Warranty Terms and Conditions
Effective Date: 29th January, 2025
1. Definitions
The following terms are used throughout these Warranty Terms and Conditions:
Customer: The original purchaser of the product from Digital Ocean Solutions.
Product: Any item sold by Digital Ocean Solutions covered under this warranty.
Warranty Period: The one (1)-year period starting from the date of invoice.
Defect: Any fault in materials or workmanship that causes the Product to fail under normal use conditions during the Warranty Period.
Exclusions: Circumstances or conditions under which the Warranty does not apply (see Section 2).
2. Warranty Coverage
2.1. Digital Ocean Solutions ("Company") provides a limited warranty for Products sold directly by the Company. This Warranty is valid for a period of one (1) year from the date of invoice.
2.2. This Warranty covers Defects in materials and workmanship under normal use and conditions.
2.3. This Warranty supersedes any manufacturer’s warranty, express or implied, provided by the original equipment manufacturer (OEM) or any third-party manufacturer.
3. Warranty Activation
3.1. To activate this Warranty, the Customer must retain proof of purchase, such as an invoice or receipt, as it will be required for any Warranty claims.
4. Warranty Claims
4.1. To make a Warranty claim, the Customer must report the Defect to the Company within seven (7) working days of discovering the issue.
4.2. The Customer must provide the following:
a. Proof of purchase (e.g., invoice or receipt).
b. Details of the issue, including any supporting evidence (e.g., photos or videos).
4.3. The Customer must cooperate with the Company’s troubleshooting instructions, which may include returning the Product for examination.
5. Warranty Remedy
5.1. If a Product is found to be defective within the one (1)-year Warranty Period and the issue is not covered by the Exclusions in Section 2, the Company will, at its discretion:
a. Repair the Product using new or refurbished parts, or
b. Replace the Product with a new or refurbished unit of equal or greater functionality.
5.2. The Warranty obligation is limited to the repair or replacement of the defective Product.
6. Software and Data Disclaimer
6.1. The Company is not responsible for software or data loss. Customers are advised to back up all data before returning the Product for service.
6.2. The Company is not responsible for restoring or recovering data lost during the repair or replacement of the Product.
7. Out-of-Warranty Services
7.1. For Products outside the Warranty Period, repair services may be provided at the Customer’s expense. Quotes for repair costs will be provided upon request.
7.2. Any repairs done outside the Warranty Period will be charged separately, and the Customer will be informed of the cost before proceeding.
8. Transferability
8.1. This Warranty is non-transferable and applies only to the original purchaser.
9. Warranty Voidance
9.1. This Warranty will be void if the Product:
a. Has been repaired, modified, or tampered with by an unauthorized service provider.
b. Has been used in a manner inconsistent with the instructions provided in the user manual.
c. Shows evidence of misuse, abuse, or negligence by the Customer.
10. Exclusions
This Warranty does not cover:
10.1. Consumables:
a. Batteries, inks, toners, cables, adapters, and other consumable items.
10.2. Electrical Damage:
a. Damage caused by power surges, voltage fluctuations, or electrical issues resulting from improper wiring or inadequate electrical infrastructure.
10.3. Environmental Damage:
a. Damage caused by exposure to moisture, extreme temperatures, direct sunlight, dust, or other environmental factors.
10.4. Improper Use:
a. Damage caused by using the Product for purposes other than its intended function (e.g., commercial or industrial use of a product meant for personal use).
b. Damage caused by overclocking, unauthorized modifications, or using unapproved software or firmware.
10.5. Transportation and Shipping:
a. Damage occurring during transportation or shipping if the Product is returned to the Company without proper packaging or protection.
10.6. Third-Party Actions:
a. Damage caused by third-party services, repairs, or modifications not authorized by the Company.
b. Damage resulting from the use of third-party accessories, components, or software not approved by the Company.
10.7. Installation Issues:
a. Defects or damage caused by incorrect installation or assembly by the Customer or an unauthorized third party.
10.8. Cosmetic Damage:
a. Scratches, dents, discoloration, or other cosmetic issues that do not affect the Product's functionality.
10.9. Negligence or Abuse:
a. Damage resulting from negligence, improper handling, or deliberate abuse.
b. Issues caused by failure to follow maintenance instructions or user manual guidelines.
10.10. Acts of Nature and Force Majeure:
a. Any damage or loss resulting from natural disasters (e.g., floods, earthquakes, hurricanes) or other uncontrollable events such as fire, theft, war, or riots.
10.11. Software and Data Issues:
a. Any issues related to software compatibility, viruses, malware, or corrupted data.
b. Data loss during service or repairs.
10.12. Obsolete or Discontinued Products:
a. Warranty claims for Products that have been discontinued or declared obsolete by the manufacturer, where repair parts are no longer available.
10.13. Normal Wear and Tear:
a. Gradual wear and tear of mechanical components due to regular use, including keys, hinges, buttons, and connectors.
10.14. Non-Operational Conditions:
a. Claims arising from subjective concerns (e.g., “I don’t like the product”) or perceived issues that do not affect the product’s intended operation (e.g., noise levels or aesthetic preferences).
11. Geographic Limitations
11.1. This Warranty is valid only for Products purchased and used within Zambia.
12. Preventative Maintenance Disclaimer
12.1. This Warranty does not cover costs related to routine maintenance, preventative care, or inspections.
13. Customer Responsibilities
13.1. To maintain Warranty eligibility, the Customer must:
a. Follow all care and usage instructions provided in the Product manual.
b. Use only authorized accessories and components with the Product.
c. Avoid any actions that void the Warranty as described in Section 9 and 10.
14. Limitation of Liability
14.1. The Company’s liability under this Warranty is limited to the repair or replacement of the Product. Digital Ocean Solutions shall not be liable for indirect, incidental, or consequential damages, including but not limited to loss of data, business, or profits.
15. Governing Law
15.1. This Warranty shall be governed by and construed in accordance with the laws of Zambia. Any disputes arising under or in connection with this Warranty shall be subject to the exclusive jurisdiction of the courts in Zambia.
16. Warranty Policy Changes
16.1. The Company reserves the right to modify, update, or discontinue this warranty policy at any time without prior notice.
16.2. Any changes to the warranty policy will not create any liability for the Company towards past or future purchases.
