Welcome to Embric (“App”, “Service”), owned and operated by Devion Tech (“we”, “us”, or “our”).

By downloading, installing, or using Embric, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the application.

1. Acceptance of Terms

By creating an account, accessing, or using Embric, you confirm that:

1. You are at least 18 years old or possess legal parental/guardian consent.

2. You agree to comply with all applicable local, national, and international laws and regulations.

3. You have read and understood our Privacy Policy.

2. User Accounts & Registration

• Account Creation: To access features such as saving and synchronizing embroidery designs, you are required to register with a valid mobile number, your name, and a password.

• Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

• Accuracy of Information: You agree to provide accurate and truthful information during registration.

3. Permitted Use & App Services

Embric provides embroidery cost estimation and file analysis tools, including:

• DST File Viewer: Rendering and analyzing stitches, dimensions, and color stops from DST embroidery files.

• Garment Cost Calculators: Calculating estimated costs for Saree, Suit, and Allover machine repeats based on user inputs.

• Bead Cost Analysis: Estimating embellishment and bead material costs.

• Design Cloud Storage: Securely storing design records, calculations, and uploaded design artwork.

We grant you a personal, non-exclusive, non-transferable, and revocable license to use the App for personal or business embroidery calculation purposes.

4. Calculation & Valuation Disclaimer

• Estimations Only: All cost calculations, stitch totals, piece rates, and valuations generated by Embric are estimates based solely on the data (stitch rates, head counts, stitches, add-on values) provided by you.

• No Financial or Manufacturing Guarantee: Actual factory production costs, thread usage, fabric behavior, machine efficiency, and wage rates may vary. Devion Tech does not guarantee commercial profits, nor are we liable for discrepancies in your independent commercial quotations or production billing.

5. Intellectual Property Rights

• Our Content: The Embric app, including but not limited to its interface design, logos, graphics, icons, software, and calculation algorithms, is the intellectual property of Devion Tech and is protected by copyright and intellectual property laws.

• Your Content: You retain full ownership and copyright of your embroidery artwork, design photos, and custom specifications that you upload to the App. By uploading, you grant Embric a limited license to store, process, and display your images strictly for your own account functionality.

6. Prohibited Conduct

When using Embric, you agree NOT to:

1. Reverse-engineer, decompile, disassemble, or extract the source code of the App.

2. Upload unlawful, abusive, infringing, or harmful content or images.

3. Interfere with, tamper with, or disrupt the security or servers of the App.

4. Attempt to bypass authentication or gain unauthorized access to other users' accounts or data.

5. Use automated bots, scrapers, or software to extract data from our service.

7. Third-Party Services and Advertisements

• Advertisements: Embric is ad-supported and displays advertisements provided by Google AdMob and Meta Audience Network. Your interaction with third-party advertisements is governed by the terms and policies of those advertising partners.

• Cloud Infrastructure: We utilize third-party cloud infrastructure (such as Cloudflare R2 and Firebase) to store data and transmit notifications. While we choose industry-leading providers, we are not liable for third-party server downtimes beyond our reasonable control.

8. Termination & Account Deletion

• We reserve the right to suspend or terminate your account access without notice if you violate these Terms or engage in fraudulent activity.

• You may stop using the App at any time. You can delete individual designs directly within the App or contact us to request full account deletion.

9. Disclaimer of Warranties

Embric is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will always be uninterrupted, error-free, or free of bugs.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Devion Tech and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or production losses resulting from:

• Your access to or inability to use the App.

• Any calculation decisions, quotations, or agreements made based on numbers generated by the App.

• Unauthorized access to or alteration of your transmissions or data.

11. Modifications to These Terms

We reserve the right to revise or update these Terms and Conditions at any time. Continued use of the App after any modifications constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
