The length of copyright protection varies from country to country, but music, along with most other creative works, generally enters the public domain 50 to 75 years after the death of the creator.[citation needed] Generally, copyright separately protects "musical compositions" (melodies, rhythms, lyrics, etc. as written in sheet music) and "sound recordings" (performances as recorded in audio files, CDs, and records).[2] Therefore, a recording of Rhapsody in Blue made in 2020 could be protected by copyright even though the underlying composition lies in the public domain.

In the European Union and Canada, sound recordings were copyrighted for 50 years until 2013. On 1 January 2013, the Beatles' single "Love Me Do" entered the public domain.[7] As of November 2013, European sound recordings are now protected for 70 years, which is not retroactive.[8] In 2015, Canada changed the copyright length to 70 years.[9]

If a piece of music does not fall within the public domain and is instead under copyright protection, most countries' laws forbid the reproduction, public performance, distribution, and creation of derivative works without the permission of the copyright holder.[16][17] Under compulsory licensing laws, some of these actions may in fact be lawful, but the infringing party would then be liable to pay royalties to the copyright holder for the use of their work.[18]

Inherently, all historical musical works (pre-1928) are public domain.[16] Classical sheet music, for example, is widely available for free use and reproduction. Some more current works are also available for free use through public works projects such as Internet Archive. This and similar projects aim to preserve and make readily available thousands of public domain music files, many of which have been recorded by projects dedicated to recording music for public use.

The Creative Commons is a nonprofit organization created for the purpose of housing the public domain. The Commons allows copyright owners to dedicate their works to the public domain either immediately or, with the "Founders' Copyright" (originally created in the first American copyright law in 1790), can obtain an exclusive license for 14 or 28 years (if renewed) of copyright protection in exchange for selling their work to the Commons for one dollar after that protection has expired. I have a question about public domain works that have been uploaded to musescore.com with copyright attached to them. I have limited understanding of copyright law so hoping someone on here can help me out! What I do understand is that while the original work may be in the public domain, transcribers can copyright their arrangement including eg. fingerings, phrasing, page turns etc.

I am wondering what right, if any, we have to use a copyrighted public domain musescore files, for just the notes without any copyrighted formatting. For example, say I downloaded a copyrighted public domain file and removed all markings so I'm just left with the notes (that are in the public domain, but now formatted in a musescore file)- is this allowed, or am I infringing copyright by sourcing these notes from a copyrighted file?

Essentially, I am looking to source copyright free musescore files of public domain works. It is fine if articulation, fingerings etc. are missing. Am I legally allowed to use copyrighted files to create this, by removing any formatting/markings that could be copyrighted and 'stripping' the file to its base notes that are in the public domain?

Public Domain refers to works that have intellectual property rights that have expired, have been forfeited (as in Creative Commons), or have been waived. These works are free to use without needing to obtain rights permission. Music recordings are copyright protected separately from musical compositions. There are no sound recordings in the Public Domain in the USA.

Boy oh boy, temp music can be a curse! I have finished shooting a straight8 (straight8.net) for 2012 and the temp track we used, "Shuang Shuang Yan" by Deng Bai Ying, is so so so so much better than anything else we try, it's torture.

In general, I recommend The Internet Archive for public domain music ( ). You can sometimes also find music that will suit your purpose at the Open Music Archive ( ) and there are occasionally musical offerings available through the Public Domain Review ( ).

That being said, the reason I found your post in the first place is that I'm *also* looking for public domain Chinese music and none of those sources have turned up much (there is a little at the Internet Archive, so you might want to look at what they've got and see if any of it suits you).

Thousands of works published in the United States before 1964 fell into the public domain because the copyright was not renewed in time under the law in effect then. If a work was first published before 1964, the owner had to file a renewal with the Copyright Office during the 28th year after publication. No renewal meant a loss of copyright.

Under the Music Modernization Act of 2018 (see section 1401 in the bill), all sound recordings published before January 1, 1923 entered the public domain on January 1, 2022. This means that thousands of sound recordings from the Library of Congress are now free to use and reuse in Citizen DJ. Furthermore, for each year between 2023 and 2046, recordings older than 100 years will enter the public domain. This is significant because until 2022, no sound recording has entered the public domain due to copyright expiration. Now in its twelfth year, the National Jukebox has grown to over 16,000 early 20th Century recordings from the Victor, Columbia and Harmony labels. The recordings on the National Jukebox date from 1900 to 1925 and, under the Music Modernization Act, all sound recordings published prior to 1923 have entered the public domain effective on January 1, 2022.
