1. Terms & Conditions

   1. Acceptance of Terms
   By downloading, accessing, or using the Dermasense mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
   2. Description of Service
   Dermasense is a skin tracking and analysis application designed to help users monitor their skin conditions, identify potential triggers, and maintain a health journal. The App provides:

   • Symptom and condition logging

   • Pattern analysis and correlation insights

   • AI-powered suggestions (Pro feature)

   • PDF report generation for healthcare providers (Pro feature)

   • Tracking history and data visualization

2. 3. Medical Disclaimer
   IMPORTANT: Dermasense is NOT a medical device and does not provide medical advice, diagnosis, or treatment.

   • The App is designed solely as a tracking and journaling tool

   • Information provided by the App should not be used to make medical decisions

   • Always consult with a qualified healthcare professional for medical advice

   • The App does not replace professional medical care or examination

   • In case of medical emergency, contact emergency services immediately

3. 4. User Accounts

   • You must provide accurate and complete information when creating an account

   • You are responsible for maintaining the confidentiality of your account credentials

   • You are responsible for all activities that occur under your account

   • You must notify us immediately of any unauthorized use of your account

4. 5. Subscription Terms
   5.1 Free Tier

   • Access to basic tracking features

   • 7-day history access limitation

5. 5.2 Pro Subscription

   • Monthly or yearly subscription options

   • 7-day free trial for new subscribers

   • Automatic renewal unless cancelled

   • Access to all premium features including unlimited history, custom tracking and insights

   • If a payment fails, access may be suspended until payment is successful.

6. 5.3 Payment & Billing

   • Subscriptions are billed through your Apple App Store account

   • Payment is charged at confirmation of purchase

   • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period

   • Your account will be charged for renewal within 24 hours prior to the end of the current period

   • You can manage or cancel your subscription in your App Store account settings

7. 5.4 Cancellation & Refunds

   • You may cancel your subscription at any time through your App Store account

   • Cancellation takes effect at the end of the current billing period

   • Any unused portion of a free trial period will be forfeited when a subscription is purchased

   • No refunds for partial subscription periods

   • Refund requests are subject to Apple's refund policy

8. 6. User Content & Data
   6.1 Your Data

   • You retain ownership of all data you input into the App

   • You grant us a license to process and store your data to provide the service

   • We use your data only as described in our Privacy Policy

9. 6.2 Data Accuracy

   • You are responsible for the accuracy of information you enter

   • We are not liable for any consequences resulting from inaccurate data entry

10. 6.3 Data Backup

    • While we maintain regular backups, you are responsible for maintaining your own copies of important data

    • We recommend regularly exporting your data using the PDF export feature

11. 7. Prohibited Uses
    You agree NOT to:

    • Use the App for any illegal purpose

    • Attempt to gain unauthorized access to our systems

    • Reverse engineer, decompile, or disassemble the App

    • Use the App to transmit malware or harmful code

    • Impersonate another person or entity

    • Share your account credentials with others

    • Use the App in any way that could damage, disable, or impair our service

12. 8. Intellectual Property

    • The App and all content, features, and functionality are owned by Dermasense

    • Our trademarks, logos, and service marks are our property

    • You may not use our intellectual property without prior written permission

13. 9. Third-Party Services
    The App may integrate with third-party services (e.g., Apple Health, cloud storage). Your use of these services is subject to their respective terms and conditions.
    10. Limitation of Liability
    TO THE MAXIMUM EXTENT PERMITTED BY LAW:

    • THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND

    • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES

    • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SUBSCRIPTION IN THE PAST 12 MONTHS

    • WE ARE NOT LIABLE FOR ANY HEALTH OUTCOMES OR MEDICAL DECISIONS MADE BASED ON APP DATA

14. 11. Indemnification
    You agree to indemnify and hold harmless Dermasense from any claims, damages, or expenses arising from:

    • Your use of the App

    • Your violation of these Terms

    • Your violation of any rights of another party

15. 12. Privacy
    Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
    13. Changes to Terms

    • We reserve the right to modify these Terms at any time

    • We will notify you of material changes via the App or email

    • Continued use of the App after changes constitutes acceptance of new Terms

    • If you do not agree to changes, you must stop using the App

16. 14. Termination

    • We may terminate or suspend your access immediately, without notice, for any violation of these Terms

    • Upon termination, your right to use the App ceases immediately

    • You may terminate your account at any time by deleting the App and cancelling your subscription

17. 15. Governing Law
    These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law provisions.
    16. Dispute Resolution
    Any disputes arising from these Terms or use of the App shall be resolved through:

    • Good faith negotiation

    • Binding arbitration (if negotiation fails)

    • Small claims court (for eligible claims)

    If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
    18. Entire Agreement
    These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dermasense regarding the App.

    By using Dermasense, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

    • Fill in your actual jurisdiction

    • Adjust liability limitations based on your local laws

20: Apple Required Terms

• Acknowledgment: Explicitly state that the agreement is between you and the User, and not with Apple. You (Dermasense) are solely responsible for the app.

• Maintenance & Support: State that Apple has no obligation whatsoever to furnish any maintenance and support services for the app.

• Warranty: State that in the event of any failure of the app to conform to any applicable warranty, the user may notify Apple, and Apple will refund the purchase price—but to the maximum extent permitted by law, Apple will have no other warranty obligation.

• Third-Party Beneficiary: You must state that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon the user’s acceptance, Apple will have the right to enforce them against the user.
