# DogTrail Terms of Use

These Terms of Use (“Terms”) are an agreement between you and the developer identified on DogTrail’s App Store product page (“Developer,” “we,” “us,” or “our”) governing your use of DogTrail (“DogTrail” or “the App”).
By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
## 1. Eligibility
You must be legally capable of entering into these Terms under the laws that apply to you. If you are under the age at which you may enter into a binding agreement, you may use the App only with the permission and supervision of a parent or legal guardian.
A parent or legal guardian who permits a minor to use the App is responsible for the minor’s use of the App.
## 2. License to Use the App
Subject to these Terms and applicable App Store rules, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the App on Apple-branded devices that you own or control for personal, non-commercial entertainment.
The App is licensed, not sold. All rights not expressly granted to you are reserved by the Developer and its licensors.
Your use of the App is also subject to Apple’s applicable App Store terms, usage rules, and [Licensed Application End User License Agreement](https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If these Terms conflict with mandatory law or applicable App Store terms, those mandatory provisions will control to the extent of the conflict.
## 3. The DogTrail Service
DogTrail is a logic-puzzle game in which players place dogs and marks on a grid according to the displayed rules.
The App may include:
- campaign levels;
- Daily Challenges;
- hints;
- local preferences;
- iCloud game-progress synchronization; and
- optional sharing of Daily Challenge results.
We may improve, modify, add, suspend, or remove features when reasonably necessary. We do not guarantee that every feature will always be available on every device, operating-system version, language, or region.
## 4. User Responsibilities
You agree to:
- use the App lawfully and only for its intended purposes;
- follow applicable App Store terms;
- maintain the security of your device and Apple Account;
- avoid interfering with the App’s operation or security; and
- respect the intellectual-property and other rights of the Developer and third parties.
You must not:
- copy, redistribute, sell, rent, sublicense, or commercially exploit the App except where applicable law expressly permits it;
- reverse engineer, decompile, disassemble, derive source code from, modify, or create derivative works from the App except where such restrictions are prohibited by law or permitted by an applicable open-source license;
- bypass security, usage limits, game restrictions, or technical protections;
- introduce malicious code or use the App to harm devices, systems, or other people;
- falsely imply that you are affiliated with or endorsed by the Developer; or
- use the App in violation of applicable laws or regulations.
## 5. Accounts and Game Progress
DogTrail does not currently require a separate Developer account.
Your settings and campaign progress may be stored locally. If iCloud is available, your current campaign level may synchronize through the Apple Account signed in on your device. You are responsible for maintaining access to your device and Apple Account.
Synchronization may be delayed, unavailable, or affected by Apple services, network conditions, device settings, storage limits, software updates, or other circumstances outside our control. You should not rely on DogTrail as the sole storage location for important information.
## 6. Daily Challenges and Sharing
Daily Challenge availability may depend on the date, device settings, bundled game content, and the current App version.
If you choose to share a result, you are responsible for:
- reviewing the generated text before sharing;
- selecting the intended recipient or service;
- complying with the selected service’s terms; and
- ensuring that your shared content does not violate any law or third-party right.
The Developer does not control third-party apps or services shown in Apple’s system share sheet.
## 7. Purchases and Advertising
The current version of DogTrail does not include in-app purchases or third-party advertising.
If a future version introduces paid features, subscriptions, or advertising, applicable prices, billing terms, renewal terms, and any additional conditions will be presented before purchase or use, and these Terms and the Privacy Policy may be updated as required.
## 8. Intellectual Property
The App, including its software, game design, graphics, artwork, characters, interface, text, sounds, trademarks, logos, and other content, is owned by or licensed to the Developer and is protected by applicable intellectual-property laws.
Third-party software or assets included in the App remain subject to their respective licenses. Nothing in these Terms transfers ownership of the App or its content to you.
You may share screenshots or gameplay results for personal, non-commercial purposes, provided that you do not misrepresent ownership, remove legal notices, or imply sponsorship or endorsement.
## 9. Feedback
If you voluntarily send us suggestions, ideas, or feedback about the App, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use that feedback to improve or develop the App without an obligation to compensate you.
This provision does not transfer ownership of personal information contained in a support request, which is handled according to the Privacy Policy.
## 10. Third-Party Services
The App may interact with services provided by Apple or a service you select, including iCloud, the App Store, and apps available through the system share sheet.
Third-party services are governed by their own terms and privacy policies. We do not control and are not responsible for the availability, security, content, or practices of third-party services, except to the extent responsibility cannot be excluded under applicable law.
## 11. Updates, Availability, and Termination
We may release updates to maintain security, compatibility, gameplay quality, or legal compliance. Some updates may be required for continued use.
You may stop using the App at any time by uninstalling it.
We may suspend or terminate your license to use the App if you materially breach these Terms, misuse the App, or if continued availability is unlawful or no longer reasonably possible. Upon termination, you must stop using and delete the App, subject to any rights that survive under applicable law.
## 12. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the App is provided “as is” and “as available.” We do not guarantee that the App will:
- always be uninterrupted, secure, or error-free;
- work with every device, system version, or third-party service;
- preserve game progress in every circumstance; or
- meet every user’s expectations.
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded or limited.
## 13. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer and its licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, game progress, profits, goodwill, or use arising from or related to the App.
Where liability cannot be excluded, our liability will be limited only to the extent permitted by applicable law. Nothing in these Terms limits liability for fraud, willful misconduct, personal injury caused by negligence, or any other liability that cannot legally be limited.
## 14. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold the Developer harmless from claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the App or material breach of these Terms.
This section does not apply where prohibited by consumer-protection law.
## 15. Governing Law and Disputes
These Terms are governed by the laws applicable where the Developer is established, without regard to conflict-of-law principles, except that mandatory consumer-protection laws in your place of residence may still apply.
Before filing a formal claim, you and the Developer agree to make a reasonable effort to resolve the dispute informally by contacting the other party. If the dispute cannot be resolved, it will be submitted to a court with jurisdiction under applicable law.
Nothing in this section prevents either party from seeking urgent injunctive relief or using a consumer dispute process that cannot lawfully be waived.
## 16. Changes to These Terms
We may update these Terms to reflect changes to the App, applicable law, or our business practices. We will update the “Last updated” date and provide additional notice when required by law.
If a change materially affects your rights, it will apply prospectively from the stated effective date. Your continued use of the App after the updated Terms take effect constitutes acceptance to the extent permitted by law.
## 17. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the affected provision will be interpreted or modified only as necessary to make it enforceable.
Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or transfer of the App, subject to applicable law.
These Terms, the DogTrail Privacy Policy, and applicable App Store terms constitute the agreement governing your use of the App.
