You're not required to do a field sobriety test and that is not the examination they are looking at for a rejection. If you decline the Intoxilyzer equipment at the police headquarters they can file a rejection charge. As a criminal justice attorney my advice is don’t do the field test because they're developed for individuals to fail and are very complicated

The horizontal gaze nystagmus. They're looking for wiggling of the eyes. If you’ve been drinking there can be uncontrolled eye activity.

They’ll ask you to take the field test numerous times. If you refuse there are no penalties. However they’ll take you to jail and ask you to blow in the Intoxilyzer. If you reject that you’ll be charged with refusal.
