This outlines policies for you, the client, to commission DeltaEpsilon, the artist.
General Policies
The client must be at least 18 years old to commission the artist.
The artist will not draw any characters that the client does not own the copyrights to. If the client wants to include characters with copyrights owned by other people, then the artist must receive approval from those people directly.
If the client has any questions, such as about these terms or about what the artist will/will not draw, then they are encouraged to contact the artist. The artist will not be offended by any such inquiries.
Contact
The artist may be contacted via private message (PM) as DeltaEpsilon on FurAffinity.net, Weasyl.com, and SoFurry.com or as DookDookDraw on Twitter.com. The artist may also be contacted through email using the Quotes and Contact forms on their website at https://sites.google.com/view/dookdookdraw/ .Â
Commissions will not be taken through Telegram, Discord, or any other instant messenger service.
The client is encouraged to contact the artist regarding their commission through one consistent method. Contact through other methods may be redirected to the original method for consistency and record keeping.
The client is encouraged to wait at least one week between progress update requests.
Making excessive offensive comments or making excessive progress update requests may result in cancellation of the commission. See the Cancellation and Refunds section for full details.
Prices and Payment
The client must contact the artist with a short description of the commission idea to receive a full price quote. This quote must be paid upfront and in full. Payment is accepted via online payment processor (e.g., Stripe) invoices only. Payment attempted via other means will be refused and/or returned in full.
Delivery
The artist will deliver two versions of a digital png image. One version will be compressed for posting online (around 800 pixels resolution), and the other version will be uncompressed for personal use (around 3200 pixels). No physical items will be printed or shipped.
Completion Time
Completion time varies based on the details of the commission. Typical completion times are between one week and one month. If the commission must be completed within a certain amount of time, then it must be discussed and agreed upon before any work begins.
If the artist fails to complete the commission within the agreed upon completion time (or within three months if there was no agreed upon completion time), then the client may be eligible to request a refund. See the Cancellation and Refunds section for full details.
Edits and Corrections
The drawing stages are rough sketching, refined sketching, inking, coloring, and shading. After each stage is completed, the client will receive a watermarked work-in-progress (WIP) image and may make an edit request one time. An edit request may contain any number of minor edits, such as slight changes to expressions, proportions, positions, colors, and patterns.
If the client makes edit requests to a drawing stage multiple times or requests major edits, then they will be done at the artist's discretion and may incur additional cost up to 25% of the original commission price. This is required so that work can progress at a steady pace rather than waiting on repeated back and forth communication.
If the artist makes an error so that something does not match the original commission description, then any required corrections will be made at no penalty or additional cost.
Cancellation and Refunds
The commission may be canceled by the client for multiple reasons:
Requesting the cancellation. The client may request that the commission be canceled at any time, up to when the artist sends the final WIP images.
Making excessive offensive comments. If the client makes threatening, vulgar, or otherwise offensive comments toward the artist personally, then the client will be warned. If the client continues, then the commission may be canceled. This is required so that the artist does not feel uncomfortable or unsafe while working with the client.
Making excessive progress update requests. If the client requests progress updates three or more times in less than one week, then the client will be warned. If the client continues, then the commission may be canceled. This is required so that the artist is not overburdened by bookkeeping, especially when working with multiple clients.
If the client cancels the commission for any reason, then they will receive a partial refund based on drawing stage completion. The drawing stages are rough sketching, refined sketching, inking, coloring, and shading, and each applicable stage deducts equally from the partial refund. If the client is considering canceling the commission, then they are encouraged to request that the work be put on hold. This will avoid reducing the partial refund further.
If the artist cancels the commission for any reason, then the client will receive a full refund. If the artist does not finish the commission within the agreed upon completion time (or within three months if there was no agreed upon completion time), then the client may choose to either wait longer or receive a full refund. The agreed upon completion time excludes any time spent waiting for communication from the client and any time that the work was on hold.
In the event of a cancellation, the client receives no rights to any images, and the work may be repurposed at the artist's discretion. Repurposed work will not contain any of the client's characters or content.
Copyright
As the creator, the artist owns the copyright to all images created and transfers certain rights to the client. The simple language intents are as follows:
The artist retains the rights to reproduction and redistribution, such as for posting to online galleries and for advertising commission services, but not for other commercial uses, such as merchandising, without prior consent.
The artist grants the client the right to reproduction and redistribution for personal, noncommercial uses such as posting to online galleries or making personal prints.
The artist grants the client the right to issue takedown requests against third parties.
The artist grants the client the right to modify the work with significant cropping to create a user icon or avatar. The artist does not grant the client the right to modify the work in any other way without prior consent.
The artist does not grant the client the right to produce derivative works by any means, such as copying, tracing, vectorizing, recoloring, etc., without prior consent.
The artist does not claim rights to any character(s) depicted, and transfers any rights or licenses as necessary so that the intended owner(s) may use the character(s) in future works or commissions as they please. The intended owner(s) may be the artist, the client, or a third party depending on the commission.
The artist does not grant the client (or any other party) the right to use the work in any blockchain- or cryptocurrency-related activities, such as the creation of non-fungible tokens (NFTs). The artist grants the client the right to issue takedown requests against unauthorized NFTs.
The artist does not grant the client (or any other party) the right to use the work in any artificial intelligence (AI) related activities, such as the creation or training of algorithms.
