chemicals, and other biohazardous waste. The Company will safely remove and properly dispose of all hazardous materials in accordance with applicable laws.
Hazmat Disposal Fee: A hazmat disposal fee will be applied to cover the costs of safe removal and disposal of biohazardous materials.
Hazmat Transport Fee: A hazmat transport fee will apply to cover the transport of hazardous materials to an approved disposal site. This fee will be calculated based on the quantity of hazardous materials and transport distance.
Removal of Surfaces: If any surfaces or materials cannot be adequately cleaned due to contamination, they may need to be removed. The Company is not responsible for damages that may occur as a result of the removal of biohazardous materials.
Full Access: The Client agrees to provide full access to the building, vehicle, or any other area that needs to be cleaned. This access is necessary for the Company to properly clean and remove hazardous materials from all affected areas. The Client acknowledges that any obstruction that prevents full access may result in incomplete or delayed services.
Denied Access or Obstruction: If the Client denies access to areas or obstructs the cleaning process, resulting in insufficient or incomplete cleaning, the Company reserves the right to abandon the project and charge up to the full amount of the agreed-upon services provided up to that point.
9. Hazardous Cleaning Products
The Company will use cleaning products that are classified as hazardous and may cause injury if inhaled or improperly handled.
The Client has been made aware of the hazards associated with these cleaning products and has been advised to avoid entering the area while the cleanup process is being performed.
The Company is not responsible for any injuries or fatalities that occur due to the Client’s negligence in entering the cleanup area during the process.
The Client must adhere to the safety protocols provided by the Company to prevent harm.
10. Indemnification
The Client agrees to indemnify, defend, and hold harmless Elite Washing Solutions, its employees, contractors, and agents from and against any claims, losses, liabilities, or damages arising out of the Client's negligence, wrongful acts, or omissions during the cleanup process.
11. Force Majeure
The Company shall not be held liable for any failure or delay in providing the Services due to circumstances beyond its control, including but not limited to acts of God, natural disasters, government restrictions, or any other force majeure events.
12. Dispute Resolution
In the event of a dispute between the Client and the Company, the parties agree to attempt to resolve the issue through mediation or other alternative dispute resolution methods. If resolution is not reached, the dispute may be taken to arbitration or a court of competent jurisdiction.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state in which the Services are provided, without regard to its conflict of law principles.
14. Entire Agreement
This Agreement constitutes the entire understanding between the Client and the Company regarding the Services provided. Any modifications to this Agreement must be made in writing and signed by both parties.
By engaging with our Services, you acknowledge and accept the terms outlined in this agreement.
