Introduction

These terms and conditions govern your use of our Discord servers (the "Servers" or "Discords") provided by DC Global (the "Company") for the purpose of general communication between other players and getting in game support in Ark and Trading Servers, for getting support in Discord Bot Discords. These terms and conditions also govern the use of any website, program, Discord Bot, spreadsheet, or GPT ( the "Projects" or "Services") created by the Company and is pursuant to also abiding by the TOS of the platform that the Project is on.  By using the Server and our Services, you agree to these terms and conditions in full. If you do not agree with these terms and conditions, you must not use the Server or Services offered.

Use of the Server

2.1 You must be at least 13 years old to use most the Servers / Services. If you are under 13 years old, you must not use the Servers / Services.

2.2 You must comply with Discord's Terms of Service (https://discord.com/terms) and Community Guidelines (https://discord.com/guidelines) at all times while using the Servers / Services.

2.3 You must not use the Servers / Services for any illegal or unauthorized purpose, including but not limited to violating any applicable laws or regulations.

2.4 You must not use the Servers / Services to harass, abuse, insult, threaten, or harm any other user.

2.5 You must not use the Servers / Services to distribute spam, viruses, or any other harmful content.

Use of the Bots / GPTs

3.1 The Company provides a Bots / GPT (the "Bot") that can be used on Servers.

3.2 By using the Bots / GPTs, you agree to these additional terms and conditions in full. If you do not agree with these additional terms and conditions, you must not use the Bots / GPTs.

3.3 You must not use the Bots / GPTs for any illegal or unauthorized purpose, including but not limited to violating any applicable laws or regulations.

3.4 You must not use the Bots / GPTs to harass, abuse, insult, threaten, or harm any other user.

3.5 You must not use the Bots / GPTs to distribute spam, viruses, or any other harmful content.

3.6 You must not make any attempt to hack the Bots / GPTS.

3.7 You must protect all private information, if any, contained in or possibly gathered by Bots / GPTs. All private information of any person no matter how obtained must stay private and is not allowed to be shared by the registered Bot or GPT user or anyone they allow to use their Bot or GPT.

3.8 While our Bots / GPTs will not have the sole purpose of collecting personal information, sometimes during the course of using a Bot or GPT to get the end result the user is wanting, some information considered to be personal by the user may have been entered by them. We will never willingly and knowingly share this information to anyone and expect our users to abide by the same principle.

Limitation of Liability

4.1 The Company is not responsible for any loss or damage that may arise from your use of the Servers / Services or the Bots / GPTs.

4.2 The Company is not responsible for any loss or damage that may arise from the unavailability of the Servers / Services or the Bots / GPTs.

4.3 The Company is not responsible for any loss or damage that may arise from the use of the Servers / Services or the Bots / GPTs by third parties.

Indemnification

You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising from your use of the Servers /  Services or the Bots / GPTs or any violation of these terms and conditions.

Changes to these Terms and Conditions

The Company may modify these terms and conditions at any time. If we do so, we will notify you by posting the revised terms and conditions on the Servers. Your continued use of the Server after the revised terms and conditions have been posted will constitute your acceptance of the revised terms and conditions.

Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of the state of Alabama in the country of United States of America, without giving effect to any principles of conflicts of law. Any legal action arising out of or relating to these terms and conditions shall be filed exclusively in the courts located in the state of Alabama in the country of United States of America, and you hereby consent to the personal jurisdiction of such courts.

Entire Agreement

These terms and conditions constitute the entire agreement between you, the user, and the Company regarding your use of the Servers / Services and the Bots / GPTs, and supersede all prior agreements and understandings, whether written or oral, relating to the same subject matter.

Severability

If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver

The failure of the Company to enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision.
