2. Scope
These General Terms and Conditions (GTC) apply to all business relationships between you (hereinafter "user") and Benjamin Schlee (hereinafter "provider")
that are processed via the app. The GTC apply in the version valid at the time of the order.
3. Subject of the contract
The subject of the contract is the purchase of digital products (e.g. digital content, in-app purchases) in the Apple App Store and Google Play Store.
These digital products are not physical in nature and are made available to the user digitally after successful payment.
The app itself can be downloaded and installed free of charge. The app is financed through in-app purchases.
4. Provision of digital products
-The essential features of the digital products are included in the product description within the app.
-The digital products are provided immediately after payment has been made.
-In the event of technical problems in the app, in the Google Play Store or in the Apple App Store, there may be delays because the purchase cannot be verified.
Please write the provider an email so that the provider can possibly solve the problem with an update or use the option of a refund.
-If you reinstall or update the app, all of your purchases in the Google Play Store or Apple App Store must be verified again so that the purchased digital products are available to you.
To do this, use the "Restore purchases" button in the app.
-Products purchased in the Apple App Store are only available on iOS devices.
These products can only be used on compatible devices with the iOS operating system.
-Products purchased in the Google Play Store are only available on Android devices with the Google Play Store installed.
These products can only be used on compatible devices with the Google Android operating system.
-Access to the purchased products is tied to the respective operating system and use on another operating system is not possible.
Make sure that you use the appropriate devices and operating systems to access your purchased products.
-If you switch from one operating system to another operating system, you must purchase the digital products again for that operating system.
5. Warranty
The warranty period is 24 months from the date of provision.
6. Invoicing and sales tax
-Digital products are sold via third-party platforms such as the Google Play Store and the Apple App Store.
-These platforms are responsible for invoicing users.
-For sales of digital products to private customers within the EU, VAT is collected and paid in accordance with the regulations of the respective EU country.
This is done via the respective third-party platforms on which the products are offered.
-All prices stated in the shop are gross prices including statutory sales tax.
-All prices stated in the shop include the Apple App Store and Google Play Store platform fee of 15% to 30%.
-The price stated in the shop is the final price, there are no additional fees for the user.
7. Liability for defects
You have the right to complain to the provider if there are defects in the digital product.
The provider then has the option of correcting the defects with an update.
If the defects are not corrected, you have the right to have the purchase price refunded.
8. Payment processing in the Google Play Store
All payments for in-app purchases are processed exclusively via the Google Play Store.
The provider never has access to your bank or payment details.

9. Payment processing in the Apple App Store
All payments for in-app purchases are processed exclusively through the Apple App Store.
The provider does not have access to your bank or payment details at any time.

10. Refunds for purchases in the Google Play Store
-Refunds for in-app purchases are subject to the guidelines of the Google Play Store.

12. Disclaimer of liability
-Liability for damages is excluded unless the damage is due to intentional or grossly negligent behavior on the part of the provider.
-Liability for property damage and financial losses caused by slight negligence is excluded.
-The provider is not liable for damages caused by improper use of the app.
-The app is constantly being developed, so it may happen that created dice files or created game files can no longer be read due to an update to the app or due to a programming error. No liability is accepted for the loss of files created by the user and the time invested.
-The provider assumes no liability for costs or fees that may arise from the use of mobile data or other internet connections.
-No liability is accepted for damages caused if the app only works incorrectly or not at all for a certain period of time.
-The provider of the app will never ask you for your bank or access data. If you disclose such data, the provider of the app assumes no liability for this.
-Do not send any personal data to the provider of the app. No liability is accepted for any damage caused as a result.
13. Obligations of the user
-A permanent, fast and stable internet connection is required to use the app and in-app purchases.
-The user is obliged to always install the latest updates to the operating system and the app.
-The digitally purchased products may not be modified, resold, copied or used outside of the app.
14. Safety and usage instructions
-Always keep an eye on your surroundings when using the app.
-Do not use the app while you are moving.
-When swiping on the screen, be careful not to hit people or objects.
15. License of use
-The app is provided to you as the end user under the condition of a non-exclusive, non-transferable and non-sublicensable license for use on your devices.
-It is not permitted to use the app for, e.g., dares that could cause harm to people or objects.
15.1 Commercial use of the app for individuals
-Individuals are permitted to use the app for commercial purposes, for example on social media or as an influencer.
-Commercial use of the app in companies with only one employee is permitted.
15.2 Commercial use in companies
-Installing the app on company devices is automatically considered commercial use.
-If you want to use the app for commercial purposes in your company and your company has more than one employee, the following applies:
-Buy "Dice Set 1" in the shop for each device on which the app is installed.
-If you do not comply with this point, uninstall the app from all devices within 48 hours.
-You do not need to wait for a response and can use the app immediately for commercial purposes.
16. Changes to the terms and conditions
The provider reserves the right to change these terms and conditions at any time.
17. Final provisions
If individual provisions of these terms and conditions are or become invalid, the validity of the remaining provisions remains unaffected.
The provision that is completely or partially invalid should be replaced by a provision whose economic success comes as close as possible to that of the invalid one.
