1. Acceptance of Terms
By downloading, installing, or using Digi Logbook ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a binding legal agreement between you ("User") and the developers of Digi Logbook ("we" or "us").
2. User Eligibility & Professional Use
2.1. Medical Professionals Only: The App is intended solely for use by licensed physicians, surgeons, residents, medical students, and healthcare trainees. 2.2. Not a Medical Device: The App is a documentation tool. It is not a certified Electronic Health Record (EHR) and is not intended to be the primary legal record of patient care. 2.3. No Medical Advice: The App does not provide medical advice, diagnosis, or treatment. You agree that any clinical decisions made are your sole responsibility as a licensed professional.
3. Data Privacy & Patient Anonymity (Crucial)
3.1. Data Controller: You acknowledge that You are the Data Controller of all clinical data entered into the App. We act solely as the Data Processor providing the infrastructure. 3.2. Strict Anonymization: You explicitly agree NOT to enter Direct Patient Identifiers into any free-text field, title, or note. Prohibited identifiers include, but are not limited to:
Patient Names
Full Dates of Birth (Age is permitted)
Phone Numbers / Emails
Social Security / Aadhaar / National ID Numbers 3.3. Image Redaction: You warrant that any image uploaded to the App has been redacted/masked to remove faces, tattoos, wristbands, or any other features that could identify a patient. 3.4. Liability: You agree to indemnify and hold us harmless from any claims, fines, or damages arising from your failure to anonymize patient data in compliance with local laws (e.g., HIPAA, GDPR, DISHA).
4. Subscriptions & Payments
4.1. Pro Features: Certain features (e.g., Unlimited Logs, Cloud Backup, Dark Mode) require a "Pro" subscription or One-Time Purchase. 4.2. Payment Processing: All payments are processed by Google Play. We do not store your credit card details. 4.3. Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period via your Google Play Account settings. 4.4. Refunds: Refund requests are governed by Google Play’s Refund Policy. We do not issue direct refunds.
5. Backups, Exports, and Data Loss
5.1. Encrypted Backups: The App offers an encrypted backup feature. If you set a password for your backup and subsequently lose or forget it, we cannot recover your data. We do not store your backup password. 5.2. Exported Files: The App allows you to export data to PDF, CSV, or ZIP formats. Once a file is exported from the App to your device storage or shared via external means (email, messaging), it leaves our secure environment. You assume full responsibility for the security and privacy of these exported files. 5.3. No Warranty on Data: While we use Google Firebase for cloud storage, we do not guarantee that data will never be lost, corrupted, or inadvertently deleted. You are responsible for maintaining your own local backups.
6. User Conduct
You agree not to:
Use the App for any illegal purpose.
Reverse engineer, decompile, or attempt to extract the source code of the App.
Share your account credentials with others.
7. Limitation of Liability
To the maximum extent permitted by law, Digi Logbook and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Your access to or use of or inability to access or use the App;
Any conduct or content of any third party on the App;
Unauthorized access, use, or alteration of your transmissions or content.
In no event shall our total liability exceed the amount you paid to us, if any, for using the App.
8. Termination
We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms (e.g., uploading non-anonymized patient data).
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
