Terms of Use

The rules that govern your use of Cloud AI

TERMS OF USE

These Terms of Use ('Terms') constitute a legally binding agreement between you ('User', 'you', or 'your') and Cloud AI ('Cloud ', 'we', 'us', or 'our'), governing your access to and use of the Cloud AI application and related services ('Services').

By downloading, installing, or using Cloud AI, you confirm that you are at least 12 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher), have read these Terms, and agree to be bound by them.

If you do not agree to these Terms, do not use Cloud AI.

1. Description of Service

Cloud AI is an AI-powered creative studio for iOS that enables users to generate images, videos, audio, and written content from text prompts using third-party AI models. The Service includes free and paid subscription tiers.

2. Account Registration

• You may use Cloud AI as a guest without creating an account. Certain features (history, sync) require account creation.

• You must provide accurate information when creating an account.

• You are responsible for maintaining the confidentiality of your account credentials.

• You must notify us immediately if you suspect unauthorised access to your account.

• One account per person. Creating multiple accounts to circumvent usage limits is prohibited.

3. Subscriptions & Billing

3.1 Free Tier

Cloud AI offers a free tier with limited daily generations. Limits are subject to change with reasonable notice.

3.2 Paid Subscriptions

• Subscriptions are billed through Apple's App Store and subject to Apple's payment terms.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

• You may cancel at any time through iOS Settings > Apple ID > Subscriptions.

• We do not offer refunds for partial subscription periods, except where required by applicable law.

• We reserve the right to change subscription prices with at least 30 days' notice before the change applies to existing subscribers.

3.3 Free Trials

If we offer a free trial, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends.

4. Acceptable Use Policy

4.1 You May Use Cloud AI To:

• Generate images, videos, audio, and written content for personal or commercial purposes, subject to Section 6

• Use AI-generated outputs in your own projects, social media, marketing materials, and creative work

• Access the Service on any iOS device you own or control

4.2 You Must NOT Use Cloud AI To:

• Generate content that depicts sexual exploitation of minors (CSAM) — zero tolerance, will result in immediate account termination and reporting to law enforcement

• Create deepfakes of real people without their explicit consent

• Generate content intended to harass, defame, or threaten specific individuals

• Produce material that incites violence or hatred against any group

• Create disinformation intended to mislead the public about real events

• Generate content that infringes third-party intellectual property rights

• Attempt to circumvent our content moderation systems

• Reverse-engineer, decompile, or extract our AI models or algorithms

• Use the Service to train competing AI models

• Access the Service via automated scripts, bots, or programmatic means without our written permission

• Resell, redistribute, or sublicense access to the Service without authorisation

5. Content Moderation

We use automated and manual moderation to enforce our Acceptable Use Policy. We reserve the right to:

• Remove any generated content that violates these Terms or our content policies

• Suspend or terminate accounts that repeatedly violate these Terms

• Report illegal content to relevant law enforcement authorities

Moderation decisions are at our sole discretion. You may appeal a suspension by contacting us within 30 days.

6. Intellectual Property & Ownership

6.1 Your Content

Subject to these Terms, you retain ownership of the text prompts you submit. For AI-generated outputs created using your prompts:

• You are granted a worldwide, royalty-free licence to use, reproduce, distribute, and display the outputs for personal and commercial purposes.

• You acknowledge that identical or similar outputs may be generated for other users who submit similar prompts.

• We do not claim ownership of your generated outputs, but we retain a non-exclusive licence to use anonymised outputs for service improvement purposes.

6.2 Our Content

The Cloud AI name, logo, app design, interface, and all original content are owned by Cloud AI and protected by applicable intellectual property laws. You may not use our trademarks without our prior written consent.

6.3 Third-Party Content

AI-generated outputs may resemble existing works. We make no warranty that outputs are free from third-party intellectual property claims. You are solely responsible for evaluating whether your intended use of generated content complies with applicable law.

7. Disclaimers & Limitation of Liability

7.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) AI-generated content will be accurate, complete, or suitable for any particular purpose; (c) generated content will be free from intellectual property claims.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Cloud AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR ₹500 (FIVE HUNDRED INDIAN RUPEES), WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless Cloud AI, its officers, directors, employees, and affiliates from any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you generate and subsequently use or publish.

9. Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Cloud AI, you consent to our Privacy Policy.

10. Service Availability & Changes

• We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

• We may update features, change AI models, or adjust usage limits. Material changes to paid subscription features will be communicated with at least 14 days' notice.

• We are not liable for any disruption caused by circumstances beyond our reasonable control (force majeure).

11. Termination

We may suspend or terminate your account at any time if we believe you have violated these Terms. Upon termination:

• Your access to the Service will cease immediately

• Your generated content stored on our servers will be deleted within 30 days

• No refund will be issued for unused subscription periods unless required by law

You may terminate your account at any time by deleting it in-app (Settings > Account > Delete Account).

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India, with proceedings conducted in English in India.

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent irreparable harm.

13. Apple App Store Additional Terms

These Terms are between you and Cloud AI, not Apple Inc. Apple is not responsible for Cloud AI or its content. Apple has no obligation to provide maintenance or support for Cloud AI. Apple is not liable for any claims relating to Cloud AI.

In the event of a conflict between these Terms and Apple's App Store Terms and Conditions, Apple's terms shall prevail.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be notified via in-app notice at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
