In New Jersey, a person who receives a DWI conviction and is subsequently convicted of a similar offense within seven years must serve the suspended sentence and complete the alcohol education classes or other substance abuse treatment programs.

A person who has been convicted of an impaired driving offense and subsequently convicted of a similar offense within five years must complete a drug and alcohol treatment program. The court may impose a term of imprisonment of up to 364 days for the first violation and a consecutive term of imprisonment of up to 364 days for subsequent violations. A person who violates the law more than once within a five-year period must be sentenced to one year in prison.

When someone has been convicted of a DWI offense and received a suspended license, the state suspends his/her driving privileges until the suspension expires. The suspended license will remain on file in the motor vehicle bureau of the police department where the original offense was reported.

The New Jersey Motor Vehicle Commission requires that a person whose license is suspended for a second or subsequent offense apply for reinstatement of driving privileges. A person can only have one suspension on record at any given time. The motor vehicle commission will send an application for reinstatement to the police department where the original offense occurred. If the police department does not approve the application, the person can appeal the decision to the motor vehicle commission.
