TERMS & CONDITIONS
1. Payment Terms & Billing Policy
Residential Projects: Due in full immediately upon completion.
Commercial Projects (Under $5,000): Due in full immediately upon completion unless otherwise agreed upon in writing.
Commercial Projects (Over $5,000): Standard Net-14 terms apply. Extended Payment Plans: We offer 30, 60, and 90-day extended schedules.
These require a 50% mobilization deposit and a signed Supplemental Pay Agreement prior to project scheduling. Late Fees: Balances exceeding the agreed-upon terms are subject to a 1.5% monthly service charge (18% per annum).
2. Site Access & Resident Coordination (The "No-Tow" Policy)
For the safety of our crew and the quality of the finish, the work area must be 100% clear of vehicles, pedestrians, and active irrigation (sprinklers) by 7:00 AM on the scheduled date. Property Manager Responsibility: It is the client’s duty to notify residents of the phasing schedule. Delay Fees: Any vehicles remaining in the work zone that cause a delay or require a return trip will incur a $250.00 mobilization fee.
3. Wisconsin Weather & Environmental Disclaimer :
Work is strictly weather-dependent. To ensure proper curing and adhesion, Draki Enterprises LLC reserves the right to reschedule due to rain, high humidity, or temperatures below 50°F. We are not liable for damage caused by: Precipitation occurring after the manufacturer’s recommended "dry-to-touch" window. Winter maintenance (snow plows, salt, de-icing chemicals). Sub-surface hydrostatic pressure (groundwater) or freeze/thaw cycling.
4. Service Guarantee & Scope:
Draki Enterprises LLC provides high-performance restoration using industry-leading materials. Please note that sealcoating is a protective barrier; it is not a structural repair for "alligatored" or failing sub-bases. Performance is subject to the age, porosity, and existing condition of the asphalt.
5. Insurance & Compliance:
Draki Enterprises LLC is fully insured with General Liability and Workers' Compensation. Certificates of Insurance (COI) naming the property management group or association as "Additionally Insured" are available upon request prior to project commencement
