Cyberfire Creations Terms of Service

Effective as of 08/26/2022

These terms of service can be updated and/or modified at any time, for any reason. (Last Updated: 06/18/2024)

For purposes of these terms of service, the term "I/me" will refer to cyberfire creations: the person/entity doing the work and providing the service; whereas "you/your" will refer to you as the consumer/client/buyer that has paid for a commission/service. I have the right to refuse service to anyone, with or without reason.

Payments

Payments will only be made and accepted through ®PayPal (by means of their estimate and invoice system).

Partial payments are accepted, however, the digital item will not be sent until final payment is received.

If avatar costs are included, work will not begin, until the full cost of the avatar is covered. 

Tips are also accepted, but not expected or required.

Requesting Avatar Files

If you are requesting for me to send you the files, for either you or another avatar artist to work on, there will be a $40 transfer fee. Proof of purchase of any assets included in the project will also be required. Because I am operating a business, giving the files away interrupts business.

Privacy

• Emails: Emails are collected in order to send invoices and estimates through ®PayPal’s invoicing system. Emails are never shared/sold to third parties of any kind. If a document is used to store emails (such as a text document for business purposes) the file will be encrypted and then stored on an encrypted PortableUSB Device.

• Account Logins: Account Logins are collected to allow me to upload an avatar to your account, albeit either VRChat or ChilloutVR. Account logins are never shared/sold to third parties of any kind. If a document is used to store said login info (such as a text document) the file will be encrypted and then stored on an encrypted PortableUSB Device.

Returns and Refunds:

I do not accept returns or provide refunds on any commission once the digital item has left my possession. Once payment has been received and the file has been transferred/sent/uploaded; No returns and No refunds and thats final.

Refunds will be handled on a case to case basis, but will follow the general rule of thumb that Labor and Avatar costs will not be refunded. When I upload your avatar, a screenshot is taken to prove the date, time, and account in which it was uploaded. For legal purposes, these are stored on a encrypted USB Drive as legal proof that it has been uploaded. This is to protect me as the commissionee.

When will refunds NOT be issued:

- Avatars | If I have uploaded your avatar to vrchat, or chillout; refunds will not be issued.

- Discord | Once ownership of the discord server has been transferred to the client, refunds will not be issued.

- VRM | Upon sending you the VRM file; refunds will not be issued.

- Photography | Upon sending you the taken photos (editted or uneditted); refunds will not be issued.

Avatar Makers ToS

Regarding the ToS of the creators of avatars:

- If an avatar creator states in their ToS that certain things 

cannot be done on their avatar, I will be following that rule.

Not Safe for Work (NSFW) (18+) Assets:

Regarding the addition of NSFW assets:

- Any avatar that looks "child like", I will not add NSFW to.

- If an avatar creator states they don't want NSFW edits/additions 

to their avatar, I will NOT add NSFW to said avatar.

- Proof of age (18+) will be required for me to do NSFW work.
