These Terms and Conditions govern your access to and use of the Decision Mapping Tool (DMAT) provided by King’s College London. By using DMAT, you agree to abide by these Terms and Conditions.
1) Permission to use DMAT
a) Your permission to use DMAT is granted under the terms and conditions of Creative Commons licence CC BY-SA 4.0.
b) This licence governs, amongst other things:
· your right to share and adapt DMAT
· your obligation to give appropriate credit to King’s College London

d) Except as set out in the Creative Commons licence, you are not permitted to use King’s College London’s name, crest, logo or trademarks, or the name of any of its staff or students, nor imply their identity, without the express written permission of King’s College London or that individual.
2) Additional Conditions for using DMAT
In addition to the Creative Commons licence terms and conditions, when using DMAT you must also abide by the terms and conditions set out below (the Additional Conditions). If there is a conflict or difference between the Additional Conditions and the Creative Commons licence terms, the Additional Conditions will take precedence.
3) Risk and Liability
a) Your use of DMAT is entirely voluntary and at your own risk.
b) You recognise that DMAT may contain experimental materials, data or processes whose properties and safety may not have been established. Therefore, King’s College London does not guarantee that DMAT will provide specific results or provide data which can be used for a particular purpose.
c) King’s College London is not responsible for the consequences or effects of any use to which you or anyone else may put DMAT, except where this is due to the proven negligence or default of King’s College London or its employees, students, representatives, consultants or agents.
d) By using DMAT, you agree to indemnify King’s College London, including its employees, students, representatives, consultants or agents, against all losses, damages, claims, proceedings, penalties, fines, including statutory fines and liabilities that arise from a third-party claim connected to your use of DMAT.
e) This includes, but is not limited to, financial losses, damages, reasonable legal costs and other reasonable expenses of any nature whatsoever, whether criminal or civil, in contract, tort or otherwise and other liability of whatsoever kind or nature awarded against or incurred or paid by King’s College London.
f) This indemnity does not apply where such action or claim is due to the negligence or wilful misconduct of King’s College London or its employees, students, representatives, consultants or agents.
a) You undertake to make no claim in connection to your use of DMAT against any employees, students, agents or appointees of King’s College London, apart from claims based on fraud or wilful misconduct.
b) Nothing in these Additional Conditions limits or excludes the liability of either you or King’s College London for death or personal injury, any fraud or for any sort of liability that by law cannot be limited or excluded, or any loss or damage caused by a deliberate breach of these Additional Conditions.
2) Data Protection
You are solely responsible for your compliance with data protection legislation, including but not limited to the Data Protection Act 2018 and the UK General Data Protection Regulation, in respect of any personal data you may process in relation to your use of DMAT.
3) Governing Law
These Additional Conditions are made and shall be interpreted in accordance with the law of England and Wales, and subject to the exclusive jurisdiction of the English Courts sitting in England.
4) Changes to Terms and Conditions
King’s College London may change these Terms and Conditions at any time.
