These Terms of Service ("Terms", "Terms of Service", or "Agreement") govern your access to and use of the Cyclist Alarm mobile application and related services ("Cyclist Alarm", "Application", "App", or "Service") developed and operated by DevoneSoft ("DevoneSoft", "we", "us", or "our").

By downloading, installing, accessing, or using Cyclist Alarm, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Application.

1. ABOUT CYCLIST ALARM

Cyclist Alarm is a cycling-focused mobile application designed to provide users with tools and information related to cycling, training, fitness, performance, nutrition, and cycling safety.

Depending on the version of the Application and the features available to you, Cyclist Alarm may provide:

• AI-assisted training plans;

• Fitness and performance analysis;

• Nutrition recommendations;

• Cycling activity analysis;

• Ride statistics;

• Training history;

• AI-generated feedback;

• Cycling-related notifications;

• Advertisements.

Future versions of the Application may also include:

• GPS ride tracking;

• Live maps;

• Speed tracking;

• Route recording;

• Pothole alerts;

• Roadwork alerts;

• Hazard alerts;

• User-submitted road condition reports;

• Cycling groups;

• Cycling events;

• Social profiles;

• Ride sharing;

• Route sharing;

• Other community features.

Not every feature described in these Terms is necessarily available at the time you access the Application.

2. ELIGIBILITY

You may use Cyclist Alarm only if you are legally permitted to enter into a binding agreement under the laws applicable to you.

If you are under the minimum legal age required to use the Application in your jurisdiction, you may only use Cyclist Alarm with the involvement and permission of a parent or legal guardian where required by applicable law.

6. NO MEDICAL OR PROFESSIONAL ADVICE

Cyclist Alarm is intended for general cycling, fitness, training, and wellness purposes.

Cyclist Alarm is not a medical service.

The Application does not provide:

• Medical diagnosis;

• Medical treatment;

• Emergency medical services;

• Professional medical advice;

• Professional dietary treatment;

• Clinical assessment;

• Medical monitoring.

Training and nutrition recommendations generated by Cyclist Alarm or its AI systems are general informational recommendations and should not be considered a substitute for advice from a qualified physician, dietitian, sports physician, physiotherapist, or other qualified professional.

If you have a medical condition, injury, cardiovascular condition, respiratory condition, eating disorder, allergy, medication requirement, or other health concern, consult an appropriately qualified healthcare professional before starting or changing an exercise or nutrition program.

7. CYCLING AND PHYSICAL ACTIVITY RISKS

Cycling and physical exercise involve inherent risks, including but not limited to:

• Falls;

• Collisions;

• Traffic accidents;

• Road hazards;

• Potholes;

• Construction areas;

• Weather conditions;

• Equipment failure;

• Physical exhaustion;

• Dehydration;

• Injury;

• Serious bodily harm;

• Death.

You are solely responsible for determining whether you are physically and mentally capable of performing an activity.

You must comply with applicable traffic laws, cycling regulations, safety requirements, and local rules.

Always use appropriate safety equipment, including a properly fitted helmet where appropriate or required.

You should not use Cyclist Alarm in a manner that distracts you from safely controlling your bicycle or paying attention to traffic and surrounding conditions.

8. DO NOT RELY ON THE APPLICATION FOR EMERGENCY OR SAFETY-CRITICAL INFORMATION

Cyclist Alarm is not an emergency response system.

Information provided by the Application, including:

• Speed;

• GPS position;

• Road hazards;

• Pothole alerts;

• Roadwork alerts;

• Weather-related information;

• Route information;

• AI-generated recommendations;

may be inaccurate, delayed, incomplete, unavailable, or affected by technical limitations.

You must not rely exclusively on Cyclist Alarm for safety-critical decisions.

Always independently observe your surroundings and comply with road signs, traffic signals, official warnings, and applicable laws.

9. GPS, LOCATION, AND ROUTE FEATURES

Some Cyclist Alarm features may require GPS or location access.

When enabled, these features may allow the Application to:

• Record your route;

• Calculate distance;

• Calculate speed;

• Display your location on a map;

• Analyze your ride;

• Provide route-related information;

• Provide cycling safety alerts.

Hazard information may be based on user reports, automated systems, third-party information, or other sources.

DevoneSoft does not guarantee that any reported hazard is:

• Accurate;

• Current;

• Complete;

• Still present;

• Located precisely;

• Relevant to your specific route.

You must independently assess road conditions and never assume that an absence of an alert means that a road is safe.

11. SPEED AND PERFORMANCE INFORMATION

Cyclist Alarm may calculate or display cycling performance information, including:

• Current speed;

• Average speed;

• Maximum speed;

• Distance;

• Duration;

• Elevation;

• Cadence;

• Power;

• Heart rate;

• Estimated calories;

• Other performance metrics.

These values may be estimated or calculated from available device or sensor data and may not always be accurate.

Cyclist Alarm does not guarantee the accuracy of any performance measurement.

12. NUTRITION FEATURES

Cyclist Alarm may provide nutrition-related suggestions based on information supplied by you.

Such information is intended for general informational and fitness purposes.

Nutrition recommendations are not medical or clinical dietary advice.

You are responsible for considering:

• Allergies;

• Medical conditions;

Exercise appropriate caution when meeting individuals you first encountered through Cyclist Alarm.

Before publicly sharing information, consider whether it contains:

Except where expressly permitted by these Terms or applicable law, you may not:

• Sell;

• Lease;

• Reverse engineer;

• Decompile;

• Disassemble;

• Reproduce;

• Create derivative works from;

any part of Cyclist Alarm without prior written authorization.

22. LICENSE TO USE THE APPLICATION

Subject to these Terms, DevoneSoft grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Cyclist Alarm on a compatible device that you own or control.

This license is provided solely for personal and lawful use.

26. ACCOUNT SUSPENSION AND TERMINATION

• GPS information will always be accurate;

• Training recommendations will produce specific results;

• The Application will meet every user's requirements.

Nothing in these Terms excludes any consumer rights or mandatory legal protections that cannot lawfully be excluded.

28. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, DevoneSoft shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to your use of Cyclist Alarm.

This may include, where legally permitted:

29. YOUR RESPONSIBILITY WHILE CYCLING

You remain solely responsible for safe cycling practices.

You agree to:

• Follow applicable traffic laws;

• Follow road signs and signals;

• Maintain control of your bicycle;

• Use appropriate safety equipment;

• Avoid using the Application in a distracting manner;

• Verify route and hazard information independently;

• Stop cycling if you become unwell or unsafe to continue;

• Seek professional medical assistance when appropriate.

Do not interact with your phone in a way that compromises your safety while riding.

30. INDEMNIFICATION

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless DevoneSoft and its officers, employees, contractors, service providers, and affiliates from claims, damages, liabilities, losses, and expenses arising from:

• Your violation of these Terms;

• Your unlawful use of the Application;

• Your User-Generated Content;

• Your violation of another person's rights;

• Your misuse of the Service;

• Your violation of applicable laws.

This section does not apply to the extent that the claim results from DevoneSoft's own unlawful conduct or liability that cannot legally be excluded.
