1. Acceptance of Terms
By downloading, installing, or using the Darling AI Girlfriend Chat application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
2. Eligibility
2.1 You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are 18 years of age or older.
2.2 The App is not intended for, and must not be used by, minors. We do not knowingly permit use by anyone under 18. If we become aware that a user is under 18, we will take steps to restrict or terminate access.
3. Nature of the App — Fictional AI Content
3.1 The App provides conversational interactions with artificial intelligence ("AI Characters"). AI Characters are entirely fictional and are not real people. Any personality, memory, emotion, or affection displayed by an AI Character is simulated by machine-generated text and does not reflect real feelings, consciousness, or intent.
3.2 The App does not connect you with real human beings, does not offer matchmaking or dating services, and is not a substitute for real human relationships, companionship, or professional emotional or psychological support.
3.3 AI-generated responses may occasionally be inaccurate, inconsistent, unexpected, or inappropriate despite our efforts to moderate content. You should not rely on AI Character responses as factual, medical, legal, financial, or professional advice.
4. User Conduct
You agree not to use the App to:
Generate, request, or attempt to generate content involving minors in any romantic, sexual, or exploitative context;
Harass, abuse, or attempt to harm any real person using generated content;
Violate any applicable law in your jurisdiction;
Attempt to reverse-engineer, extract, or misuse the underlying AI models or systems powering the App;
Use automated means (bots, scripts) to interact with the App.
We reserve the right to suspend or terminate access for any user who violates this section, without refund of any purchased subscription or credits.
5. Subscriptions and Purchases
5.1 The App offers optional auto-renewing subscriptions ("Premium") purchased through the Google Play Store (and Apple App Store, if applicable), which remove advertisements and/or unlock additional features as described in the App at time of purchase.
5.2 All purchases are billed and processed by the applicable app store (Google Play / Apple App Store), not directly by us. Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period, in accordance with the app store's billing terms.
5.3 Refunds are governed by the refund policies of the Google Play Store or Apple App Store, as applicable. We do not directly process refunds; please contact the relevant app store's support for refund requests.
5.4 We reserve the right to change subscription pricing and features with reasonable notice. Changes will not apply retroactively to an already-active billing period.
6. Advertisements
6.1 The free version of the App displays advertisements served by third-party advertising networks and mediation platforms (including but not limited to Google AdMob, Unity Ads/LevelPlay, and AppLovin MAX, and networks mediated through them).
6.2 These third parties may collect certain device and usage data (such as advertising identifiers) to serve and measure ads, in accordance with their own privacy policies. See our [Privacy Policy] for details.
6.3 Certain features may require watching a rewarded advertisement to unlock content (e.g., additional AI responses or images). Ad availability is not guaranteed and may vary by region, network conditions, or ad inventory.
7. Chat Data and Local Storage
7.1 Your conversation history is stored locally on your device and is not stored on our servers as a persistent user profile. If you uninstall the App, switch devices, or clear app data, your chat history will be permanently lost. We are not responsible for recovering lost local data.
7.2 To generate AI responses, the text of your messages is transmitted to our AI service provider (currently Google's Gemini API) for processing. See our [Privacy Policy] for details on this data flow.
8. Intellectual Property
8.1 All content within the App — including AI Character designs, artwork, branding, and software — is owned by Digital Dhandha or its licensors and is protected by applicable intellectual property laws.
8.2 You may not copy, redistribute, sell, or create derivative works from App content without our prior written consent.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted availability. AI-generated content may contain errors or unexpected outputs.
10. Limitation of Liability
To the maximum extent permitted by law, Digital Dhandha shall not be liable for any indirect, incidental, emotional, or consequential damages arising from your use of the App, including reliance on AI-generated content or loss of locally stored chat data.
11. Emotional Wellbeing Notice
The App is designed for entertainment purposes. It is not a mental health service and is not a substitute for professional support. If you are experiencing distress, loneliness, or a mental health crisis, please seek support from a qualified professional or a local support helpline.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. Material changes will be communicated via an in-app notice where feasible.
13. Governing Law
