Terms of Use (End User License Agreement) for DoxSAFE

Acceptance of Terms
By downloading, installing, or using DoxSAFE ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download, install, or use the App.
These Terms constitute a legal agreement between you ("User" or "you") and the DoxSAFE developer ("we," "us," or "our").
License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use DoxSAFE on your personal iOS devices for your personal, non-commercial use.
This license does not allow you to:
• Use the App on any device you do not own or control
• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Remove or alter any proprietary notices on the App
Subscription Terms
DoxSAFE Pro Subscription
The App offers a free version with limited functionality and a paid subscription ("DoxSAFE Pro") with unlimited features.
• Free Version: Limited to storing one (1) document
• Pro Version: Unlimited document storage and access to all premium features
• Subscription Options: Available as monthly or annual subscriptions (as displayed in the App)
• Pricing: Subscription prices are displayed in your local currency and may vary by region
Payment and Billing
• Payment Method: Payment will be charged to your Apple ID account at the confirmation of purchase
• Automatic Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period
• Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
• Price Changes: We may change subscription prices at any time. Price changes will apply to new subscriptions and renewals after notice is provided
Managing Your Subscription
• Access Management: You can manage your subscription and turn off auto-renewal in your App Store Account Settings
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period
• No Partial Refunds: No refunds are provided for partial subscription periods
• Post-Cancellation: After cancellation, you will revert to the free version limitations (one document maximum)
Free Trial (if applicable)
• Trial Period: If a free trial is offered, you must cancel before the trial ends to avoid being charged
• Eligibility: Free trials are typically available only once per Apple ID
• Conversion: After the trial period ends, your subscription will automatically convert to a paid subscription unless cancelled
Permitted Use of the App
You may use DoxSAFE to:
• Store personal documents securely on your device
• Organize and manage your documents
• Set expiry dates and reminders for your documents
• Sync documents via iCloud to your own devices (if enabled)
• Password-protect sensitive documents
• Export and share your documents as needed
Prohibited Uses
You agree NOT to:
• Use the App for any illegal purposes or to store illegal content
• Store content that violates copyright, trademark, or other intellectual property rights
• Store or distribute malicious software, viruses, or harmful code
• Use the App to harass, abuse, or harm others
• Attempt to reverse engineer, hack, or compromise the App's security
• Share your subscription access with others not authorized under these Terms
• Store content that is defamatory, obscene, or violates others' privacy rights
• Use the App in any way that could damage, disable, or impair the App
User Content and Responsibility
• Your Documents: You retain all rights to the documents you store in DoxSAFE
• Your Responsibility: You are solely responsible for the content of your documents and any consequences arising from storing them
• Backups: You are responsible for maintaining backups of important documents. We are not responsible for data loss
• Legal Compliance: You must ensure your use of the App complies with all applicable laws
Data and Privacy
• Privacy Policy: Your use of DoxSAFE is also governed by our Privacy Policy, available at https://sites.google.com/view/hymscore/privacy
• Local Storage: Your documents are stored locally on your device
• iCloud Sync: If enabled, documents are stored in your personal iCloud account
• No Access: We do not have access to your documents or their contents
• Encryption: You can use password protection and encryption for additional security
• Lost Passwords: We cannot recover password-protected documents if you forget the password
Disclaimer of Warranties
DoxSAFE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
• The App will be uninterrupted, error-free, or completely secure
• The App will meet all your requirements or expectations
• All data will be preserved in all circumstances
• The App will be compatible with all devices or future iOS versions
• Any errors or defects will be corrected
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
• We are not liable for any indirect, incidental, consequential, special, or punitive damages
• We are not liable for data loss, corruption, or deletion
• We are not liable for loss of profits, revenue, or business opportunities
• We are not liable for device damage or malfunction
• Our total liability shall not exceed the amount you paid for subscriptions in the 12 months preceding the claim
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless DoxSAFE and its developers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you store in the App
Changes to the App and Features
We reserve the right to:
• Modify, suspend, or discontinue any features at any time
• Update pricing for new subscriptions (existing subscriptions maintain their current price until renewal)
• Require app updates for continued functionality
• Change the App's appearance, features, or functionality
We will make reasonable efforts to notify you of significant changes through app updates or notifications.
Termination
We may terminate or suspend your access to DoxSAFE immediately, without prior notice or liability, if you:
• Violate these Terms of Use
• Use the App for illegal purposes
• Attempt to harm, exploit, or compromise the App
• Engage in fraudulent activity related to subscriptions
Upon termination:
• Your right to use the App will cease immediately
• You may lose access to your subscription features
• Your documents stored locally will remain on your device until you delete the App
• No refunds will be provided for terminated accounts
Apple Requirements
This App is distributed through the Apple App Store and is subject to:
• Apple's Licensed Application End User License Agreement (EULA)
• Apple's App Store Terms and Conditions
• Apple Media Services Terms and Conditions
Acknowledgments:
• Apple has no obligation to provide maintenance or support services for the App
• Apple is not responsible for the App or any claims related to it
• You will comply with any applicable third-party terms when using the App
• Apple and Apple's subsidiaries are third-party beneficiaries of this EULA
In the event of any conflict between this EULA and Apple's EULA, Apple's EULA will govern.
Intellectual Property
All intellectual property rights in DoxSAFE, including but not limited to software, design, graphics, text, and trademarks, are owned by or licensed to the developer.
You may not:
• Use our trademarks without permission
• Copy or reproduce the App's design or code
• Create competing products based on DoxSAFE
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of [YOUR JURISDICTION], without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved in the courts of [YOUR JURISDICTION].
For users outside [YOUR JURISDICTION], local laws may also apply.
Dispute Resolution
Before filing a legal claim, you agree to try to resolve any disputes informally by contacting us first. We will attempt to resolve disputes in good faith.
If informal resolution fails, disputes may be resolved through:
• Binding arbitration (if applicable in your jurisdiction)
• Small claims court
• Courts of competent jurisdiction
Changes to These Terms
We may update these Terms from time to time for legal, operational, or regulatory reasons. We will notify you of material changes through:
• In-app notifications
• App Store update notes
• Email (if we have your email address)
Continued use of the App after changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the App.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DoxSAFE regarding your use of the App.
These Terms supersede any prior agreements, communications, or understandings between you and us.
No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions.
Assignment
You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms at any time without notice.
