FDA Issues Warning Letters to Companies Illegally Selling CBD and Delta-8 THC Products

Today, the U.S Food and Drug Administration issued a letter of warning to five companies for selling mislabeled products containing delta-8 tetrahydrocannibinol (delta-9 THC), commonly known as delta-8 THC. These products are marketed as dietary supplements or food products, such as gummies, oil capsules, beverages, and tinctures.

The FDA has been investigating several complaints regarding products marketed online that contain delta-8 THC and have been found to be misbranded under section 403(a)(1) of the FD&C Act. In addition, one complaint alleges that some of these products are adulterated under section 402(f)(2) of the FD& C Act because they fail to bear adequate directions for use.

These products are illegal to sell without prior approval from the FDA.

OK, what is legal right now?

In Texas, it is still illegal to use and/or possess marijuana. In fact, it has been illegal since 1931. But what about hemp? Is it legal? Well, according to the Texas Agriculture Code, yes. And while you might think that makes things easy, there is actually some confusion over just how much hemp is allowed.

What Changed in 2019?

The federal government legalized industrial hemp in December 2018. Then, in February, Texas passed legislation allowing farmers to grow hemp legally.

Now, CBD products are being manufactured and sold across the state. Manufacturing, however, is another story. There are several regulations surrounding the production and sale of hemp products. For example, no one can sell raw materials like seeds, stems, leaves, flowers, or roots without having a permit. This means that people cannot make CBD oil out of plants grown in their backyard. They must purchase the plant material from licensed suppliers.

How Can I Tell If Something Is Legal?

This is where it gets tricky. You see, even though hemp is legal, manufacturing isn't. So, you could technically buy hemp seeds, plant them, and harvest the resulting product. However, it wouldn't be legal to process the plant into a usable form. Only the raw material is legal.
