Today, the White House Office of Science and Technology Policy (OSTP) updated U.S. policy guidance to make the results of taxpayer-supported research immediately available to the American public at no cost. In a memorandum to federal departments and agencies, Dr. Alondra Nelson, the head of OSTP, delivered guidance for agencies to update their public access policies as soon as possible to make publications and research funded by taxpayers publicly accessible, without an embargo or cost. All agencies will fully implement updated policies, including ending the optional 12-month embargo, no later than December 31, 2025.

This policy will likely yield significant benefits on a number of key priorities for the American people, from environmental justice to cancer breakthroughs, and from game-changing clean energy technologies to protecting civil liberties in an automated world.

In the short-term, agencies will work with OSTP to update their public access and data sharing plans by mid-2023. OSTP expects all agencies to have updated public access policies fully implemented by the end of 2025. This timeline gives agencies, researchers, publishers, and scholarly societies some flexibility on when to adapt to the new policies. Over the long term, OSTP will continue to coordinate with federal agencies to ensure that government public access policies adapt to new technologies and emerging needs.

At the request of Congress, the Copyright Office reviewed and assessed (1) how the existing bundle of exclusive rights under Title 17 covers the making available right in the context of digital on-demand transmissions such as peer-to-peer networks, streaming services, and music downloads, as well as more broadly in the digital environment; (2) how foreign laws have interpreted and implemented the relevant provisions of the WIPO Internet Treaties; and (3) the feasibility and necessity of amending U.S. law to strengthen or clarify our law in this area.

The Secretary of State is aware that many transactions in the business and financial world are time sensitive. The office strongly encourages electronic filing through SOSDirect or SOSUpload to ensure swift processing times. To better serve the public, this office provides forms for downloading, filings by fax, expedited and preclearance services, online certificate verification, and a range of payment methods.

The SOSUpload System allows you to upload certain documents required to create a new business entity, register an existing out-of-state business entity, or make a change to a business entity's record. By using SOSUpload, you will have the ability to file documents not currently available for filing on SOSDirect.

Expedited processing may be requested for documents and orders received by mail, fax, or by personal delivery. Please include a cover letter containing an email address and daytime phone number with a mailed or faxed instrument/order. The cover must specifically request expedited processing.

The office expedites the processing of business organization documents for a fee of $25 per document and expedites the processing of certified copies and certificates for a fee of $10 per certified copy or certificate.

The Secretary of State will pre-clear a business filing instrument upon written request. The fee is $50 per instrument. Generally, an instrument submitted for preclearance is a draft of an instrument that will be submitted for filing at a later date. The instrument to be pre-cleared will not be filed, but reviewed for compliance with minimal statutory filing requirements. The instrument will be returned with a written statement that the draft instrument is suitable for filing or with the reasons why the instrument would be rejected if submitted for filing as drafted.

All checks should be made payable to the Secretary of State. Cash should not be sent in the mail. Checks are returned, cash refunded, credit cards and LegalEase are not charged when used to pay a filing fee for documents that cannot be filed.

Evidence of filing is typically returned by regular mail for documents received by mail, fax, or personal delivery. If you require an alternate return method, such as return of your documents by a shipping company like Federal Express, the Secretary of State will attempt to accommodate your request.

When documents may be filed with reproduced signatures, the Secretary of State accepts faxed documents for filing. Fax filings for business organization filings should clearly specify whether expedited service is requested.
