Terms of Use

Short rules for a simple app.

1. Agreement

These Terms are an agreement between you and Gurbeer Kaur, an individual developer based in India, covering the Descripted iOS app.

BY USING DESCRIPTED YOU ACCEPT THESE TERMS

If you do not accept them, please do not use the app.

2. The app

Descripted lets you record or import video and audio, generates a transcript on your device, and lets you edit the media by editing that transcript. It also offers on-device noise reduction, filler-word removal, captioning and export.

Features may be added, changed or removed as the app develops.

3. Age

You must be at least 13 to use Descripted, or 16 if you are in the EEA or the UK. If you are under the age of majority where you live, use the app only with a parent or guardian who accepts these Terms.

4. Your content

You own everything you create. Your videos, audio, transcripts and exports are yours entirely.

Because Descripted processes everything on your device and uploads nothing, no licence to your content is needed and none is taken. I have no access to your files, no copy of them, and no ability to view, use or recover them.

What you are responsible for

• Having the rights to whatever you record or import

• Any consent needed from people appearing or speaking in your recordings

• Ensuring your content and its use are lawful where you are

• Keeping your own backups. Descripted is an editing tool, not an archive. If you delete a project or lose your device, the content is not recoverable.

5. Subscriptions

Descripted is free to download. Some features require a paid subscription. Prices are shown in the app before purchase and vary by region.

Apple handles all payments through your Apple Account. Subscriptions renew automatically unless auto-renew is switched off at least 24 hours before the current period ends. If a free trial is offered and you do not cancel at least 24 hours before it ends, the subscription begins.

CANCEL IN iOS SETTINGS

Settings → your name → Subscriptions. I cannot cancel a subscription for you.

Refunds are handled by Apple at reportaproblem.apple.com. I have no ability to issue them. Any statutory refund right you have under local consumer law is unaffected.

6. Acceptable use

Do not use Descripted to:

• create or edit anything unlawful where you are;

• produce content that sexualises minors, or non-consensual intimate imagery;

• impersonate someone, or produce material designed to deceive or defraud;

• infringe anyone's copyright, trademark, privacy or publicity rights;

• reverse engineer, decompile or tamper with the app, except where that restriction is void by law;

• circumvent subscription checks or other technical limits.

7. AI-generated output

Transcripts, captions and filler-word detection are produced by machine learning and are provided as-is.

• Accuracy is not guaranteed. Errors are common with accents, overlapping speech, technical vocabulary and background noise.

• Review before you rely on it. Do not use output for legal, medical, financial or safety-critical purposes without checking it yourself.

• Captions and accessibility. Auto-generated captions may not meet legal accessibility standards. If you are subject to those obligations, review and correct captions before publishing.

8. Ownership

The app itself — its software, design, illustrations and interface — belongs to Gurbeer Kaur. Using Descripted gives you a personal, limited, non-transferable, revocable licence to install and use it on Apple devices you own or control, as permitted by Apple's Usage Rules.

"Descripted" and its logo are marks of Gurbeer Kaur. Please do not use them without permission.

Any feedback you send is voluntary and may be used freely without obligation.

9. Disclaimers

To the maximum extent permitted by law, Descripted is provided "as is" and "as available", without warranties of any kind — express or implied — including merchantability, fitness for a particular purpose, accuracy, or uninterrupted or error-free operation.

I do not warrant that the app will meet your requirements, that output will be accurate, or that every defect will be fixed.

YOUR STATUTORY RIGHTS STAND

Nothing here removes any right or remedy that cannot lawfully be excluded, including consumer guarantees under the law where you live.

10. Limitation of liability

To the maximum extent permitted by law:

1. Gurbeer Kaur is not liable for indirect, incidental, special or consequential damages, nor for lost profits, lost data or lost content.

2. Total liability is limited to the greater of what you paid for Descripted in the 12 months before the claim, or USD 100 (or local equivalent).

3. These limits do not apply to death or personal injury caused by negligence, to fraud, or to any liability that cannot lawfully be limited.

Some places do not allow certain exclusions; there, the above applies only as far as permitted.

11. Termination

You may stop using Descripted at any time by deleting the app. Cancel any subscription separately through Apple — deleting the app does not stop billing.

I may suspend access if these Terms are materially breached or if required by law. Sections 4, 7, 8, 9, 10 and 13 survive termination.

12. Governing law

These Terms are governed by the laws of India. Subject to the paragraph below, the courts at [City] have jurisdiction.

CONSUMERS KEEP THEIR LOCAL RIGHTS

If you are a consumer somewhere whose law lets you bring proceedings locally and protects you under local mandatory consumer law, nothing here removes that. EU consumers may also use ec.europa.eu/consumers/odr.

13. Apple-specific terms

Apple requires the following to be stated. You and I acknowledge:

1. Not a party. These Terms are between you and Gurbeer Kaur only, not with Apple. Apple is not responsible for Descripted or its content.

2. Scope of licence. The licence in section 8 is limited to Apple-branded products you own or control, per the Usage Rules in Apple's Media Services Terms and Conditions.

3. Maintenance and support. Gurbeer Kaur is solely responsible. Apple has no obligation to provide any maintenance or support.

4. Warranty. Gurbeer Kaur is solely responsible for any product warranties not effectively disclaimed. If Descripted fails to conform to an applicable warranty you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs or expenses attributable to a warranty failure are Gurbeer Kaur's sole responsibility.

5. Product claims. Gurbeer Kaur, not Apple, is responsible for addressing any claim relating to Descripted or your use of it — including product liability, failure to conform to a legal or regulatory requirement, and claims under consumer protection or privacy legislation.

6. Intellectual property claims. On any third-party claim that Descripted infringes intellectual property rights, Gurbeer Kaur — not Apple — is solely responsible for the investigation, defence, settlement and discharge of that claim.

7. Legal compliance. You confirm you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and are not on any U.S. Government list of prohibited or restricted parties.

8. Third-party terms. You must comply with applicable third-party terms when using Descripted.

9. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you as such.

14. General

Entire agreement. These Terms and the Privacy Policy are the whole agreement about Descripted.

Changes. These Terms may be updated. Material changes will be announced in the app before taking effect. Continued use afterwards means acceptance.

Severability. If part of these Terms is unenforceable, the rest still applies.

No waiver. Not enforcing something once does not waive it.

Language. Written in English; any translation is for convenience only.
