Concerned About Kratom & Botanical Restrictions?
We encourage community members to respectfully contact the City regarding proposed restrictions on kratom and other botanicals. Share your personal experience, why safe retail access matters to you, and why decisions should be based on research, education, and understanding of how botanical retail businesses actually operate — not assumptions or broad food-service regulations.

The Environmental Health Department hereby gives notice that the Environmental Health Department will conduct a public hearing on Thursday, May 21 2026 from 9:00 a.m. to 12:00 p.m. on the rule described below.
The purpose of this meeting is to obtain public input on the proposed amendments to the Regulation 2024 Rules of the City of Albuquerque Food Service and Retail Ordinance. The Regulation accompanies the Food Service and Retail Ordinance §9-6-1. The Amendments address:
Incorporation of the permit classification “Micro-Market” to facilitate and support the ABQ Fresh initiative;
Correct grammar and formatting issues throughout the document to create clarity and/or consistency throughout the document and other City ordinances;
Adjust protocols for the issuance of permits to allow for a smoother process;
Clarify regulations related to allergen warnings, temperature holding, date marking, and food transportation;
Include language specific to the prohibition of Kratom and other non “Generally Recognized as Safe” ingredients;
Include clarifying language on Cannabis Permits;
Include clarifying language on grade stickers; and
Add in language to address advanced vending machines.
The public hearing allows members of the public an opportunity to submit testimony and arguments on the Regulation. The public hearing will be held on Thursday, May 21, 2026 from 9:00 a.m. to 12:00 p.m, - NEXT HEARING JUNE 1ST , 1:30P - THE CITY WILL POST ANOTHER MEETING - MENTIONED IN JULY - CITY NEWS
