At Ejja Maghna Travel, our priority is customer satisfaction. We strive to go the extra mile to ensure that every client receives excellent service and genuine value for money.
Our aim is for you to enjoy your holiday to the fullest and return to Malta feeling satisfied, refreshed, and relaxed. We therefore encourage you to read these Booking Terms and Conditions carefully before making your reservation.
The holidays and travel programmes featured in our programmes and promotional materials are planned and operated by Ejja Maghna Travel, 29, Triq il-Kbira, Xewkija, Malta, hereinafter referred to as the “Company”, “Tour Operator”, “Travel Agent”, “we”, “us”, or “our”.
These Terms and Conditions are intended to operate in accordance with applicable Maltese legislation, EU legislation, and relevant international rules and regulations. They apply to all aspects of your holiday, from the time your booking is made until your return to Malta.
These Terms and Conditions set out our obligations to you as well as your responsibilities and commitments when booking a holiday or travel package with us.
In these Terms and Conditions, the words “you”, “your” and their derivatives refer to the person making the booking and all other persons travelling under the same booking.
Once you have paid the required deposit and we have issued a receipt, your booking will be considered confirmed, subject to the applicable terms of the holiday or package booked.
The standard deposit is:
€400 per person for package holidays; and
€800 per person for long-haul holidays and cruises.
Payment of the deposit confirms that you have read, understood, and accepted these Terms and Conditions.
Please note that your participation in the tour or holiday is subject to payment of the full balance due within the applicable deadline.
When making a booking, you must provide your name exactly as it appears on your passport or other valid travel document. Failure to provide the correct name may result in you being refused boarding or may require a name correction or change.
Where a name change is required, an administrative fee of €50 may apply, together with any additional charges imposed by airlines, cruise companies, hotels, or other suppliers.
The same principle applies where you request that your booking be transferred to another traveller. Requests for changes or transfers should be submitted within a reasonable period and, where possible, no later than seven (7) days before the scheduled departure.
If you wish to make any other changes to your holiday arrangements, we will make reasonable efforts to accommodate your request. A €50 administration or handling fee may apply, in addition to any actual costs or charges imposed by our suppliers.
Where the price of accommodation depends on the number of people sharing a room and you subsequently change the number of persons travelling, the applicable price will be recalculated based on the new party size and the prices applicable at that time.
Any increase in the cost per person resulting from a reduction in the number of occupants—for example, changing from a twin room to a single room—is a price adjustment and shall not be considered a cancellation charge.
The prices published in our brochures, programmes, or other promotional materials are based on costs and exchange rates applicable at the time of publication and are generally stated per person.
Children's rates apply where the relevant child shares accommodation with two or three adults, subject to the conditions specified for the particular holiday.
The cost of your holiday may change between the date of publication, the date of booking, and the date of travel due to circumstances beyond our control, including:
Increases in fuel costs imposed by airlines, cruise operators, transport providers, or other suppliers;
Increases in taxes, duties, fees, or charges imposed by governments, airports, ports, local authorities, or other third parties, including tourist taxes, landing charges, embarkation or disembarkation fees;
Changes in visa or entry-related costs;
Changes in currency exchange rates or other currency fluctuations; and
Other increases in costs directly affecting the services included in your package.
Where applicable law provides you with rights in relation to price increases, those rights shall apply.
The outstanding balance for your holiday must be paid no later than:
Seven (7) weeks before departure for package holidays; and
Eight (8) weeks before departure for cruises and long-haul holidays.
If a booking is made less than the applicable period before departure, the full amount will be payable immediately.
Payment may be made by:
Cash;
Personal cheque;
Banker's cheque; or
Bank transfer.
As personal cheques may take up to seven (7) working days to clear, personal cheques will not normally be accepted within the final ten (10) working days before departure.
If we do not receive payment by the applicable deadline, we reserve the right to cancel your booking and apply the relevant cancellation charges.
You may cancel your booking at any time before departure, subject to the applicable cancellation charges.
Cancellation requests must be submitted in writing by one of the persons named on the booking or by the Travel Agent through whom the booking was made.
The cancellation will take effect on the date the written cancellation is received by our offices. Where applicable, the date stamped or otherwise officially recorded by our offices shall constitute evidence of the date on which the cancellation was received.
Unless different conditions apply to the specific holiday, the following cancellation charges shall apply:
More than 90 days before departure: the deposit paid;
89 to 75 days before departure: 50% of the total package price, including any extras previously booked;
74 to 60 days before departure: 75% of the total package price, including any extras previously booked;
59 days or less before departure: 100% of the total package price, including any extras previously booked.
For cruise packages, where cancellation takes place more than 90 days before scheduled departure, the deposit shall normally be forfeited.
Where cancellation takes place less than 65 days before scheduled departure, a cancellation charge of 100% of the total package price may apply.
The cancellation conditions imposed by the relevant cruise operator may also apply.
Where unavoidable and extraordinary circumstances occurring at the holiday destination significantly affect the performance of the package or substantially affect the carriage of passengers to the destination, you may have the right to cancel your booking without paying a cancellation fee and receive a refund of payments made, where provided for under applicable law.
We reserve the right to cancel a tour where there are insufficient bookings to operate the holiday in an economically viable manner. In particular, we may cancel a tour where fewer than 30 persons have booked, although other circumstances may also make cancellation necessary.
Where we cancel a holiday for this reason, we may offer you an alternative holiday of comparable standard, where available. You are under no obligation to accept or purchase the alternative holiday.
If you decline the alternative arrangement, we will refund the amounts paid to us for the cancelled holiday, subject to applicable law.
Where we cancel a tour for reasons of insufficient bookings, we will normally notify you at least 20 days before the scheduled departure, where reasonably possible and where applicable law permits.
We also reserve the right to cancel a tour where this becomes necessary due to force majeure or unavoidable and extraordinary circumstances. In such circumstances, we will notify you without undue delay.
No compensation will normally be payable where cancellation results from:
Circumstances attributable to you;
Unforeseeable and unavoidable circumstances attributable to third parties who are not connected with the provision of services included in the package, including government or public authorities;
Force majeure; or
Unavoidable and extraordinary circumstances.
Any rights you may have under applicable Maltese or EU law shall remain unaffected.
We take reasonable steps to ensure that appropriate arrangements are made for the holidays and travel services advertised by us.
We are not responsible for additional costs, losses, inconvenience, or consequential loss arising from independent arrangements that you make with third parties outside the services included in your package.
Although we carefully select and work with our suppliers, we do not have direct control over every service provided by airlines, hotels, cruise operators, transport companies, entertainment providers, or other third parties.
We cannot be held responsible where activities or services are cancelled or altered due to force majeure or unavoidable and extraordinary circumstances, including adverse weather conditions, strikes, industrial action, government restrictions, or the illness or unavailability of a performer or other person involved in an event.
We will make reasonable efforts to communicate your specific requests to our suppliers. However, such requests cannot be guaranteed, as they remain subject to availability and confirmation by the relevant supplier.
Where a travel service included in your package is not performed in accordance with the package contract, we will take appropriate steps to remedy the lack of conformity, unless doing so is impossible or would involve disproportionate costs, subject always to applicable law.
We carefully plan our holidays to provide an enjoyable and comfortable experience. However, circumstances may occasionally require us to make changes to your itinerary or other arrangements.
Changes may become necessary due to, among other things:
Force majeure;
Unavoidable and extraordinary circumstances;
Government or local authority action;
Essential maintenance or cleaning;
Changes made by suppliers;
Hotel closures or overbooking;
Local or religious holidays;
Weather conditions;
Road or traffic conditions;
Mechanical breakdowns;
Police or security activity; or
Changes to flight schedules.
Where reasonably possible, we will inform you of any changes as soon as they are communicated to us.
Tour itineraries may occasionally need to be changed at short notice due to circumstances beyond our control. We will endeavour to minimise any inconvenience and maintain the overall quality of the holiday.
If we are required to make a significant change to your travel arrangements before departure, we will notify you or your Travel Agent within a reasonable period and provide details of the proposed change.
Where a change is significant, or where the change increases the price of your package by more than 8%, and you do not wish to accept the revised arrangements, you may have the right to cancel your booking without cancellation charges, subject to applicable law.
Where applicable, cancellation must be communicated within a reasonable period and, unless otherwise required by law, no later than seven (7) days after notification of the change or seven (7) days before scheduled departure, whichever occurs first.
In exceptional circumstances, it may become necessary to change accommodation or another element of your holiday after your holiday has commenced.
Where this occurs, we will make reasonable efforts to provide an alternative arrangement of a comparable standard.
If the alternative arrangement is of a lower quality or value than the original arrangement, you may be entitled to an appropriate reduction in price, where provided for under applicable law.
The airlines listed in our programmes are those we anticipate using. The final choice of airline remains at our discretion, and we reserve the right to use an alternative airline or aircraft where necessary.
If such a change occurs, we will inform you as soon as reasonably possible.
Flight schedules are subject to change and confirmation by the relevant airline. Our reservation system will reflect the latest schedules communicated to us.
You should carefully check your flight tickets and travel documents as soon as you receive them, as these will contain the confirmed flight times.
Some flights may include intermediate stops or technical stops that are not known at the time of booking. Where such information becomes available to us, we will communicate it as appropriate.
Flights are also subject to the granting of the necessary permits and licences by authorities in Malta and abroad.
We cannot accept responsibility for losses or consequential damage arising from changes imposed by airlines, airports, authorities, or other third parties, except where liability cannot lawfully be excluded.
However, we will endeavour to notify you promptly when any material change becomes known to us.
Where a flight delay results in an unavoidable overnight stay abroad and where applicable under the relevant passenger-rights legislation, we will provide or arrange appropriate assistance, which may include reasonable meals and refreshments, accommodation where necessary, transport between the airport and accommodation, and reasonable means of communication.
All air and other transport services are subject to the applicable conditions of carriage of the company providing the transport. These conditions may incorporate the laws and regulations of the country in which the transport provider operates.
Descriptions of hotels and other accommodation in our brochures and programmes are based on information supplied by the relevant accommodation providers at the time the material was prepared.
Unless otherwise specified, hotel check-in is normally not available before 3:00 p.m., while rooms must generally be vacated by 9:00 a.m. on the day of departure. Guests are expected to follow the instructions of the tour leader and accommodation management.
Hotel rooms and cruise ship cabins may vary considerably in size and facilities and may be smaller than accommodation standards with which you are familiar.
Our programmes generally provide single or twin rooms. Triple and quadruple rooms may have limited availability.
Where a third or fourth person shares a twin room, the accommodation provider may provide a folding bed, bunk bed, sofa bed, or other supplementary sleeping arrangement. This may result in reduced space and comfort.
In the United States, rooms occupied by three or four persons may generally contain two double beds rather than separate single beds for each guest.
Room and cabin allocation is the responsibility of the accommodation provider. We cannot guarantee the size, layout, location, view, or specific configuration of a room or cabin.
At the time of booking, you may inform us of your preferred room arrangement, such as twin or double beds, adjoining rooms, or a particular view. We will make reasonable efforts to communicate your preferences to the accommodation provider, but we cannot guarantee that such requests will be fulfilled.
Swimming pools may only be heated during colder periods, depending on the individual property.
Standards relating to hygiene, public facilities, drainage, plumbing, and other services may vary between destinations and may differ from standards normally experienced in Malta.
Unless otherwise stated, breakfast is normally continental.
Lunch and dinner are generally served as three-course meals unless otherwise specified.
Food choices may be limited unless special dietary requirements or allergies have been communicated to us at the time of booking. Where such information is provided, we will communicate it to the relevant catering establishment.
Please note that portion sizes may differ from those customary in Malta.
Where buffet meals are provided, a selection of food will normally be available.
Drinks, including bottled water and soft drinks, are not included unless expressly stated in the package and must be paid for separately.
Charges for hotel mini-bars, telephones, pay television, room service, and similar facilities are not included in the package price unless expressly stated.
Hotel policies and charges vary. If you are uncertain whether a service carries an additional cost, you should check with the hotel directly before using it.
Unless expressly stated otherwise, entrance fees for museums, shows, attractions, boat trips, train journeys, cable cars, and similar activities are not included in the package price and must be paid separately.
Unless otherwise stated, excursions generally do not include the services of a local guide, although coach transportation may be included.
Only the services specifically listed under “Price Includes” are included in the package price.
We are responsible only for excursions and activities expressly included in our published programme.
If you fail to attend or miss an included excursion or transfer, you will generally not be entitled to a refund.
We are not responsible for additional excursions, activities, or services arranged independently by you, by your tour leader, or by another third party while abroad where such services are not included in our published programme or have not been authorised in writing by Ejja Maghna Travel management in Malta.
Each group tour will normally be accompanied by a Maltese-speaking tour leader responsible for assisting with the implementation of the published programme.
The tour leader is not responsible for providing services outside the official programme and is not required to accompany individual members of the group while shopping, visiting flea markets, theme parks, or other locations, even where such visits form part of the published itinerary.
In an emergency, including where a client suffers an injury or becomes a victim of crime, the tour leader will make reasonable efforts to assist the client in contacting local medical services, authorities, consular services, or other appropriate assistance.
Where necessary, the tour leader may also assist with alternative travel arrangements.
We reserve the right to charge for reasonable costs incurred in providing assistance that falls outside the services included in the package.
If you experience a problem during your holiday, you should notify your tour leader immediately and, where possible, provide the complaint or notification in writing so that appropriate action can be taken without unnecessary delay.
You are responsible for ensuring that you comply with all applicable travel requirements and regulations.
You must ensure that you have a valid passport or other valid travel document and any visas, permits, or authorisations required for your journey.
We strongly recommend that you verify passport, visa, entry, and travel-document requirements with your Travel Agent and the relevant authorities well in advance of departure, particularly if you are travelling on a non-Maltese passport.
Any fines, charges, penalties, or other costs arising from failure to comply with applicable travel-document or immigration requirements shall be your responsibility.
Health facilities, hygiene standards, and risks associated with disease vary between destinations.
You are responsible for ensuring that you are medically fit to travel and should seek appropriate advice from your doctor or other qualified healthcare professional before travelling.
You should obtain any vaccinations, medication, or other health precautions recommended for your destination and ensure that any required treatment is commenced within the appropriate timeframe.
If travelling within Europe, we recommend that you carry a valid European Health Insurance Card (EHIC) where applicable.
Airlines may impose restrictions on passengers who are pregnant. If you are more than 28 weeks pregnant at the time of your return journey, you may be required to provide a medical certificate confirming that you are fit to travel.
You should check the specific requirements of your airline before travelling.
We strongly recommend that you purchase comprehensive travel insurance appropriate to your holiday.
Ejja Maghna Travel may offer travel insurance for purchase; however, you are not obliged to purchase your insurance through us unless otherwise required by the terms of your booking.
You are expected to behave responsibly and respectfully throughout your holiday.
We reserve the right to refuse to accept or continue to provide services to any person whose behaviour, in our reasonable opinion or in the opinion of an airline pilot, ship captain, hotelier, accommodation manager, or other person in authority, is likely to cause distress, danger, damage, disruption, or annoyance to other customers, employees, suppliers, or members of the public.
Where a person is required to leave accommodation, transport, or other facilities because of unacceptable behaviour, we will not normally be responsible for providing a refund, compensation, or reimbursement of resulting costs, subject to applicable law.
For holidays where a reduced child rate applies, the child must meet the age requirements specified for the particular package.
Where a child has reached the applicable age limit by the end of the holiday but was booked as a child, additional charges may apply and the airline or other service provider may refuse boarding or service in accordance with its applicable conditions.
Customers are responsible for providing accurate dates of birth at the time of booking.
We welcome travellers with disabilities and special requirements.
However, our tour leaders and other personnel cannot provide personal care or act as personal assistants or carers.
You should inform us at the time of booking of any accessibility requirements, disabilities, mobility limitations, medical conditions, or other circumstances that may affect your ability to participate in the holiday.
Providing such information in advance allows us to communicate your requirements to the relevant suppliers and determine whether suitable facilities and services are available.
While we will make reasonable efforts to accommodate your requirements, we cannot guarantee that all requested facilities or adaptations will be available.
We welcome senior travellers.
Please note that some travel insurance providers apply special terms, conditions, or restrictions to travellers aged 70 or over.
You should therefore check with your insurance provider and travel adviser that the level of activity involved in your chosen holiday is appropriate and that your insurance provides adequate cover.
We are responsible for the proper performance of the travel services included in your package, subject to the limitations and protections provided by applicable Maltese and EU law.
We are not responsible for services or arrangements that are outside the package purchased from us or that are independently arranged by you with third parties.
We cannot accept responsibility for theft, loss, injury, damage, delay, or other incidents except to the extent that we are legally responsible under applicable law.
Activities and excursions may involve inherent risks. You should follow all safety instructions provided by tour leaders, guides, transport operators, accommodation providers, and other service providers.
Nothing in these Terms and Conditions shall exclude or restrict any liability that cannot legally be excluded or limited under applicable law.
Ejja Maghna Travel participates in the applicable insolvency protection arrangements for package travel, where required by Maltese law.
Where an insolvency protection certificate is issued in relation to your booking, you should retain this document carefully, as it provides evidence of the protection applicable to your package in the event of insolvency.
Force majeure and unavoidable and extraordinary circumstances may affect the performance of a holiday or package and may constitute circumstances beyond our reasonable control.
Such circumstances may include, but are not limited to, natural disasters, severe weather conditions, war, terrorism, serious security risks, pandemics, government restrictions, strikes, or other events that could not reasonably have been avoided or overcome.
Where a cruise ship is unable to call at a scheduled port for safety reasons, force majeure, or unavoidable and extraordinary circumstances, passengers may be transported to an alternative port, including by air where necessary, at no additional cost where such arrangement is provided by the relevant operator.
In such circumstances, port taxes or similar charges may not be refundable where these have already been incurred or are non-refundable under the applicable supplier terms.
Your statutory rights under applicable Maltese and EU law remain unaffected.
We make every reasonable effort to provide an enjoyable and trouble-free holiday. However, if you experience a problem, we ask that you give us the opportunity to resolve it as quickly as possible.
If you have a complaint concerning the overseas part of your holiday, you should notify our tour leader, representative, or local agent as soon as possible.
Where possible, complaints should also be submitted in writing. Prompt notification allows us and our suppliers to investigate the matter and, where possible, resolve it while you are still on holiday.
WhatsApp groups or other informal messaging groups created by tour leaders, clients, or other participants are not official communication channels of Ejja Maghna Travel unless expressly stated otherwise.
Where such groups are created independently, Ejja Maghna Travel is not responsible for their content, administration, messages, opinions, or information shared within them.
Any formal complaint, request, notification, or other official matter concerning your booking or holiday must be communicated directly to Ejja Maghna Travel through an appropriate formal channel, such as:
Email;
Written correspondence handed to the tour leader for forwarding to the Company; or
Registered mail.
Informal messages posted in WhatsApp groups or other unofficial communication channels should not be considered formal notification of a complaint unless expressly acknowledged by the Company.
In addition to reporting a problem while abroad, you should notify us in writing of any unresolved difficulty or complaint within seven (7) days of your return from the holiday, where applicable.
Prompt notification is important because it allows us to investigate the circumstances while relevant information and evidence are still available.
Nothing in this clause is intended to remove or restrict any mandatory rights or remedies you may have under applicable Maltese or EU legislation.
All disputes relating to a package holiday shall be governed by Maltese law and, subject to applicable consumer-protection and jurisdiction rules, shall be submitted to the competent courts of Malta.
For cruises, complaints should be submitted in writing within two (2) months of the incident, unless a different period applies under the applicable law or the cruise operator's conditions.
We will make reasonable efforts to investigate and address your complaint.
If you remain dissatisfied with our response, you may have the right to seek further assistance or lodge a complaint with the Malta Competition and Consumer Affairs Authority (MCCAA) or another competent authority, in accordance with your applicable rights as a passenger and consumer.
These Terms and Conditions have been prepared with reference to applicable Maltese and EU legislation governing package travel, consumer protection, passenger rights, and related services.
The Terms and Conditions may be amended from time to time to reflect changes in applicable legislation, regulatory requirements, business practices, or the services provided by Ejja Maghna Travel.
Any amendments will apply in accordance with applicable law and, where required, will be communicated to customers through the appropriate channels.
Where any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.
