1. Scope of License

The Licensed Application is licensed to you by the Application Provider, not sold. The license is granted solely for personal, non-commercial use, subject to the terms of this agreement. If additional terms are provided in a separate license agreement, those will override this Privacy Policy.

a. Use of the Licensed Application: You are granted a non-exclusive, non-transferable, revocable license to install and use the Licensed Application on a device you own or control, such as an iPhone or iPod touch. The application must be used in accordance with the Usage Rules set out in Section 9.b. of the App Store Terms and Conditions. You are not permitted to install, use, or distribute the application on devices you do not own or control.

b. Restrictions: You may not rent, lease, sublicense, sell, or redistribute the application. Reverse-engineering, decompiling, disassembling, or modifying the application is prohibited unless specifically authorized by law or by the licensing terms of any open-source components.

c. Updates and Upgrades: Any updates, bug fixes, or new content provided by the Application Provider to supplement or replace the original Licensed Application will be subject to the terms of this Privacy Policy unless otherwise stated.

2. Consent to Use of Data

By using the Licensed Application, you consent to the collection and processing of certain technical data related to your device and usage. This information helps with updates, product support, and service delivery. The data is typically anonymized and used for improving the app and related services.

Note: The Application Provider does not collect, store, or track any personal content or data that you enter into the Licensed Application.

3. Termination of License

The license granted under this Privacy Policy remains in effect until terminated by either you or the Application Provider. The Application Provider may terminate the agreement if you fail to comply with the terms outlined in this policy. Upon termination, you must stop using the Licensed Application and remove it from your devices.

4. Third-Party Services and Materials

The Licensed Application may provide access to third-party services, websites, or content ("Third-Party Services"). These services may require an internet connection and may be subject to additional terms.

Location Data: Any location data provided is for basic navigation purposes only and should not be relied upon for critical decisions. The Application Provider makes no guarantees regarding the accuracy of location data.

Third-Party Content: The Application Provider is not responsible for any content or services provided by third parties, nor for any harm arising from using these services.

5. No Warranty

The Licensed Application is provided "as is" without any warranties of any kind. The Application Provider does not guarantee the app’s performance, quality, or accuracy. The provider disclaims all warranties, including implied warranties of merchantability or fitness for a particular purpose.

6. Limitation of Liability

To the fullest extent permitted by law, the Application Provider shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the app. This includes damages for data loss or business interruption.

The Application Provider’s total liability is limited to $50.00.

7. Export Control and Legal Compliance

You agree to comply with all applicable export laws and regulations, including U.S. embargoes and restrictions. By using the app, you represent that you are not located in any country subject to U.S. government embargo or on the restricted parties list.

8. U.S. Government Rights

If you are a U.S. government user, the app and related documentation are considered "Commercial Items" and are governed by the Federal Acquisition Regulation (FAR) and its supplements.

9. Governing Law

This Privacy Policy is governed by the laws of the State of California. Depending on your location, you may also be subject to additional local or international laws.

10. Changes to Privacy Policy

The Application Provider reserves the right to update or modify this Privacy Policy at any time. Any changes will be posted within the app or on the official website. Continued use of the Licensed Application after changes are posted will signify your acceptance of those changes.
